HomeMy WebLinkAbout2006-102 - Amendments to Sections 110.150 and 110.140 of the Municipal Codef s,~ ~ BILL N0.2006-102 ORDINANCE N0.2006-102 AN ORDINANCE AMENDING SECTION 110.150 AND SECTION 110.140 OF THE MUNICIPAL CODE OF THE CTTY OF RIVERSIDE, MISSOURI, BY AMENDING PROVISIONS REGARDING THE REGULAR MEETING TIMES OF THE BOARD OF ALDERMEN AND THE PLANNING COMMISSION AND PROVIDING FOR THE INCLUSION OF ORDINANCE 95-81 IN THE RIVERSIDE MUNICIPAL CODE SECTION 110.040 REGARDING THE COMPENSATION FOR THE MAYOR AND BOARD OF ALDERMEN FOR ATTENDANCE AT BOARD OF ALDERMEN MEETINGS WHEREAS, the City of Riverside, Missouri (the "City") and its staff have conducted a comprehensive review of the City's Municipal Code (the "Code") sections regazding the meeting times of the Boazd of Aldermen and the Planning Commission; and WHEREAS, by Ordinance 95-81 duly passed September 12, 1995, the City of established the amount to be paid to the Mayor and members of the Boazd of Aldermen for attendance at meetings of the Boazd of Aldermen; and WHEREAS, the Boazd of Aldermen believes that the provisions of Ordinance 95-81 should be included in the Riverside Municipal Code; and WHEREAS, the City staff and the Board of Aldermen have reviewed, examined and deemed adoption of the amendments to be advisable and in the City's best interests for the promotion of the health, safety and welfaze of the residents of the City. NOW, THERFORE, be it ordained by the Board of Aldermen of the City of Riverside, Missouri, as follows: Section 1. Section 110.050 of the Municipal Code of the City of Riverside, Missouri is hereby amended, and shall read as follows: ARTICLE II. BOARD OF ALDERMEN-MEETINGS AND PROCEDURE SECTION 110.150: REGULAR MEETING TIMES OF BOARD OF ALDERMEN AND PLANNING COMMISSION-NOTICE FOR SPECIAL MEETINGS OF SAID BOARD AND COMMISSION A. The regulaz meeting time for the Boazd of Aldermen of the City of Riverside, Missouri, is hereby designated as the first (ls`) and third (3'~) Tuesdays of each month at 7:00 p.m., at City Hall, Riverside, Missouri. The Mayor or any four (4) Aldermen may call a special meeting of the Boazd of Aldermen by submitting a written notice of said meeting to the City Administrator at least twenty-four (24) hours prior to the commencement of the proposed special meeting excluding Saturdays and Sundays and legal holidays. It shall be the duty of the City Administrator to post notice of said meeting at a prominent place at City Hall and to notify any members of the news media who have requested notice of meetings of the Board of Aldermen no less than twenty-four (24) hours prior to the ~. i 1 .. .. ~ ~. - ~` commencement of said meeting. In the event there is good cause such notice is impossible or impractical, then the City Administrator shall give such notice as reasonably possible and the nature of the good cause justifying that departure from the normal requirements shall be stated in the minutes. B. The regular meeting time for the Planning Commission of the City of Riverside, Missouri, is hereby designated as the second (2"a) and fourth (4~') Thursdays of each and every month at 7:00 p.m. at City Hall, Riverside, Missouri. The Chairman may call a special meeting of the Commission by submitting written notice of said meeting to the City Administrator no less than twenty-four (24) hours prior to the commencement of the proposed meeting excluding Saturdays and Sundays. It shall be the duty of the City Administrator to post notice of said meeting at a prominent place at City Hall and to notify any members of the news media who have requested notice of meetings of the Planning Commission no less than twenty-four (24) hours prior to the commencement of said meeting. Section 2. Section 110.140 of the Municipal Code of the City of Riverside, Missouri hereby amended, and shall read as follows: SECTION 110.140: SALARY OF OFFICERS AND EMPLOYEES A. The non-elected officers and employees of the City shall receive such salary as may be determined by ordinance by the majority of the members elected to the Board of Aldermen. The pay for the Mayor shall be $225.00 per meeting with a limit of five (5) meetings per month. The pay for members of the Boazd of Aldermen shall be $100.00 per meeting with a limit of five (5) meetings per month. Section 3. The provisions of the Municipal Code of the City of Riverside, Missouri amended herein shall not be construed to revive any former ordinance, clause or provision of the Municipal Code of the City of Riverside, Missouri. Section 4. The sections, paragraphs, clauses, and phrases of the Ordinance aze severable and if any portion of the Ordinance is declared unlawful by the valid judgment, decree, or injunction order of a court of competent jurisdiction, such ruling shall not affect any of the remaining phrases, clauses, sentences, pazagraphs, and sections of the Ordinance and all provisions of the Ordinance not specifically declared to be unlawful shall remain in full force and effect. Section 5. This Ordinance overrides any conflicting provision or regulation within the Municipal Code of the City of Riverside, Missouri. Section 6. This ordinance shall take effect immediately.
