HomeMy WebLinkAbout2006-116 - Amendments to Municipal Code Regarding Permit Fees and Adopting a Development Fee ScheduleuI, ~ ~ BILL NO. 2006-116 ORDINANCE N0.2006-116 AN ORDINANCE AMENDING CHAPTER 400, CHAPTER 430, CHAPTER 435, CHAPTER 440, CHAPTER 485, AND CHAPTER 505 OF THE MUNICIPAL CODE OF THE CITY OF RIVERSIDE, MISSOURI, BY AMENDING PROVISIONS REGARDING PERMIT FEES AND ADOPTING A DEVELOPMENT FEE SCHEDULE WHEREAS, the City of Riverside, Missouri (the "City") and its staff have conducted a comprehensive review of the City's Municipal Code (the "Code") sections regarding permit fees currently charged by the City related to planning and zoning activities, including building permits, sign permits, subdivision of land, special use permits, and zoning changes; and WHEREAS, the City staff has prepared a schedule of proposed revisions to the fees charged by the City for planning and zoning activities; and WHEREAS, the Riverside Planning & Zoning Commission, at a public hearing held on July 13, 2006 considered and discussed amendments to the City Code's Sections regarding permit fees and the proposed fee schedule; and WHEREAS, after such consideration and discussion, the Planning & Zoning Commission recommended that the City's Board of Aldermen adopt the proposed amendments; and WHEREAS, during a public hearing held during its meeting on July 18, 2006 the Board of Aldermen considered and discussed the proposed amendments and the recommendation of the Planning & Zoning Commission; and WHEREAS, the Board of Aldermen has determined it to be in the City's best interests to accept the Planning & Zoning Commission's recommendation and adopt the proposed amendments; and WHEREAS, the City staff and the Board of Aldermen have reviewed, examined and deemed adoption of the amendments to be advisable and in the City's best interests for the promotion of the health, safety and welfare of the residents of the City. NOW, THERFORE, be it ordained by the Board of Aldermen of the City of Riverside, Missouri, as follows: Section 1. The Board of Aldermen makes the following findings of fact and conclusions: (a) The City staff, Planning & Zoning Commission, and Board of Aldermen reviewed the time spent by City employees in connection with each type of activity, the volume of applications and permits for each type, and the actual cost to the City for staff time and supplies. The City staff, Planning & Zoning Commission, and ~. _ i .. r c Board of Aldermen also reviewed the fees charged by neighboring cities for similar services to assist the City in determining whether the costs incurred by the City are reasonable. (b) The City has historically charged fees for planning and zoning activities, including building permits, sign permits, subdivision of land, and special use permits and zoning changes. (c) The City has experiences substantial increases in the costs of City staff time and supplies necessary for these planning and zoning activities. (d) These planning and zoning activities provide a positive service to the payor by increased safety and efficienpy and reduced cost in connection with construction and land development. (e) These fees are paid only on or after the provision of the planning and zoning services, and are charged to the actual user of the services. (f) The revised fee schedule proposed by City staff includes fees for services which reflect the level of service charged to the fee payor. (g) The revised fees are reasonably related to the cost to the City of providing the services. Section 2. Riverside Municipal Code Section 400.090 "Fees" shall be deleted in its entirety. Section 3. Riverside Municipal Code Section 430.200 shall be deleted in its entirety. Section 4. Riverside Municipal Code Section 435.010 "Fees" shall be amended to add subsection C to read as follows: C. Penalty. A penalty shall be assessed to all permit fees when work proceeded without a permit. This penalty shall be 20% of the initial permit fee for permits issued in Residential zoning districts and shall be 50% of the initial permit fee for permits issued in all other zoning districts. Section 5. Riverside Municipal Code Section 435.045 "Fees for Building Permits" shall be deleted in its entirety and replaced by the following: SECTION 435.045: RIVERSIDE FEE SCHEDULE A. The provisions of the Municipal Code of the City of Riverside, Missouri amended herein shall not be construed to revive any former ordinance, clause or provision of the Municipal Code of the City of Riverside, Missouri. Section 7. The sections, paragraphs, clauses, and phrases of the Ordinance are severable and if any portion of the Ordinance is declared unlawful by the valid judgment, decree, or injunction order of a court of competent jurisdiction, such ruling shall not affect any of the remaining phrases, clauses, sentences, paragraphs, and sections of the Ordinance and all provisions of the Ordinance not specifically declared to be unlawful shall remain in full force and effect. Section 8. This Ordinance overrides any conflicting provision or regulation within the Municipal Code of the City of Riverside, Missouri. ~. .. I ,,. .. 1 ~, :. . Section 9.
