AN ORDINANCE APPROVING THE MISSOURI HIGHWAYS AND
TRANSPORTATION COMMISSION ADOPT-A-HIGHWAY AGREEMENT
BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF RIVERSIDE,
MISSOURI AS FOLLOWS:
Section 1. That the Riverside Board of Aldermen ('Board") hereby approves the Missouri
Highways and Transportation Commission Adopt-A-Highway Agreement, in
substantially the form attached hereto, by and between the City of Riverside and the
Missouri Highways and Transportation Commission. The Mayor is authorized to
execute the Agreement on the City's behalf.
Section 2. The Mayor, the City Administrator, and other appropriate City officials are hereby
authorized to take any and all actions as may be deemed necessary or convenient to
carry out and comply with the intent of this Ordinance and to execute and deliver for
and on behalf of the City all certificates, instruments, agreements and other
documents, as may be necessary or convenient to perform all matters herein
authorized.
Section 3. This Ordinance shall be in full force and effect from and after its passage and
approval.
BE IT REMEMBERED that the above was read two times by heading only, PASSED AND
APPROVED by a majority of the B�Qard of Aldermen and APPROVED by the Mayor of the

The City of Riverside Beatification Agreement

With the Missouri Department of Transportation
i
As part of the agreement Riverside would like to do additional mowing and seeding of grass areas on
Modot Right of Way within the city limits. (Approximately 400 acres, including pavement surface.)
Modot and the City of Riverside will continue to work cooperatively to remove invasive brush and tree
species, but as these areas become cleared the City of Riverside will seed and mow these areas to keep
them free of undesirable brush.
r The City of Riverside would also like to establish areas of native flower/grass plantings. These planting
shall consist of flowers that reach no more than 36"in height and all invasive weeds and brush will be
removed from them without burning.

If the City can no longer continue the agreement the City or its representative will give written notice to
Modot Roadside Manager and Northmoor Building Supervisor.
City of Riverside will follow all Modot safety procedures while working on Modot right of Way which
includes the following:
All equipment used on Modot Right of Way shall be equipped with either a white strobe or flashing
amber light.
All mowing equipment shall have a slow-moving vehicle placard attached and all safety shields or
devices properly installed and maintained.
i Actions by City of Riverside personnel or its contractors that result in damage to desirable vegetation,
curbs, sidewalks,structures, mail boxes,signs,or roadway traffic shall be repaired at the City of
Riverside's expense.
All work shall be performed during daylight hours. All equipment and vehicles shall not park in a way so
as to obstruct traffic flow.
When operating mowing equipment standard 48" orange "MOWERS AHEAD"signs shall be placed a
maximum of one mile in advance of the operations,and at intervals not to exceed one mile within the
operation. Workers shall place all signs prior to beginning work and shall relocate as work progresses.
All workers within highway right of way shall wear ANSI/]SEA 107 Performance Class 2 or 3 vests,a high
visibility hard hat,safety glasses and safety toe footwear.

her knowledge and if he or she has submitted any false statements of a material fact or have practiced or attempted to
practice any fraud or deception,the Commission may refuse to grant the request to participate in the program.

2.Eligibility: Individuals,as Adopters or as members of Adopter organizations and enterprises,will not be approved to
participate in the program if they have been convicted of,or pled guilty or no contest to,a violent criminal activity,unless 10
years have passed since completion of the latest incarceration,probation or parole for violent criminal activity.
3.Administrative Rules:The Adopter shall comply with the administrative rules of the Missouri Department of
Transportation,under Title 7,Chapter 14,including any rules promulgated or amended after the date of this Agreement.
4.Amendments:Any change in this Agreement,whether by modification or supplementation,must be accomplished by a
formal contract amendment signed and approved by the Adopter representative and the Commission.

� 5. Signs:The sign shall have the actual name of either the adopter, or an individual in whose memory the adoption is being
made,and shall not include telephone numbers, logos,slogans,dates, addresses,or Internet addresses. Please keep verbiage to
a minimum for case of reading. The Adopter's requested identification on the sign is worded as follows,with one character
allowed per space:

6. Special Provisions: NA

7.Safety Training: The Adopter or Adopter representative shall obtain safety materials,such as highway safety tips
brochures and videos,from the Commission at a safety briefing,and agrees to abide by all provisions and safety
requirements contained within these materials. Before any participant within a group takes part in the program,he or she
must attend a meeting conducted by the Adopter representative to view these materials and discuss safety.
8.Indemnification:To the extent allowed by law,the Adopter assumes the obligation to indemnify and hold harmless
the Commission, including its officers,employees and agents,from every expense, liability or payment arising from any
claim, lawsuit or liability which may arise from the Adopter's participation in the program.
