Boazd of Aldermen of City of Riverside, Missouri
October 12, 2004
A regulaz meeting of the Board of Aldermen of the City of Riverside, Missouri, was held in the
City Hall, of Riverside, Missouri, October 12, 2004 at 7:00 p.m.
Those in attendance were Mayor Burch, Aldermen Bums, Looker, Dazata, Legaazd, Super and
Beard.
Also present were, David Blackburn, City Administrator, Louise Rusick, City Clerk, Brent Miles,
Planning, Zoning and Community Development Coordinator, John Jackson, City Engineer, John
McClelland, Deborah Polk and Matt Kitzi with the City Attorney's office.
Driveway Discussion It was mentioned that the driveways that were not sealed during the High
on High Drive Drive Street project in 1999 to be replaced.
Marvin Layton, resident said his driveway ran uphill to the doorway and
the construction company, Damon Purcell took out the slope and made the
driveway level.
Alderman Beazd suggested bids be obtained for all the driveways that were
involved in the NW High Drive construction project that are in need of repair
and that easements would need to be obtained.
Driveway repair for Alderman Darata moved to approve the driveway repair for 4920 NW High
4920 NW High Drive Drive, the Layton residence that was involved in the street project in 1999,
Approved seconded by Alderman Looker, the vote was:
Aye: Aldermen Dazata, Looker and Burris.
No: Aldermen Legaard and Beazd.
Abstain: Alderman Super abstained because there is not enough information
from the city attorney regarding statute of limitations.
Motion carries.
Bids obtained for Two bids were obtained to remove a dead tree at 4900 NW High Drive and the
Tree removal at 4900 bids were:
NW High Drive Mr. Tree II Service $2,000
Guazantee Tree Service 1,500
One Tree removal at Alderman Looker moved to approve one tree removal at 4900 NW High Drive
4900 NW High Drive by Guarantee Tree Service, 4120 S. Spring, Independence, Mo. at a cost of
Approved $1,500 due to damage during the 1999 street project , seconded by Alderman
Dazata, the vote was:
Aye: Alderman Bums, Darata, Legaard and Looker.
No: Alderman Beard, because other trees need to be taken care of.
Abstain: Alderman Super.
Motion carries.

Light Pole Discussion John Jackson said there would be temporary lighting down NW Gateway and
tying into West Platte, the fmal portion of the NW Gateway corridor.
Pam Cook, KCPL said there will be another chazge for planned outages or street
lights and the cost approximately $7,800. The contract amounts aze below are
estimated.
Bill No. 2004-93 Alderman Legaazd moved to place Bill No. 2004-93 on its first reading, said
Approv. the form of, Bill approving the form of, and authorizing the Mayor to complete and execute
& author. the Mayor to two utility agreements by and between the City of Riverside, Missouri and
enter into 2 agreements Kansas City Power & Light Company to adjust certain utility facilities placed
w/KCPL in service by Kansas City Power & Light Company, temporary pole relocation
and underground construction at a total cost of $373,612.78, seconded by
Alderman Looker, the vote was:
Aye: Aldermen Looker, Super, Dazata, Legaazd, Beard and Burris.
Motion carries.
Ordinance No. 2004-93 Alderman Burris moved to place Bill No. 2004-93 on its second reading,
Approved and upon passage of same become Ordinance No. 2004-93, seconded
by Alderman Darata, the vote was:
Aye: Aldermen Beazd, Burris, Legaard, Super Looker and Dazata.
Motion carries.
Bill No. 2004-94 Alderman Legaazd moved to place Bill No. 2004-94 on its first reading,
Granting & approv. said Bill granting and approving the execution of a proxy for annual
the execution of a meeting of landowners of Riverside-Quindazo bend Levee District of
proxy for Riverside- Platte County, Missouri and actions related thereto, seconded by Alderman
Quindazo Bend Levee Burris, the vote was:

Ordinance No. 2004-94 Alderman Dazata moved to place Bill No. 2004-94 on its second reading,
Approved and upon passage of same become Ordinance No. 2004-94, seconded
by Alderman Legaard, the vote was:
Aye: Aldermen Beard, Burris, Legaard, Super Looker and Darata.
Motion carries.
Mayor Burch's' Certain Horizons property owners meeting was held today.

Joe Bednar, Joe Bednaz, Armstrong, Teasdale said the state TIF was approved by the
Speaks Director of Economic Development and Office of Administration.
Joe said we are currently in the process of determining the amount of revenue
due the city and we should have payment of that amount within thirty to sixty
days of the final determination of the appropriate amount. We will go through
the same process in February of 2005 for another revenue payment to be made

between Mazch 1 and July 1, 2005. Continuing efforts are ongoing to gain
funding for the cost of the I-635 Interchange by implementing a Transportation
Development District (TDD) and to obtain additional funds from MoDot.
Matt Kitzi speaks The TDD is a specifically defined area of land in which development projects
the boazd and public improvements aze constructed and financed by imposing a special
tax, then bonds, notes or financing instruments on certain sales or property
within the district.
First, a petition must be filed in the Platte County Circuit Court and consent
from the landowners involved to certify the district.
The discussion was a sales tax to be imposed would be the best way. Most of
the sales tax generated would be from the businesses that are operating
presently.
Bob Gieseke, landowner said he didn't think any of the landowners in the
Horizons area would oppose. Bob said landowners would like access on the
west with the Interchange.
Bob said the "wetlands" aze a big issue for the property owners and the "farmed
wetlands" aze different. Deborah Polk said displaced by development,
"wetlands" (farmed) aze yet to be designated. The business owners would like a
map of small areas of the wetlands and who will determine the location of the
wetlands. Deborah Polk and John McClelland said the Corps of Engineers and
the Department of Natural of Resources will determine the location.
The properly owners would like to know why there couldn't be a road to NW
Mattox and when a moratorium would be lifted on the project.
Dan Peak asked, "Who buys the bonds"? Mayor Burch said, "'The city does."
Joe's suggestion is a briefmg book to be prepazed for the boazd and public on
the city's website for aspects of the project as it moves along and public
comments could be made.
There will be another meeting in two to three weeks regarding this matter.
Audit Report Alderman Bums moved to approve the Audit Report for the fiscal yeaz July 1,
for Jul.l, 2003 through Apri12003 through June 30, 2004 prepared by Bruce Culley, CPA seconded by
June 30, 2004 Alderman Darata, the vote was:
Aye: Aldermen Bums, Super, Darata, Legaard, Bazd and Looker.
Motion carries.
Motion for Closed Alderman Darata moved that the meeting go into closed session, pursuant to
Session at 8:45 p.m. RSMo 610.021(2) real estate issues, with the City Attorney, seconded by
Alderman Looker, and the vote was:
Aldermen Beard, Darata, Burns, Super, Looker and Legaazd.
Motion carries.
