HomeMy WebLinkAbout1725 Approving Petition to Establish Riverside Horizons Community Improvement District BILL NO. 2020-024 ORDINANCE NO.-Lia—:5,", AN ORDINANCE APPROVING THE PETITION TO ESTABLISH THE RIVERSIDE HORIZONS COMMUNITY IMPROVEMENT DISTRICT WHEREAS, Sections 67.1401 to 67.1571 RSMo, 2000, as amended (the "CID Act"), authorize the governing body of any city, upon presentation of a proper petition requesting the formation and after a public hearing, to adopt an ordinance establishing a community improvement district; and WHEREAS, the City of Riverside, Missouri (the "City") is a city of the fourth class and a political subdivision of the State of Missouri, duly created, organized and existing under and by virtue of the Constitution and laws of the State of Missouri; and WHEREAS, on May 28, 2020, property owners within the proposed Riverside Horizons Community Improvement District filed with the Clerk of the City (the "City Clerk") a petition for the establishment of a community improvement district pursuant to the CID Act (the "Petition), entitled the Riverside Horizons Community Improvement District (the "District"); and WHEREAS, the City Clerk verified that the Petition substantially complies with the CID Act, submitted the verified Petition to the Board of Aldermen and set a public hearing with all proper notice being given in accordance with the CID Act or other applicable law; and WHEREAS, none of the signatures of the signers of the Petition were withdrawn within seven days after the Petition was filed with the City Clerk; and WHEREAS, all the real property included in the District is entirely located within the City; and WHEREAS, on June 15, 2020, the Board of Aldermen held a public hearing at which all persons interested in the formation of the District were allowed an opportunity to speak and at which time the Board of Aldermen heard all protests and received all endorsements. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN FOR THE CITY OF RIVERSIDE, MISSOURI, as follows: SECTION 1 — APPROVAL OF PETITION. That the Riverside Horizons Community Improvement District is hereby approved and shall be established within the City as a political subdivision of the State of Missouri, as provided in the Petition filed with the City Clerk on May 28, 2020, a copy of which is attached hereto as Exhibit A and incorporated herein by this reference. SECTION 2 —INITIAL BOARD MEMBERS. That the District shall be governed by a board of directors consisting of five (5) members. The names and terms of office of the initial Board of Directors were proposed in the Petition and the following individuals are hereby appointed by the Mayor with the consent of the Board of Aldermen to serve as the Board of Directors for the District for the initial terms set forth below Jill Hammond 4 year term Al Bowman 4 year term Frank Biondo 2 year term Travis Hoover 2 year term Tom Wooddell 2 year term SECTION 3 — PURPOSE AND POWERS. That the District is hereby established for the purposes set forth in the petition; that the District shall have all the powers and authority authorized by the petition the Act, and by law; and that the District shall continue to exist and function in perpetual existence unless terminated in accordance with Missouri law. SECTION 4 — CITY REPORTING. That upon the effective date of this ordinance, the City Clerk is hereby directed to report the creation of the District to the Missouri Department of Economic Development pursuant to Section 67.1421.6 RSMo, by sending a copy of this ordinance to said agency. SECTION 5 — FURTHER AUTHORIZATION. That the City Administrator, City Clerk and such other officials of the City may execute any other additional documents or take such other actions as are necessary, incidental or expedient to carry out the intent of this Ordinance approved and the authority granted herein. SECTION 6 — EFFECTIVE DATE. That this ordinance shall be in full force and effect from and after the date of its passage and approval. The undersigned, collectively representing i) the property owners collectively owning more than fifty percent by assessed value of the real property within the boundaries of the proposed district; and ii) more than fifty percent per capita of all owners of real property within the boundaries of the proposed district,do hereby petition and request that the Board of Aldermen of the City of Riverside, Missouri create a community improvement district pursuant to Missouri law. 1. Property Description. The legal description of the proposed district is set forth in Exhibit A to this Petition and a map illustrating the contiguous boundaries of the District is set forth as Exhibit B. A list of the owners of all properties included within the boundaries of the proposed district as of the date of the filing of this Petition is attached hereto as Exhibit C. 2. District Name. The name of-the proposed district shall be: Riverside Horizons Community Improvement District. 3. Notice to Petitioners. The signers of this Petition understand that their signatures may not be withdrawn from this Petition later than seven(7)days after this Petition is filed with the City Clerk. 4. Purpose and Five Year Plan. A five-year plan stating a description of the purposes of the proposed district, the services it will provide, the improvements it will make and an estimate of costs of these services and improvements to be incurred, is as follows: The proposed district's purpose and five-year plan shall generally include, without being limited to, (A) maintenance of public and privately owned areas, (B) landscape and streetscape maintenance, (C) community development, (D) management and operations, and (E) establishment of a reserve fund. A. Maintenance and Appearance. The proposed district may provide or contract for the provision of maintenance and appearance services to public and private areas. Such services may include, but are not necessarily limited to: litter removal; purchase and maintenance of additional trash receptacles; sidewalk sweeping through manual and mechanical devices;vacuuming sidewalks,public parking lots, streets, and gutters;pressure washing surfaces; steam cleaning sidewalks and street surfaces; weed abatement;purchase,maintain,and install trees,shrubs,flowers and other vegetation;purchase and maintain pots and planters;plant and/or replace trees located or planned to be located in the public right of way; provide, or cause to be provided, design services for planning the type and the location of benches, lighting, public art, banners, trash receptacles, trees, shrubs, flowers, sidewalk repairs and replacement,public parking lot repair and replacement,and street repair and replacement; purchase, maintain, repair and/or install benches, lighting,public art, banners, trash receptacles, trees, shrubs, flowers, and sidewalks; and mowing, seeding and fertilizing grass and other vegetation; scheduled watering; seasonal plantings. B. Community Development. The proposed district may employ or contract for the provision of community development services to provide for its continued growth and sustainability. Such services may include, but are not limited to: buy, sell, or lease property; development of a community gather space (either alone or in conjunction with existing development); develop and implement a retail marketing program; develop and implement targeted promotions to attract visitors; develop and distribute marketing collaterals and advertising; produce and distribute an electronic and/or print periodic newsletter; engage in business recruitment, support and retention. C. Management and Operations. The proposed district -nay hire or contract for personnel to staff and provide professional services. Moreover, the proposed district may furnish, equip and house staff as may be necessary. D. Additional Improvements and Services. The proposed District shall be authorized to provide for any and all desired services and improvements, and shall have the rights needed to provide those desired services and improvements, up to and including any desired service and improvement right not specifically limited, or prevented, by this Petition or the Act. E. Reserve Fund. A reserve account may be created to provide funds to offset slow or delinquent income payments; for unexpected or special situations; or to save funds for future projects. F. Costs estimates. Political Subdivision. Petitioners request the proposed district be created as a political subdivision of the State of Missouri. 6. Governing Board. Petitioners request the proposed district be governed by a Board of Directors (the "Board")appointed by the Mayor of the City, with the consent of the Board of Aldermen. 7. Board Composition. The proposed District shall be governed by a five (5) person Board. The following persons constitute the initial Board of the proposed district and shall serve for the terms specified below. The total assessed value of all real property within the proposed district is $0. 9. Property Not Blighted. Petitioners do not seek a determination that that the proposed district or any part of it is a blighted area. 10. Duration of District. The existence of the proposed district shall be perpetual, unless terminated sooner according to law. 11. Real Property Taxes. The proposed district will not have the power to impose a real property tax or a business license tax. 12. Special Assessments; The proposed district will not have the power to impose special assessments. 13. Sales Taxes. Qualified voters of the proposed district may be asked to approve a sales tax of up to one percent (1%), in accordance with the CID Act, to fund certain improvements within the proposed district and/or to pay the costs of services provided by the proposed district. 14. Borrowing Capacity. Petitioners do not seek limitations on the borrowing capacity of the proposed district. 15. Revenue Generation. Petitioners do not seek limitations on the revenue generation of the proposed district. 16. Powers of District. Petitioners do not seek limitations on the powers of the proposed district.
