M BILL N0.2005-OS ORDINANCE N0.2005-OS AN ORDINANCE AMENDING TITLE V, CHAPTER 500 OF THE MUNICIPAL CODE OF THE CITY OF RIVERSIDE, MISSOURI, BY AMENDING PROVISIONS REGARDING THE ADOPTION OF BUILDING AND CONSTRUCTION CODES WHEREAS, the City of Riverside, Missouri (the "City") and its staff have conducted a comprehensive review of the City's Municipal Code (the "Code") sections regarding the adoption of building and construction codes; and WHEREAS, the City staff and the Board of Aldermen have reviewed, examined and deemed adoption of the amendments to be advisable and in the City's best interests for the promotion of the health, safety and welfare of the residents of the City. NOW, THERFORE, be it ordained by the Board of Aldermen of the City of Riverside, Missouri, as follows: Section 1. Title V. Building and Construction, Chapter 500: Code Adoptions of the Municipal Code of the City of Riverside, Missouri is hereby amended, and shall read as follows: ARTICLE I. BUILDING CODE ADOPTION SECTION 500.010: ADOPTION OF THE INTERNATIONAL BUILDING CODE A. Adoption. The International Building Code , 2003 Edition, as published by the International Code Council, Inc., including: Appendix Chapter A- AGRICULTURAL BUILDINGS Appendix Chapter I- PATIO COVERS Appendix Chapter J- GRADING is hereby enacted and made part of this Section by reference except as to portions hereinafter specifically deleted, clarified or amended: B. If any conflict should exist between the International Building Code and the Zoning Code of the City of Riverside, Missouri, the provisions of the Zoning Code shall control. If any conflict should exist between the International Building Code and any other ordinance of the City of Riverside, Missouri, the International Building Code provisions shall control and the portion of the ordinance in conflict with the International Building Code provision shall be repealed. Such repeal will affect only that portion of any ordinance which is in conflict with the International Building Code and shall not affect any other portions of the ordinance. ,~~ '. ,;• C. The following changes shall be made in the International Building Code: 1. Amend Subsection 101.1. by adding: City of Riverside, Missouri. 2 Delete Subsection 101.2, Exception 2: "International Existing Building Code." 3. Amend Subsection 101.4.5 by replacing a reference to The International Property Maintenance Code with a reference to Chapter 490: PROPERTY MAINTENANCE REGULATIONS of the Municipal Code of the City of Riverside Missouri. 4. Delete Subsection 101.4.7: "The International Energy Conservation Code." 5. Delete Subsection 112: "BOARD OFAPPEALS" 6. Delete Subsection 108.6: Fee refunds 7. Amend Subsection 3410.2 by adding [the date of passage of this Ordinance]. ARTICLE II. PLUMBING CODE SECTION 500.020: ADOPTION OF THE INTERNATIONAL PLUMBING CODE A. The International Plumbing Code®, 2003 Edition, as published by the International Code Council, Inc., is hereby enacted and made part of this Section by reference except as to portions hereinafter specifically deleted, clarified or amended. B. If any conflict should exist between the International Plumbing Code and the Zoning Code of the City of Riverside, Missouri, the provisions of the Zoning Code shall control. If any conflict should exist between the International Building Code and any other ordinance of the City of Riverside, Missouri, the International Plumbing Code provisions shall control and the portion of the ordinance in conflict with the International Plumbing Code provision shall be repealed. Such repeal will affect only that portion of any ordinance which is in conflict with the International Plumbing Code and shall not affect any other portions of the ordinance. C. The following changes shall be made in the International Plumbing Code: 1. Amend Subsection 101.1. by adding: City of Riverside, Missouri. 2. Delete Subsection 101.2, Exception 2: "International Existing Building Code." 3. Delete Subsection 106.5.2: "Fee schedule." 4. Delete Subsection 106.6.3: "Fee refunds." ~1 ~ - 1 V. 5. Delete Subsection 108.4: "Violation penalties." 6. Amend the last sentence of Subsection 108.5 as follows: "Any person who shall continue any work in or about the structure after having been served a stop work order, except such work as that person is directed to perform to remove a violation or unsafe condition, shall be subject to penalties prescribed by law. 7. Delete Section 109: "BOARD OFAPPEALS." 8. Amend Subsection 305.6.1 by inserting: "twenty four inches (24")" in both the "private disposal system" [NUMBER] brackets and in the "Building Sewers" [NUMBER] brackets. ARTICLE III. FUEL GAS CODE SECTION 500.030: ADOPTION OF THE INTERNATIONAL FUEL GAS CODE A. The International Fuel Gas Code®, 2003 Edition, as published by the International Code Council, Inc., including: Appendix Chapter A- SIZING AND CAPACITY OF GAS PIPING Appendix Chapter B- SIZING OF VENTING SYSTEMS SERVING APPLIANCES EQUIPPED WITH DRAFT HOODS, CATEGORY 1 APPLIANCES, AND APPLIANCES LISTED FOR USE WITH TYPE B VENTS. Appendix Chapter C- EXIT TERMINALS OF MECHANICAL DRAFT AND D112ECT- VENT VENTING SYSTEMS. is hereby enacted and made part of this Section by reference except as to portions hereinafter specifically deleted, clarified or amended. B. If any conflict should exist between the International Fuel Gas Code and the Zoning Code of the City of Riverside, Missouri, the provisions of the Zoning Code shall control. If any conflict should exist between the International Fuel Gas Code and any other ordinance of the City of Riverside, Missouri, the International Fuel Gas Code provisions shall control and the portion of the ordinance in conflict with the International Fuel Gas Code provision shall be repealed. Such repeal will affect only that portion of any ordinance which is in conflict with the International Fuel Gas Code and shall not affect any other portions of the ordinance. C. The following changes shall be made in the International Fuel Gas Code: 1. Amend Subsection 101.1. by adding: City of Riverside, Missouri. 2. MECHANICAL CODE SECTION 500.040: ADOPTION OF THE INTERNATIONAL MECHANICAL CODE A. The International Mechanical Code®, 2003 Edition, as published by the International Code Council, Inc., is hereby enacted and made part of this Section by reference except as to portions hereinafter specifically deleted, clarified or amended. B. If any conflict should exist between the International Mechanical Code and the Zoning Code of the City of Riverside, Missouri, the provisions of the Zoning Code shall control. If any conflict should exist between the International Mechanical Code and any other ordinance of the City of Riverside, Missouri, the International Mechanical Code provisions shall control and the portion of the ordinance in conflict with the International Mechanical Code provision shall be repealed. Such repeal will affect only that portion of any ordinance which is in conflict with the International Mechanical Code and shall not affect any other portions of the ordinance. C. The following changes shall be made in the International Mechanical Code: 1. Amend Subsection 101.1 by adding: City of Riverside, Missouri. 2. Delete Subsection 101.2, Exception 2.: "International Existing Building Code." 3. Delete Subsection 106.5.2: "Fee schedule." 4. Delete Subsection 106.5.3: "Fee refunds." 5. Delete Subsection 108.4: "Violation penalties." 6. Delete within Subsection 108.5: "Dollar Amounts In Two Locations." 7. Delete Section 109: "MEANS OFAPPEAL." ARTICLE V. ELECTRICAL CODE T ~ i ¶ ,~. ., T ~, . ',, SECTION 500.050: ADOPTION OF THE INTERNATIONAL SERIES OF THE NATIONAL ELECTRICAL CODE A. The International Series of the National Electrical Code®, 2002 Edition, including Article 80 Administration and Enforcement therein as prepared by the National Electrical Code Committee and acted upon by the National Fire Protection Association, Inc., is hereby enacted and made part of this Section by reference except as to portions hereinafter specifically deleted, clarified or amended. B. If any conflict should exist between the International Series of the National Electrical Code and the Zoning Code of the City of Riverside, Missouri, the provisions of the Zoning Code shall control. If any conflict should exist between the International Series of the National Electrical Code and any other ordinance of the City of Riverside, Missouri, the International Series of the National Electrical Code provisions shall control and the portion of the ordinance in conflict with the International Series of the National Electrical Code provision shall be repealed. Such repeal will affect only that portion of any ordinance which is in conflict with the International Series of the National Electrical Code and shall not affect any other portions of the ordinance. C. The following changes shall be made in the International Series of the National Electrical Code: 1. Delete definition of "Electrical Inspector" included in Section 80.2. 2. Delete Subsection 80.15: "ELECTRICAL BOARD." 3. Delete Subsection 80.23(B)(3): "Penalties." 4. Delete Subsection 80.27: "Inspector's Qualifications." ARTICLE VI. FIRE CODE SECTION 500.060: ADOPTION OF THE INTERNATIONAL FIRE CODE A. The International Fire Code®, 2003 Edition, as published by the International Code Council, Inc., including: Appendix Chapter B- FIRE-FLOW REQUIREMENTS FOR BUILDINGS Appendix Chapter C- FIRE HYDRANT LOCATIONS AND DISTRIBUTION Appendix Chapter D- FIRE APPARATUS ACCESS ROAD Appendix Chapter E- HAZARD CATEGORIES ~, . .. ~ 1 ,~, ~ .. . The following changes shall be made in the International Fire Code: 1. Amend Subsection 101.1 by adding: City of Riverside, Missouri. 2. Amend Subsection 102.3 by replacing the reference to The International Property Maintenance Code with a reference Chapter 490: PROPERTY MAINTENANCE REGULATIONS of the Municipal Code of the City of Riverside Missouri. 3. Delete Subsection 102.4: "International Existing Building Code." 4. Delete Section 103: "DEPARTMENT OFFIRE PREVENTION' 5. Delete Subsection 108.1: "BOARD OFAPPEALS." 6. Delete Subsection 109.3: "Violation penalties." ARTICLE VII. RESIDENTIAL CODE SECTION 500.070: ADOPTION OF THE INTERNATIONAL RESIDENTIAL CODE FOR ONE- AND TWO- FAMILY DWELLINGS A. The International Residential Building Code®, 2003 Edition, as published by the International Code Council, Inc., is hereby enacted and made part of this Section by reference except as to portions hereinafter specifically deleted, clarified or amended. B. If any conflict should exist between the International Residential Building Code and the Zoning Code of the City of Riverside, Missouri, the provisions of the Zoning Code shall control. If any conflict should exist between the International Residential Building Code and any other ordinance of the City of Riverside, Missouri, the International Residential Building Code provisions shall control and the portion of the ordinance in conflict with the International Residential Building Code provision shall be repealed. Such repeal will affect only that portion of any ordinance which is in conflict with the International Residential Building Code and shall not affect any other portions of the ordinance. 1. .' ¶ ,~, ., T ,, . '~" ~j' C. The following changes shall be made in the International Residential Building Code: 1. Amend Subsection R101.1 by adding: City of Riverside, Missouri. 2. Amend Subsection R102.7 by replacing a reference to The International Property Maintenance Code with a reference to Chapter 490: PROPERTY MAINTENANCE REGULATIONS of the Municipal Code of the City of Riverside Missouri. 3. Delete Subsection R108.5: "Fee Refunds" 4. Amend Section Rl l l by adding: Subsection 111.4: Confirmation Letters by Utility Purveyors acknowledging the termination of Electric, Gas and Water services shall be required as a prerequisite to approval for demolition permits unless otherwise approved for immediate re-use. 5. VIOLATIONS AND PENALTIES SECTION 500.080: VIOLATIONS AND PENALTIES Any person violating any of the provisions of this Title or any of the Codes, as amended and adopted, in this Title of the Municipal Code of the City of Riverside Missouri shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in an amount not exceeding five hundred dollars ($500.00) or be imprisoned in the City or County Jail for a period not exceeding ninety (90) days, or both a fine and imprisonment. Each day such violation is committed or permitted to continue shall constitute a separate offense and shall be punishable as such hereunder. i .. .i , ¶ T. ., r ,,. Yr••~ R. 3 r~ ARTICLE IX. APPEALS SECTION 500.090: APPEALS The Board of Zoning Adjustment, as established under Title N, Article II of the Municipal Code of the City of Riverside, Missouri, shall have the power to hear and decide appeals where it is alleged there is error in any order, requirement, decision or determination made by the Codes Enforcement Officer in the enforcement of this Title. Section 2. The provisions of the Municipal Code of the City of Riverside, Missouri amended herein shall not be construed to revive any former ordinance, clause or provision of the Municipal Code of the City of Riverside, Missouri. Section 3. The sections, paragraphs, clauses, and phrases of the Ordinance are severable and if any portion of the Ordinance is declared unlawful by the valid judgment, decree, or injunction order of a court of competent jurisdiction, such ruling shall not affect any of the remaining phrases, clauses, sentences, paragraphs, and sections of the Ordinance and all provisions of the Ordinance not specifically declared to be unlawful shall remain in full force and effect. Section 4. This Ordinance overrides any conflicting provision or regulation within the Municipal Code of the City of Riverside, Missouri. Section 5. This ordinance shall take effect immediately.
