HomeMy WebLinkAbout2005-010 - Professional Services Agreement with Adaptive Ecosystems, Inc.':~ BILL N0.2005-10 ORDINANCE N0.2005-10 AN ORDINANCE APPROVING THE FORM OF, AND AUTHORIZING THE MAYOR TO COMPLETE AND EXECUTE, AN AGREEMENT FOR PROFESSIONAL SERVICES BY AND BETWEEN THE CITY OF RIVERSIDE, MISSOURI AND ADAPTIVE ECOSYSTEMS, INC. FOR THE PROVISION OF WETLANDS MITIGATION PLANNING SERVICES WHEREAS, the City of Riverside, Missouri (the "City") has negotiated with Adaptive Ecosystems, Inc. ("AEI"), for the provision of professional wetlands mitigation planning services (the "Services"). WHEREAS, the City and AEI have reached an agreement concerning the provision of payment for such Services. NOW, THEREFORE, be it ordained by the Board of Aldermen of the City of Riverside, Missouri, as follows: Section 1. The City of Riverside shall enter into an Agreement, to be substantially in the form attached hereto as Exhibit A and dated February 2, 2005, with AEI, whereby AEI will provide the Services, and as consideration for such services the City shall pay AEI a total amount not to exceed Thirteen Thousand Five Hundred and No/100 Dollars ($13,500.00) (the "Agreement"). Section 2. The execution and delivery of the Agreement, with such additions and modifications deemed necessary by the Mayor to complete the same, is approved, and the Mayor is authorized to execute the Agreement and to take such other actions reasonably necessary to carry out the intent of this Ordinance on behalf of the City, the execution of the Agreement being conclusive evidence of such approval. Section 3. This Ordinance shall be in full force and effect from and after its passage and approval. Passed this ~.~~day of February, 2005. City of Riverside Missouri Mitigation Planning -Corps of Engineers Compliance Revised February 2, 2005 Introduction: The City of Riverside owns properties within the L-385 levee currently proposed for development. The tracts aze referred to as Riverside properties the purpose of this proposal. Jurisdicational wetlands will be filled for development and will require as Section 404 Department of the Army permit and compensatory mitigation. For the Riverside properties, the Kansas City District has proposed a single permit with mitigation for all of the development activities that could occur within the L-385 flood protected area. Adaptive Ecosystems, Inc. proposes to assist the City of Riverside in planning and Corps of Engineers compliance issues related to the development of Riverside properties. Adaptive Ecosystems, Inc. proposes to provide assistance with following services: • Task 1: Compensatory Mitigation Planning: Conceptual Mitigation Plan for Horsehoe Lake acquisition • Task 2: Mann Acquisition; Assist with the acquisition of the Mann Property. • Task 3: Survey of Mann Property (Kaw Valley Engineering) Task 1: Horseshoe Lake Acquisition The City of Riverside is in the process of acquiring the Mann Property for Section 404 mitigation. Adaptive Ecosystems, Inc. will meet with the owner and the Kansas City District Corps of Engineers (Regulatory star on the Mann Property to define the project limits. Adaptive Ecosystems, Inc. will define the project boundaries, and provide draft mitigation covenants and restrictions to the City. Adaptive Ecosystems, Inc. will assist City of Riverside legal staff in the review of covenants and restrictions for the acquisition and to complete the closing. Adaptive Ecosystems, Inc will complete a field site visit with a survey crew to define the boundaries of the pazcel and to obtain a legal description, and complete a topographic survey. Survey costs aze included in Task 3. Services/Deliverables: Coordination with owner, KC District Corps of Engineers (Regulatory Staff), draft mitigation covenants and restrictions for the acquisition, coordination with City of Riverside legal staff, coordination with field crew, (survey included in task 3). Schedule: February 18, 2005 Task 2: Mitigation Concept Adaptive Ecosystems, Inc. will develop a mitigation concept based on site topography, ecological data and coordination with the Corps of Engineers. Adaptive Ecosystems, Inc. will complete a rapid ecological review and field flagging of existing ecological zones. The mitigation concept will include a plan view of proposed mitigation measures and a brief description of mitigation activities including restoration, creation and enhancement opportunities at Horseshoe Lake. The plan will also include a mitigation credits table for review by the Corps of Engineers. Corps comments on the plan will be included in the summary of findings memorandum submitted to the City of Riverside. Services and Deliverables: Mitigation Concept for Horseshoe Lake Acquisition Schedule: Mazch 18, 2005 Task 3: Survey Costs Kaw Valley Engineering will complete survey services on the Mann Property. The services and costs aze listed below. Metes and bounds survey and legal description for Mann Tract: $2500 Topographic Survey for wetland (6"design level topography) and Demazcation of ecological zones: 2~ 0 $5000 Services and Deliverables: Legal Description of Mitigation Area, Metes and Bounds Survey, Topographic survey, surveyed ecological zones. Schedule: February 2005 Fee Proposal The estimated fee for services is a lump sum of $13,500 which includes coordination, Corps compliance and mitigation planning services listed above (See Table 1). Adaptive Ecosystems, Inc. will bill monthly on a percent complete basis. The City of Riverside will pay invoices within 30 days of receipt. The City of Riverside will initiate the project with a signed contract and 20% advance payment for services ($2700).
