PROVIDING IMPOUNDMENT AND DISPOSAL OF CERTAIN ANIMALS WITHIN THE CITY WHEREAS, the City of Riverside, Missouri (the "City") has negotiated with Wayside Waifs, Inc. for the provision of providing impoundment and disposal of certain animal services to the City; and WHEREAS, the City and Wayside Waifs. have reached an agreement concerning the provision of such services. NOW, THEREFORE, be it ordained by the Board of Aldermen of the City of Riverside, Missouri, as follows: Section 1. The City of Riverside shall enter into an Agreement to be substantially in the form attached hereto as Exhibit A, with Wayside Waifs, Inc.(the "Agreement"). Section 2. The execution and delivery of the Agreement, with such additions and modifications deemed necessary by the Mayor to complete the same, is approved, and the Mayor is authorized to execute the Agreement and to take such other actions reasonably necessary to carry out the intent of this Ordinance on behalf of the City, the execution of the Agreement being conclusive evidence of such approval. AGREEMENT THIS AGREEMENT, made and entered into this 5th day ofApril 2005, by and between the City of Riverside, a Missouri municipal corporation, hereinafter referred to as "City", and Wayside Waifs Inc., anon-profit corporation hereinafter referred to as "Society" WHEREAS, the city is authorized to provide for the impoundment and disposal of certain animals within the City, and WHEREAS, the Society has offered to provide certain animal related services for the City; NOW, THEREFORE, in consideration of the recitals, promises, and covenants herein set forth, the parties agree as follows: The Society shall maintain at 3901 E. 119m Street, Kansas City, MO, a shelter for the care and feeding of animals, which shall be open to receive and impound animals seven days a week and to release impounded animals to the owners thereof; pursuant to the terms of this Agreement, during scheduled business hours of the Society. 2. The Society shall accept at its shelter all animals for impoundment brought to it by an authorized official of the City except dead animals. Any deceased anneal will be disposed of by the Society for an additional fee of $15.00 per companion pet or small wildlife. $60.00 per large wildlife such as deer or any mammal livestock. The Society shall provide proper care, food, and shelter for the impounded animals (excepting veterinary care) until the animals are reclaimed, transferred for adoption, or otherwise disposed of. 4. The City shall pay $17.50 board fee per day per animal for all animals impounded by an authorized official of the City. Said fees are subject to change as determined by the Society; however, no fee shall be increased without thirty (30) days notice in writing thereof to the City. 5. The Society shall confine the animal(s) as follows: a. No minimum time if animal(s) are found to be ill or injured and requiring immediate euthanasia to prevent further suffering. b. For a minimum hold of 24 hours if (i) Animal(s) are released by the owner; or (ii) Animal(s) are found to be feral as determined by the Society in accordance with MO state law. c. For a minimum hold of 7 days if the owner is unknown. .~. „ . .1 ., 11 .3r ~ . ~ ,_ T l.. :_ ' t ~ d. For a minimum of 10 days: (i) If the owner is known; or (ii) Rabies observation as follows: a. The Society shall notify the City immediately upon evidence of any change in the health or behavior of such animal(s) during the observation period; b. Upon termination of the observation period, the Society shall notify the City to determine whether said animal is to be euthanized in a humane manner or released to the original owner; or (iii) At the request of the City or the City's agent. After the required hold, unclaimed animals shall be placed for adoption or disposed of in a humane manner, at the discretion of the Society. 6. The Society shall collect $17.50 per day for boarding and a $ pick up fee for each animal returned to an owner. Those fees will be forwarded to the City. Release shall be made during the regulaz business hours of the Society 7. The Society shall keep such records of animals cared for as may be requested by the City, and shall render to the City monthly statements of it charges. Payment is due within 10 days of receipt of any statement, subject to annual appropriation. 8. This agreement shall continue in effect until terminated by one (1) of the parties by mailing a notice of termination to the other party at least thirty (30) days before the termination becomes effective.
