HomeMy WebLinkAbout2003-01-21 Minutes of Regular Meeting of Board of Aldermen of City of Riverside, Missouri January Zl, 2003 A regular meeting of the Board of Aldermen of the City of Riverside, Missouri, was held in the City Hall, of Riverside, Missouri, on January 21, 2003 at 7:30 p.m. Those in attendance were Mayor Betty Burch, Aldermen Burris, Looker, Darata, Beard and Flaws. Aldennan Legaard was absent at 7:30 p.m. but arrived at 8:00 p.m. Also present were David Blackburn, City Administrator, Louise Rusick, City Clerk, John Jackson, City Engineer, Chief Wylie Simpson, John McClelland, and Matt Kitzi, City Attorney's office. Mike Duffy's comments Mike said the Planning Commission recommended approving a Special Use Permit for 3401 NW Vivion Road. There is a chain line fence and screened azea. Most of Gann Asphalt's equipment will be parked in the fenced area. Public Hearing Opened Mayor Burch opened the Public Hearing to consider a request for a Special Use Permit be allowed for outside storage at 3401 NW Vivion Road. As there were no comments, the Public Hearing was closed at 7:35 p.m. Special Use Permit Alderman Flaws moved to approve a Special Use Permit for outside storage for 3401 NW Vivion Rd for Gann Asphalt at 3401 NW Vivion Rd, seconded by Alderman Beazd, the Approved Aye: Aldermen Bums, Flaws, Dazata, Beard and Looker. Absent: Alderman Legaazd. Motion carries. Change of Use Permit Alderman Beard moved to approve a Change of Use Permit for Brian Gann, for 3401 NW Vivion for 3401 NW Vivion Road, seconded by alderman Burris, the vote was: Rd Approved Aye: Aldermen Beazd, Looker, Darata, Flaws and Bums. Building Permit Alderman Beard moved to approve a Building Permit for Beverly Lumber, 2519 for Beverly Lumber, NW Platte Road for a storage shed, seconded by Alderman Flaws, the vote was: 2519 NW Platte Rd Approved Aye: Aldermen Burris, Flaws, Dazata, Beazd and Looker. Grading Permit for Alderman Beard moved to approve a Grading Permit for Gate Woods Gate Woods Dev. Development on the West side of NW Gateway subject to Professional Service on the W. side of Industries (PSI) report dated January 6, 2003 and agreement (made a part of and NW Gateway attached to these minutes). Alderman Legaazd arrived at 8:00 p.m. City Administrator David Blackburn, City Administrator requested the board approve a student to Comments do work at the city, a project for Human Resources and in coordination with Park University. The City would pay twenty-five per cent of the candidate's salary and Park University would pay seventy-five per cent. This would take place the fast semester of this year and after that a re-evaluation completed. City Engineer John received a quote to coordinate the two projects. All right of way easements have not been obtained for the NW Gateway project. Acquisitions need to be completed by June 1". A change order for the new Public Safety Building was discussed to install a new storm sewer from the new building to Jumping Branch Creek. A change order for Bucher, Willis & RatlifPs quote (bid package) for part of the Gateway project is $9,300. He said the drainage off of City Hall and Public safety goes across the driveway across NW Vivion Road and on. The inlets and storm sewers in the pazking lot aze up to a 30" pipe. To pick up the Vivion Road drainage a 48" pipe is required. Minn. 1/21/03 Chief Simpson's The Chief said South Platte Fire and Platte Woods Public Safety gave comments their sincere thanks and appreciation for donating the equipment. Mins. 1/21/03 Chief Simpson announced Communications Dispatcher, Linda Wattenbazger's resignation, retirement to be effective April 12, 2003. Recess A brief recess was called at 8:25 p.m. Reconvene The Mayor and all Boazd members answered to roll call at 8:35 p.m. Mayor's Comments Mayor Burch mentioned the Missouri American Water Rate Case Report and the merger with Missouri American Water Co. and RWE. Motion carries. General Discussion Alderman Legaazd asked about the picnic tables for the pazk. It was stated the new tables have just arrived. She mentioned a dangerous place on the playground. Gateway Dear Mr. Jackson, We have reviewed the PSI letter ofJanaury 6, 2003, and agree to development ofthe property as suggested, Part of the letter refers to removal of underground tanks which is being handled by Midwest Remediation, Inc., under the supervision ofthe Missouri Department of Natural Resources. The only part of the property covered by this grading permit is the area South of the old gas station site. Trimble Attorney At Law 7 Maui Street Parlcville, Missouri 64152 Re: Geotecluucal Engineering Services Report 5300 NW Gateway Riverside, Missolui Dear Mr. Trimble: Professional Service Industries, Inc. is pleased to transmit our Geotechnical Engineering Services Report for the referenced project. This report includes the results of field observations and recommendations for general site development. _ ' The purpose of this study was to observe the subsLrface conditions at the site to prepare . recommendations for the fill placement required for the proposed construction. Our scope of services. included observing the excavation of 6 test pits at the site to depths of about 3 feet to 7 feet below the surface or refusal, whichever was shallower and preparation of this geotechnical report. This report briefly outlines the testing procedures, presents available project information, describes the site and subsurface conditions, and presents recommendations regarding the grading procedures for site development. The site for the proposed commercial development is located at 5300 NW Gateway in Riverside, Missouri. The site sloped down toward the west with an estnnated 23 feet dif ef~i- nce in elevation between the east and west property lilies. Fill was encountered across the site, rar~,aing fiom 1 to 4 feet u1 thiclcuess. As is the case with fill placed without technical observations, the possibility exists that the fill may contain concentrated amounts of deleterious material not disclosed by our exploration, although none were encountered at the test pit locations. Accordingly, there are certain risks associated with construction on this, or on any, uncontrolled fill. The geotecluucal risk is primarily related to the possibility of experiencing g-eater than anticipated increments of settlement. The geoteclnucal risk can be mitigated tluough appropriate site preparation, but can Ue substantially improved through the complete removal and replacement of the existuig fill. Otherwise, the existing fill should be removed i~ its entirety prior to the general site preparation. hutially, all topsoil and deleterious materials must be removed from the areas proposed for construction and the resulting excavations baclcfilled with enguieered fill as described below. The contractor should refer to local codes or ordinances for proper removal and disposal of existing underground tanks, fuel lutes and soil or other tank bacltfill material that may have been exposed to possible fuel leakage. Stripping operations should extend a minimtun of 5 feet beyond the linuts of proposed pavement areas and 10 feet beyond building limits. After stripping and excavating to the proposed subgrade level, as required, the building areas should be proof-rolled with a loaded tandem axle dump truck or similar rubber tired vehicle, typically with an axle load of 9 torts. Soils that aJ•e observed to rut or deflect excessively (typically greater than 1 inch) under the moving load should be undercut and replaced with properly compacted fill. The proof-rolling and undercutting activities should be witnessed by a representative of the geotechnical engineer and should be performed during a period of dry weather. The subgrade soils should be scarified and compacted to at least 95 percent of the standard Proctor maximum dry density for a depth of at least 6 inches below the surface. After subgrade preparation and observation have been completed, fill placement may begin. The first layer of fill material should be placed in a relatively lmifolm horizontal lift and be adequately keyed Tito the stripped and scarified subgrade soils. Fill materials should be free of organic or other deleterious materials, have a maximlun particle size less than 3 inches. If a fine-grained silt or clay soil is used for fill, close moisture content control will be requured to achieve the recommended degree of compaction. Structural fill should be compacted to at least 95 percent of standard Proctor maximum dry density. Fine-grained silt oi• clay fill should be placed in maximum lifts of 8 inches of loose material and should be compacted within the range of -2 to +3 percentage points of the optimum moisture content value. Granular fill should be compacted within the range of -2 to +2 percentage points of the optimum moisture content value. If water must be added, it should be ruuformly applied and thoroughly mixed into the soil by disking. Each lift of compacted engineered fill should be tested by a representative of the geotechnical engineer prior to placement of subsequent lifts. The top of strucillral fill should ea~tend horizontally at least 10 feet beyond the outside edge of the struchlral foundations before sloping. PSI recommends that all pern~anent fill slopes be constructed at 3(I~ on 1(V) or flatter and be adequately compacted. -The surfaces of the slopes should be protected from erosion by seeding, sodduig, or other acceptable means. The benched placement of engineered structural fill on nahu•al slopes steeper than 5(H) to 1(~ where the final area will be uncontai7ed is reconnnended. The placement of fill should begin at the base of the nahiral slope with benches or ten-aces. The benches or terraces should be a minimum of 8 feet wide laterally, and should be cut into the slope every 5 feet of vertical Ilse. The naturally occurring existing soils should be prepared and fill placed in accordance with the previously described structural fill guideliies. The benching and fill placement operations should be monitored by a representative of the geotechlucal engineer. Special consideration must also be given to the stability of the natural ground when supporting substantial fills, to shuchiral fills themselves, and to cut surfaces in natural soil and rock excavations. The evaluation of slope stability aspects of this site and the proposed developments is beyond the scope of this exploration. Relatively detailed grading plans will have to be developed before meaningful evaluation of slope stability can be accomplished. All slope stability evaluation should be perfomled by qualified geoteclnnical engineering personnel prior to the initiation of any significant grading activities at the site. PSI should be retained to provide observation and testing of construction activities involved in the earthwork and related activities of this project. PSI cannot accept any responsibility for any conditions that deviated from those described in this report, nor for the performance of the foundation if not engaged to also provide construction observation and testing for this project. Water should not be allowed to collect on prepared subgrades of the construction area either during or after construction. Undercut or excavated areas should be sloped toward one corner to facilitate removal of any collected rainwater, groundwater, or surface runoff. Positive site drainage should be provided to reduce infiltration of surface water around the perimeter of the building and beneath the floor slabs. The grades should be sloped away from the site and surface drainage should be collected and discharged such that water is not permitted to infiltrate the fill area. Although water was not observed during our site visit, if water is encountered during the excavation of the benched areas, PSI should be called in for further consultation. In Federal Register, Volume 54, No. 209 (October 1989), the United States Department of Labor, Occupational Safety and Health Adrniustration (OSHA) amended its "Construction Standards for Excavations, 29 CFR, part 1926, Subpart P". This doctunent was issued to better insure the safety of worlarlen entering trenches or excavations. It is mandated by this federal regulation that excavations be constntcted in accordance with the new OSHA guidelines. It is our understanding that these regtllatiolns are beiig stl~ctly enforced and if they are not closely followed the owner and the contractor could be liable for substantial penalties. The contractor is- solely responsible for designing and constructing stable, temporary excavations and should shore, slope, or bench the sides of the excavations as required to maintain stability of both the excavation sides and bottom. The contractols "responsible person", as defined. in 29 CFR Part 1926, should evahiate the soil exposed in the excavations as part of the contractor's ._ James G. The recommendations submtted are based on the available subsurface u-Ifolmation obtained by PSI. If there are airy revisions to the plans for this project or if deviations from the subsurface conditions noted in this report are encountered during constriction, PSI should be notified immediately to determine if changes in the fo>.uidation recommendations are requu-ed. If PSI is not retained to perform these fimctions, PSI will not be responsible for the impact of those conditions on the prof ect.
