A RESOLUTION APPROVING THE GRANT OF A PERMANENT RIGHT OF WAY
CONVEYANCE, A PERMANENT ACCESS EASEMENT, AND TWO TEMPORARY
WORK AREA EASEMENTS FROM THE CITY OF RIVERSIDE TO THE RIVERSIDE-
QUINDARO BEND LEVEE DISTRICT OF PLATTE COUNTY, MISSOURI IN
CONNECTION WITH THE LEVEE RELIEF WELL AND DRAINAGE IMPROVEMENTS
PROJECT
WHEREAS, the Board of Aldermen finds it to be a public purpose and in the best
interest of the public to grant access to certain property further described herein in connection
with construction and maintenance of the Levee Relief Well and Drainage Improvements
Project;
NOW, THEREFORE, BE IT RESOLVED BV THE BOARD OF ALDERMEN OF
THE CITY OF RIVERSIDE, MISSOURI AS FOLLOWS:
THAT the Board of Aldermen ("Board") hereby approves the grant of a Permanent
Right-of-Way Conveyance, a Permanent Access Easement, and two Temporary Work Area
Easements, in substantially the form attached hereto, to the Riverside-Quindaro Bend Levee
District of Platte County, Missouri, and the Mayor is authorized to execute all of the
conveyances on behalf of the City; and
FURTHER THAT the Mayor, the City Administrator, the Finance Director and other
appropriate City officials are hereby authorized to take any and all actions as may be deemed
necessary or convenient to carry out and comply with the intent of this Resolution and to execute
and deliver for and on behalf of the City all certificates, instruments, agreements and other
documents, as may be necessary or convenient to perform all matters herein authorized.

PERMANENT ACCESS EASEMENT
KNOW ALL MEN BY THESE PRESENTS: That the CITY OF RIVERSIDE,
MISSOURI, a Missouri Political Subdivision, herein the Grantor, in consideration of the 811111 of
Ten and no/100 Dollars ($10.00) and other good and valuable considerations, the receipt of
which is hereby acknowledged, hereby grants to the RIVERSIDE-QUINDARO BEND LEVEE
DISTRICT OF PLATTE COUNTY, MISSOURI, a Missouri political subdivision, herein the
Grantee, its lessees, licensees, successors and assigns, a permanent access easement and right of
entry in, on, over and across the tracts of land described in Exhibit "A" attached hereto and
incorporated herein by this reference (the "Easement Arca") beginning on the date of the
recording of this easement instrument for use by the United States, its representatives, agents and
contractors for ingress and egress on, over and across the Easement Area for the purpose of
having access to and from W. Riverside Street which is adjacent to the easterly end of the
Easement Area to Grantee's permanent right of way which is adjacent to the westerly end of the
Easement Area to perform work necessary and incident to the construction of relief wells and
drainage improvements (the "Project") and for use by the Grantee and/or its contractors to have
access to and from Grantee's permanent right of way after completion of the work on the Project;
reserving, however to the Grantor, its successors and assigns, all such rights and privileges as
may be used without interfering with or abridging the rights and easement hereby granted to
Grantee; subject, however, to existing easements for public roads and highways, public utilities
and pipelines.
The Grantor shall receive notice from the Grantee and/or the contractor on the Project a
minimum of 15 days prior to beginning work on the Project.
As part of the completion of the construction of the Project, the Grantee and/or the
contractor shall restore the Easement Area to a similar condition as existed prior to beginning use
of the Easement Area. In addition, Grantee shall repair any damage resulting from the use of the
Easement Area by Grantee and/or its contractors following the completion of the Project work.
This Permanent Access Easement shall be binding upon the Grantor and its successors
and assigns.
Grantor hereby covenants that it is the owner of the land within the Easement Area
described in Exhibit "A" attached hereto and has the right to grant the easement rights to Grantee
as set forth hereinabove.

PERMANENT RIGHT-OF-WAY CONVEYANCE
KNOW ALL MEN BY THESE PRESENTS: That the CITY OF RIVERSIDE,
MISSOURI, a Missouri political subdivision, herein the Grantor, ht consideration of the sum of
Ten and no/100 Dollars ($10,00) and other good and valuable considerations, the receipt of
which is hereby acknowledged, hereby grants, bargains, sells and conveys to the RIVERSIDE-
QUINDARO BEND LEVEE DISTRICT OF PLATTE COUNTY, MISSOURI, a Missouri
political subdivision, herein the Grantee, its lessees, licensees, successors and assigns, the right,
privilege and perpetual right of way in fee as described below, on, under and over the tract of
land described below, which said land of Grantor situate in the County of Platte in the State of
Missouri, and the right of way across Grantor's said land is specifically described as follows:
A perpetual right-of-way in fee on, over and across the land described in Exhibit "A"
which is attached hereto and incorporated herein by this reference, which is adjacent to
Permanent Right -of -Way now owned by the Grantee, said Permanent Right -of -Way to be
used as part of the L-385 Flood Protection System which is operated and maintained by
Grantee; together with a right to remove or relocate any utility, railroad or pipelines
either within existing utility, railroad or pipeline easements.
Subject to existing easements of record, public roads and highways.
The Grantee shall have the right to remove any existing fencing and any other structures
or improvements located upon the right-of-way tract described in attached Exhibit "A" for the
purpose of construction of the L-385 Levee Project improvements (the "Levee Project
Improvements"), provided, however that the Grantee and/or its contractor shall notify Grantor a
minimum of 15 days prior to taking possession of the right of way tract.
As part of the completion of the construction of the Levee Project Improvements, the
Grantee and/or the contractor shall install a chain link fence and/or gates on the property line
between the right of way tract described in attached Exhibit "A" and the Grantor's adjacent
property.
This Permanent Right -of -Way Conveyance shall run with the land and shall be binding
upon the Grantor and its successors and assigns
Grantor hereby covenants that it is the owner of the Land described in Exhibit "A"
attached hereto and has the right to grant the perpetual right-of-way to Grantee as described
herein.

TEMPORARY WORK AREA EASEMENT
KNOW ALL MEN BY THESE PRESENTS: That the CITY OF RIVERSIDE,
MISSOURI, a Missouri political subdivision, herein the Grantor, in consideration of the sum of
Ten and no/100 Dollars ($10.00) and other good and valuable considerations, the receipt of
which is hereby acknowledged, hereby grants to the RIVERSIDE-QUINDARO BEND LEVEE
DISTRICT OF PLATTE COUNTY, MISSOURI, a Missouri political subdivision, herein the
Grantee, its lessees, licensees, successors and assigns, a temporary easement and right of entry
in, on, over and across a tract of land described in Exhibit "A" attached hereto and incorporated
herein by this reference (the "Easement Area") beginning on the date of the recording of this
easement instrument and ending on January 31, 2022 for use by the United States, its
representatives, agents and contractors as a work area, including the right to move, store and
remove equipment and supplies, and erect and remove temporary structures on the Easement
Area and to perform any other work necessary and incident to the construction of relief wells and
drainage improvements (the "Project") together with the right to remove obstructions,
vegetation, structures or obstacles within the limits of the Easement Area; reserving, however to
the Grantor, its successors and assigns, all such .rights and privileges as may be used without
interfering with or abridging the rights and easement hereby granted to Grantee; subject,
however, to existing easements for public roads and highways, public utilities and pipelines.
The Grantor shall receive notice from the Grantee and/or the contractor on the Project a
minimum of 15 days in advance of taking possession of the Easement Area.
As part of the completion of the construction of the Project, the Grantee and/or its
contractor shall restore the Easement Area to a similar condition as existed prior to taking
possession of the Easement Area.
This Temporary Work Area Easement shall be binding upon the Grantor and its
successors and assigns.
Grantor hereby covenants that it is the owner of the land within the Easement Area
described in Exhibit "A" attached hereto and has the right to grant the easement rights to Grantee
as set forth hereinabove,

TEMPORARY WORK AREA EASEMENT
KNOW ALL MEN BY THESE PRESENTS: That the CITY OF RIVERSIDE,
MISSOURI, a Missouri political subdivision, herein the Grantor, in consideration of the sum of
Ten and no/100 Dollars ($10.00) and other good and valuable considerations, the receipt of
which is hereby acknowledged, hereby grants to the RIVERSIDE-QUINDARO BEND LEVEE
DISTRICT OF PLATTE COUNTY, MISSOURI, a Missouri political subdivision, herein the
Grantee, its lessees, licensees, successors and assigns, a temporary easement and right of' entry
in, on, over and across a tract of land described in Exhibit "A" attached hereto and incorporated
herein by this reference (the "Easement Area") beginning on the elate of recording this Easement
Instrument and ending on January 31, 2022 for use by the United States, its representatives,
agents and contractors as a work area, including the right to move, store and remove equipment
and supplies, and erect and remove temporary structures on the Easement Area and to perform
any other work necessary and incident to the construction of' relief wells and drainage
improvements (the "Project") together with the right to remove obstructions, vegetation,
structures or obstacles within the limits of the Easement Area; reserving, however to the Grantor,
its successors and assigns, all such rights and privileges as may be used without interfering with
or abridging the rights and easement hereby granted to Grantee; subject, however, to existing
easements for public roads and highways, public utilities and pipelines.
The Grantor shall receive notice from the Grantee and/or the contractor on the Project a
minimum of 15 days hi advance of taking possession of the Easement Area.
As part of' the completion of the construction of the Project, the Grantee and/or its
contractor shall restore the Easement Area to a shnilar condition as existed prior to taking
possession of the Easement Area.
This Temporary Work Area Easement shall be binding upon the Grantor and its
successors and assigns.
Grantor hereby covenants that it is the owner of the land within the Easement Area
described in Exhibit "A" attached hereto and has the right to grant the easement rights to Grantee
as set forth hereinabove.

All that part of the Soutlnvest Quarter of Section 4, Township 50 North, Range 33 West, in the
City of Riverside, Platte County, Missouri, described as follows:
Commencing at the Southeast Corner of Lot 2, RENNER PLAZA NO, 5, a subdivision of land in,
in the City of Riverside, Platte County, Missouri; thence North 84° 21' 30" West along the South
line of said Lot 2, Renner Plaza No. 5, a distance of 512.03 feet to its intersection with the East
Permanent Right -of -Way of the Riverside-Quindaro Bend Levee District as established by Circuit
Court Case No. 99 -CC -00930, recorded October 30, 2001, as Document No. 19451, in Book 957,
at Page 142, at the Platte County Recorder's Office, said point being the Point of Beginning; thence
South 26°56'58" West, along said Permanent Right -of -Way, a distance of 6.18 feet; thence South
10°51'25" West a distance of 191.65 feet, to a point on the South line of'a tact of land conveyed
