AN ORDINANCE APPROVING A PRELIMINARY/FINAL DEVELOPMENT PLAN FOR
LAND LOCATED ON THE NORTH SIDE OF NW 50TH TERRACE, WEST OF
GATEWAY DRIVE TO THE NORTHERN CITY LIMITS IN RIVERSIDE, MISSOURI, IN
ACCORDANCE WITH THE UNIFIED DEVELOPMENT ORDINANCE OF THE CITY OF
RIVERSIDE
WHEREAS, Application No. PC20-07 was submitted to the City by Andy Mackey and
Brian Mertz for approval of a Preliminary/Final Development Plan for construction of a
32-unit townhome development ("Development Plan") located on an approximately 19
acres of land located on the north side of NW 5011 Terrace, west of Gateway Drive to
the northern City limits, Riverside, Missouri,
WHEREAS, the Planning Commission held a meeting on November 12, 2020 to
consider said application and recommended that the Development Plan be approved;
and
WHEREAS, the Board of Aldermen find it to be in the best interests of the City in order
to further the objectives of industrial and economic development of the City, as well as
in furtherance of the objective to protect the health, safety, and welfare of the
businesses and citizens of the City, to approve the Development Plan as set forth
herein.
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE
CITY OF RIVERSIDE, MISSOURI, AS FOLLOWS:
SECTION 1 — BEST INTEREST OF THE CITY TO APPROVE DEVELOPMENT PLAN.
It is in the best interests of the City in order to further the objectives of industrial and
economic development of the City, as well as in furtherance of the objective to protect
the health, safety, and welfare of the businesses and citizens of the City, to approve the
Development Plan, attached hereto as Exhibit A and incorporated herein, for
development of property located on the north side of NW 50th Terrace, west of Gateway
Drive to the northern City limits of Riverside, and legally described as Skyline
Townhomes plat, and such Development Plan is hereby approved, subject to the
conditions provided herein, to allow for the construction of a townhome development
according to such plan.
SECTION 2 — CONDITIONS OF APPROVAL. The following conditions of approval
shall apply with regard to the Development Plan approved for development of the
property:
1. The approval of the Development Plan does not relieve the
developer from compliance with all other applicable local,
state and federal laws, codes, ordinances, and regulations.

The developer is required to request and obtain approval for
all necessary permits to begin constructing the development.
2. The developer will work with City Staff on a landscape plan.
SECTION 3 — AUTHORITY GRANTED. The Mayor, the City Administrator, and other
appropriate City officials are hereby authorized to take any and all actions as may be
deemed necessary or convenient to carry out and comply with the intent of this
ordinance and to execute and deliver for and on behalf of the City all certificates,
instruments, agreements and other documents; as may be necessary or convenient to
perform all matters herein authorized.
SECTION 4 — EFFECTIVE DATE. This ordinance shall be in full force and effect from
and after the date of its passage and approval.
BE IT REMEMBERED that the above was read two times by heading only, PASSED
AND APPROVED by a majority of the Board of Aldermen and APPROVED by the
Mayor of the City of Riverside, Missouri, this 1711 day of November 2020.
