HomeMy WebLinkAbout2005-088 - Service Agreement with Shafer, Kline & Warren' .~ ,il BILL NO.2005-88 ORDINANCE N0.2005-88 AN ORDINANCE AUTHORIZING THE CITY OF RIVERSIDE TO ENTER INTO A SERVICES AGREEMENT WITH, AND PAY CERTAIN FUNDS TO, SHAPER, KLINE & WARREN, INC. WHEREAS, Shafer, Kline & Warren, Inc. ("Service Provider") is a corporation providing services, including certain construction contract administration and construction progress monitoring services ("Services"). WHEREAS, Service Provider desires to provide such Services and requires funding to provide services to the City for the review of, administration of, and progress monitoring of the City's construction contract for the West Gateway improvements. WHEREAS, the City finds that the provision of the Services is a public purpose and the City has the capability and desire to retain Service Provider for the provision of such Services to the City. NOW, THEREFORE, BE IT ORDAINED, by the Board of Aldermen of Riverside, Missouri, as follows: Section 1. The City finds that the provision of the Services contributes to the welfare of the City as well as the economic and social potential of the City and its residents, that the Services are important to the welfare of the City and that the provision of funds to assist in providing such Services are for a public purpose. Section 2. The City of Riverside shall pay to the Service Provider the sum of Twenty-Three Thousand and 00/100 Dollars ($23,000.00) for the provision of Services to the City, pursuant to a Services Agreement, in substantially the form attached as Exhibit A, which is hereby approved. Section 3. .The Mayor and City Clerk are authorized and directed to execute the Services Agreement with such changes as such officer shall approve, execution of such document being conclusive proof of such approval. The Mayor, City Clerk and City Administrator are each authorized and directed to perform all acts and execute any other documents necessary or desirable to effectuate the intent of this Ordinance. The City Clerk is hereby authorized and directed to ensure that checks in the amounts provided by invoices from the Services Provider are drafted and presented to an authorized official of the Service Provider, upon execution of the Services Agreement and receipt of the invoices. Section 4. The sections, paragraphs, clauses, and phrases of the Ordinance are severable and if any portion of the Ordinance is declared unlawful by the valid judgment, decree, or injunction order of a court of competent jurisdiction, such ruling shall not affect any of the remaining phrases, clauses, sentences, paragraphs, and sections of the Ordinance and all provisions of the Ordinance not specifically declared to be unlawful shall remain in full force and effect. Kline & Warren, Inc., (SKW), proposes to provide Construction Contract Administration and Construction Progress Monitoring for the West Gateway Improvements in the City of Ri~•erside. Missouri. SKW will provide the services of an experienced Senior Construction Observer, (David L. McGee), having a minimum of twenty five (25) years experience in observation of the construction of municipal improvements including pavement, curbs, stotnt sewers, sanitaty- sewers, lighting and ancillary items. The Observer will provide an initial "Review of the Project Plans and Construction Documents" for constructability and f.3tniliarization. The Observer will make an initial "Review of the quality and quantity of the construction progress to date along with an assessment of progress compared to the submitted construction schedule." The Observer will provide "Daily construction observation of the ongoing construction and provide documentation of the quality, quantity and progress Hof the work". The Observer will prepare a monthly "Contractors pay request based upon the satisfactory quantities complete to date:' The Obsei~'er will "Assist in the coordination of utility relocations and the work by others" The Observer will prepare a "Monthly report to the City" to include the following it:fonrtation: 1. Estimate of the projects overall percentage of completion which will include a narrative description of work completed to date, work in progress and materials stored on site. ?. Review and comment on the submitted contractor's pay request, and supplemental documentation, as to whether or not the itemized amounts are a valid representation for the value of work in place and materials stored on site. 3. Identify any o~'ertttns or underruns to contract items and provide an opinion as to the sufficiency of the remaining budget to complete the project. ~. Review and comment on all proposed change orders, . Rer-iew and comment on the retainage amounts withheld relative to adherence to terms of the contract documents. 6. REV1eW and comment on whether or not the on-site stored materials appear to be in good condition and are adequately stored and protected.
