HomeMy WebLinkAbout2005-091 - Agreement with TransystemsBILL N0.2005-~~ ORDINANCE N0.2005- ~ ~ AN ORDINANCE AUTHORIZING THE CITY OF RIVERSIDE, MISSOURI TO ENTER INTO AN AGREEMENT WITH TRANSYSTEMS CORPORATION FOR DESIGN SERVICES FOR THE I-635, ROUTE 9, HORIZONS PARKWAY AND SCHOENBECK ROAD SUPPLEMENTAL WORK FOR SANITARY SEWER LIFT STATION AND FORCE MAIN WHEREAS, the City of Riverside, Missouri ("City") engaged in negotiations with Transystems Corporation ("Transystems") for provision of engineering and design services related to the Horizons Project and the I-635 and Van de Populier interchange under consideration by the City (the "Services"); and WHEREAS, the City and Transystems have previously reached an agreement concerning the provision of and payment for such Services (the "Agreement"); and WHEREAS, revisions are necessary to the Agreement due to the necessary design of a sanitary sewer lift station and force main, and the concurrent change in the scope and nature of the Services. NOW, THEREFORE, be it ordained by the Board of Aldermen of the City of Riverside, Missouri, as follows: Section 1. The City of Riverside shall enter into Supplement #4, in substantially the form attached hereto as Exhibit A, to the Agreement whereby Transystems shall provide design and engineering services, related to the design of a sanitary sewer lift station and force main, to the City at a total cost of $227,400.00 ("Supplement #4"). The proposed lift station will be located on the west side of I-635 near the current overpass for Schoenbeck Road. The proposed force main will begin at this new lift station and continue easterly and tie into the existing KCMG Water Services "Line Creek" Pump Station (approximately 4000' from I-635). Please note that the final route to the Line Creek Pump Station has not yet been determined. As we indicated during our August 11th progress meeting, the area through which this line must be constructed has many challenges that have to be investigated in order to determine the most economical route. At least 3 alternate routes are currently identified. The majority of the design, detailing and permitting work will be accomplished by Continental Consulting Engineers (subconsultant to TranSystems Corporation) with surveying, base mapping, coordination and limited environmental services being provided by TranSystems Corporation. Taav~'s~snEn~s CLYlPO/?AT/O/V I-635 /Horizons Pa~rkway /Route 9 / Schoenbeck Road Supplement #4 (Design of Sanitary Sewer Lift Station and Force Main) OVERVIEW OF SUPPLEMENT: The work included in this supplement consists of the design and detailing of a sanitary sewer lift station and force main that will serve the area south of the BNSF Railroad tracks bounded by the recently completed L-385 Levee. The proposed lift station will be located on the west side of I-635 near the current overpass for Schoenbeck Road. The proposed force main will begin at this new lift station and continue easterly and tie into the existing KCMG Water Services "Line Creek" Pump Station (approximately 4000' from I-635). SURVEY ITEMS: 1 Coordination and management ~of the survey project. 2 Coordination and establishment of the Horizontal control tied to NAD 1983, Missouri West Zone Datum. 3 Coordination and establishment of the Vertical control tied to NAVD 1988 Datum. 4 Coordinate with utility companies for them to mark there main lines and facilities. 5 Conduct topographical surveys to supplement the aerial mapping and base map from MJ Hardin including but not limited to utility location, levee cross sections and profiles and storm drainage structures. 6 Conduct and prepare base map drawing of planimetric features to supplement MJ Harden aerial mapping. 7 Conduct and locate section corners, property corners and physical evidence (i.e. fence lines, tree rows, etc.) to define Existing Right of Way (ROW) and property lines. 8 Conduct and prepare a boundary survey base map to define Existing Right of Way (ROW) and property lines to add to or supplement Boundary Survey for the Horizons Parkway Project by TranSystems. 9 Preparation of descriptions for Right of Way and Easement Acquisitions. 10 Coordinate and conduct survey to verify existing information on the Line Creek Pump Station. .r ,. 7 n ~i T~wS~~n~s I 635 /Horizons Pa~'kway /Route 9 / Schoenbeck Road Supulement #4 (Design of Sanitary Sewer Lift Station and Force Main) The following is a list of conditions that were the basis for this supplement: General: 1. The "Proposal Conditions" for the Phase II and Phase III Scope of Work (Ordinance No. 2004- 19, dated 2/24/04) are included in this supplement by reference. Survey: 1. The Horizontal Datum is tied to~previous datum established by MJ Harden and TranSystems in Phase I of the I-635 and Horizons Parkway project (NAD 1983, Missouri West Zone). 2. The Vertical Datum is tied to previous datum established by MJ Harden and TranSystems Corporation in Phase I of the I-635 and Horizons Parkway project (NAND 1988). 3. That no bridge surveys are to be performed as part of this project. 4. The coordination and marking from Missouri One-Call for all utilities on the projects will be marked for the surveyors to locate with out any delay or problems. 5. Topographical surveys would only be done to supplement the aerial mapping by MJ Harden and TranSystems Base Map and will include, but not limited to utility location, Levee cross sections and profiles, railroad track location (as necessary), drainage structures, check cross sections along the decided route. 6. Conduct and prepare the boundary surveys to determine Existing Right of Way and property lines either to supplement earlier survey by TranSystems Corporation or create new survey of additional parcels or plats needed. Boundary survey is based upon four (4) section corners needed, being existent and of record. Title Reports are based upon one (1) Original report and one (1) update to the report. 7. The planimetric drawing (Base Map) will be verified and supplemented to an aerial mapping or drawing from earlier survey by TranSystems Corporation and MJ Harden. 8. That the Right of Way and Easement description preparation is based on the following: A) ± 20 Parcels within total project limits. 9. The coordination with the City of Kansas City, Missouri to have access to the Line Creek Pump Station to verify tie-in elevations and locations as necessary. This is based on only one visit to gather the information. 10. The coordination with the Levee District for access is without delay or problems. Environmental: 1. TranSystems will provide a wetland field locate only (used to assist in determining the final alignment of the force main). If a "wetland report" is required then that scope and fee will be negotiated at a later date. 2. No additional "Threatened and Endangered Species" or "Cultural Resources" investigations or reports will be required for the alignment east of Line Creek. The alignment of the force main will situated in previously disturbed .area and/or existing developed areas. Vehicle mileage is billed at a rate of $0.37 per mile beginning from Consultant's offices to job/project site and back to the Consultant's offices. Reasonable aircraft travel, car rental, and other similar travel expenses shall be billed at actual invoice amount. PAYMENT TERMS: Payment shall be rendered no later than 70 days from receipt of payment by TranSystems from Riverside, Missouri. cr-ICnut E OF CONDITIONS -STANDARD OF PERFORMANCE - Consultant services shall be performed in a manner consistent with the standard of professional care, skill and diligence that is customary for projects of the type and complexity as herein described. All work shall be performed by qualified personnel under the supervision of, or pedormed directly by, persons licensed to practice in the Slate wherein the project is located. The Services shall reasonably conform to applicable laws, codes, ortlinances and regulations of any governmental agency having jurisdiction over the project, al the time services are rendered. The plans shall conform to either MoDOT or APWA standards. SCHEDULE- The services will be provided in accordance with Client's schedule. -OWNERSHIP OF D000MENTS- The Consultant and Client shall jointly retain ownership of all work produMS and drawings. Consultant shall provide Client copies of drawings in an electronic formal. -DELIVERABLE PRODUCTS- The following is a list of the products Consultant shall provide the Client: Sanitary Sewer Force Main Design Sanitary Sewer Lift Station Design Preparation of applications for required Permits (404, 401, SWPPP, Stream Crossing. Railroad Crossing) -PERMITS- The Consultant shall assist the Client in obtaining necessary construction permits relating to Consultant's scope of work. -INSURANCE- The Consultant shall provide Client a copy of a proof of insurance prior to beginning work. -MEETINGS- The Consultant shall attend the following meetings as part of the Basic Services. Public Meetings Design Team Coordination Meetings City Council Presentations -GOVERNING LAW AND FORUM- This Agreement shall be governed by and construed in accordance with the laws of the state in which the project is located, without regard to the internal laws of such slate regarding congicts of laws. - COMPENSATION AND PAYMENT - Compensation shall be in accordance with the Scope of tiServices attached hereto. Payment shall be made by the Client to the based on the above standard hourly rates. Invoices will include the name, title, hours worked of the people assigned to the project, the expenses incurred and a summary of the tasks accomplished since the last invoice. -AGREEMENT REVISION - This Professional Services Agreement, wnsisting of lh9 Documents enumerated in the Request for Proposal shall not be modified, amended, extended or changed in any manner except in writing ar)d signed by persons duly authorized to represent the Client and the Consultant. -AGREEMENT TERMINATION- The Consultant may terminate this Professional Services Agreement upon seven (7) days written notice to the Client Tor failure of the client to make payment in accordance with the terms contained herein. The mapping will tie to the existing mapping provided previously and will be delivered on CD-ROM. Our fee for the additional services is $3,600.00 Services will be in accordance with the Terms and Conditions in the original contract dated February 10, 2003.
