HomeMy WebLinkAbout2003-05-20Minutes of Regulaz Meeting of Board of Aldermen of City of Riverside, Missouri May 20, 2003 A regular meeting of the Boazd of Aldermen of the City of Riverside, Missouri, was held in the City Hall, of Riverside, Missouri, on May 20, 2003 at 6:30 p.m. Those in attendance were Mayor Betty Burch, Aldermen Burris, Looker, Darata, Legaard, Beard and Flaws. Also present were David Blackburn, City Administrator, Louise Rusick, City Clerk, John Jackson, City Engineer, Brent Miles, Community Development & Planning & Zoning Coordinator, Michael Duffy, City Consultant, John McClelland, Matt Kitzi and Ben Prell, City Attorney's office. Motion for Closed Alderman Legaazd moved that the meeting go into closed session, Session pursuant to RSMo 610.021(2) Real Estate issues with the City Attorney, seconded by Alderman Darata, the vote was: Aye: Aldermen Darata, Legaazd, Beard, Flaws, Looker and Bums. Motion carries. Motion for Open Alderman Flaws moved that the meeting go into open session, Session seconded by Alderman Darata, the vote was: Aye: Aldermen Legaazd, Beazd, Flaws, Looker, Darata and Bums. Motion carries. Regular Session begins, Mayor Burch, Alderren Legaazd, Beazd, Flaws, Looker, Darata and Roll call at 7:30 p.m Burris answered to roll call. Minutes, May 6, 2003 Alderman Dazata moved that the minutes of May 6, 2003 be Approved corrected and approved, seconded by Alderman Legaazd, the vote was: Aye: Aldermen Bums, Flaws, Dazata, Legaazd, Beard and Looker. Motion carries. Minutes, May 13, 2003 Alderman Legaazd moved that the minutes of May 13, 2003 be Approved approved, seconded by Alderman Dazata, the vote was: Aye: Aldermen Burris, Flaws, Dazata, Legaazd, Beard and Looker. Motion carries. Public Hearing Opened Mayor Burch opened the Public Hearing at 7:35 p.m to consider a request to approve a Special Use Permit for Riverside Seat, 500 NW Platte Valley Drive. Public Hearing Closed Mayor Burch closed the Public Hearing at 7:37 p.m. Minn. 5/20/03 John Jackson's comment Regazding the request for the Special Use Permit, John said all conforms to the city code and there is no problem in the floor zone and minimal revision to the existing building. Special Use Permit Alderman Looker moved to approve a Special Use Permit for Riverside for Riverside Seat, Seat, 500 NW Platte Valley Drive to build a new facade, seconded by 500 NW Platte Valley Dr. Alderman Beazd, the vote was: Approved Aye: Aldermen Looker, Beard, Legaard, Dazata, Flaws and Bums. Motion carries. Building Pernvt Alderman Dazata moved to approve a Building Permit for Riverside for Riverside Seat, Seat, 500 NW Platte Valley Drive to build a new facade, seconded by 500 NW Platte Valley Dr. Alderman Burris, the vote was: Approved Aye: Aldermen Beazd, Legaazd, Dazata, Flaws, Looker, and Bums. Motion carries. Public Comments Mr. Paul Clancy, 4708 NW High Drive, Rick Turner, 4707 NW High Drive and Terri Edwards, 4716 NW High Drive, thanked the Mayor and Boazd for the city's support and clean up of limbs on High Drive from the recent tornado. They appreciated all that was done. Rick said the tresses were ordered and should be able to move back in about 4-6 months. Public Hearing Opened Mayor Burch opened the Public Hearing at 7:40 pm. to consider a request to amend Title VI, Chapter 410 of the Municipal Code of the City of Riverside, Missouri by revising the zoning regulations con- tained in Section 410.050:"C-1" General Commercial District. Comments from the Public Jim Trimble, 5503 NW Foxhill Road, Pazkville, Mo indicated azeas in the proposed Ordinance he though should be amended, i.e. page 4, Building Materials (3) Stucco-including Dryvit, but excluding pre- manufacturedpanels (to not exclude pre-manufactured panels), (6) Metal- He sees no need for metal restricted to the rim and page 5, Architectural Chazacteristics, (10) Pitched Roofs. Mr. Trimble claims there is no definition for a pitched roof. He claims this should be deleted because it is addressed in the next two pazagraphs (3) (e)and (f). Public Hearing Closed Mayor Burch closed the Public Hearing at 7:48 p.m Mike Duffy's comment Mike addressed Mr. Trimble's concerns regazding the Design Standazds. Mike said we would amend page 2, D. 1 (a) to read "the City prefers" etc. and page 4, 9. (3) deleting but excluding pre- manufacturedpanels and (6)amending "Metal used for trim" page 5 b. (3) Materials not listed as approved, etc. John's comment John said Mr. Nash with Nash Gas will be coming before the Planning and Zoning Commission on May 22°d for a request for a Building Permit to put a new roof on the building from the tornado damage. Minn. 5/20/03 2 Bill No. 2003-49 Alderman Flaws moved to place Bill No. 2003-49 on its first reading, Payment of Indebtedness said Bill authorizing the payment of certain indebtedness listed therein, and corrected, seconded by Alderman Darata, the vote was: Aye: Aldermen Looker, Darata, Burris, Legaazd, Beazd and Flaws. Motion carries. Ordinance No. 2003-49 Alderman Legaard moved to place Bill No. 2003-49 on its second Approved reading, and upon passage of same become Ordinance No. 2003-49, seconded by Alderman Darata, the vote was: Biil No. 2003-50 Ratifying the acceptance of bids on $15,140,488.57 Ordinance No. 2003-50 Approved Bill No. 2003-51 Amend. Alderman Flaws moved to place Bill No. 2003-50 on its first reading, ratifying the acceptance of bids on $15,140,488.57, seconded by Alderman Beazd, the vote was: Alderman Darata moved to place Bill No. 2003-50 on its second reading, and upon passage of same become Ordinance No. 2003-50, seconded by Alderman Legaard, the vote was: Aye: Aldermen Flaws, Dazata, Bums, Legaard, Beard and Looker. Motion carries. Aye: Aldermen Flaws, Darata, Burris, Legaazd, Beazd and Looker. Alderman Burris moved to place Bill No. 2003-51 on its first reading, with amendments, page 2, D. 1 (a) to read "the City prefers" etc. and page 4„ 9. (3) deleting but excluding pre-manufactured panels and (6)amending "Metal used for trim" page 5 b. Ordinance No. 2003-51 Alderman Looker moved to place Bill No. 2003-51 on its second Approved reading, and upon passage of same become Ordinance No. 2003-51, seconded by Alderman Beazd, the vote was: Aye: Aldermen Darata, Burris, Legaazd, Flaws, Beazd and Looker. Motion carries. Aye: Aldermen Flaws, Darata, Burris, Legaard, Beard and Looker. Mins. 5/20/03 Bill No. 2003-52 Alderman Beard moved to place Bill No. 2003-52 on its fast reading, Author. & approving the City authorizing and approving the City of Riverside, Missouri, to acquire to acquire certain land & certain land and improvements by exercise of its power of eminent improvements by exercise of its domain in the event it is unable to acquire the property through agood- power of eminent domain faith offer and subsequent purchase, seconded by Alderman Flaws, the in the event it is unable to acquire vote was: the property through a good faith offer & subsequent purchase Aye: Aldermen Flaws, Dazata, Legaard, Beazd, Looker and Bums. Ordinance No. 2003-52 Alderman Flaws moved to place Bill No. 2003-52 on its second Approved reading, and upon passage of same become Ordinance No. 2003-52, seconded by Alderman Legaazd, the vote was: Aye: Aldermen Darata, Burris, Legaazd, Flaws, Beard and Looker. Motion carries. Aye: Aldermen Flaws, Darata, Bums, Legaard, Beazd and Looker. Bill No. 2003-53 Author. the city to employ Brent Miles as Community Dev. & Planning & Zoning Coor. Alderman Burris moved to place Bill No. 2003-53 on its fast reading, said Bill authorizing the City of Riverside, Missouri, to employ Brent Miles as the Community Development & Planning & Zoning Coord- inator, at the hourly rate of $16.00 to become effective May 19, 2003 With full benefits as a one-year internship, seconded by Alderman Darata, the vote was: Aye: Aldermen Darata, Flaws, Bums, Legaard, Beazd and Looker. Motion carries. Ordinance No. 2003-53 Alderman Looker moved to place Bill No. 2003-53 on its second Approved reading, and upon passage of same become Ordinance No. 2003-53, seconded by Alderman Burris, the vote was: Aye: Aldermen Dazata, Burris, Legaazd, Flaws, Beard and Looker.
