BILL NO.~~C~-~ ~~ ORDINANCE NO. ~~`~5 /~~ AN ORDINANCE AUTHORIZING THE CITY OF RIVERSIDE, MISSOURI TO EXECUTE FOUR GENERAL WARRANTY DEEDS TO THE MISSOURI HIGHWAYS AND TRANSPORTATION COMMISSION FORRIGHT-OF-WAYS FOR THE I-635 INTERCHANGE WHEREAS, the Missouri Highways and Transportation Commission ("MoDOT") has approved a program for the construction and improvement (the "Project") of Interstate Highway 635 ("I-635") and an interchange passing through the City of Riverside, Missouri (the "City"); and WHEREAS, it is necessary for MoDOT to acquire certain real property within, and certain real property rights from, the City to complete the Project; and WHEREAS, the City has determined that the Project is in the best interests of the City and its residents, and that donating the real property to serve as the right-of--way required for the Project is in the best interests of the City; and WHEREAS, it is necessary for the City to complete and execute certain documents to properly and legally effect the transfer of certain real property, and to grant certain real property rights, affected by the Project. NOW, THEREFORE, BE IT ORDAINED, by the Board of Aldermen of Riverside, Missouri, as follows: Section 1. The City finds that completion of the Project will greatly benefit the public health, safety and welfare of the City and its residents, and finds that the Project is important to the welfare of the City. Section 2. The Mayor and City Clerk are authorized and directed to execute the MoDOT agreement and waiver of compensation, in substantially the form attached as Exhibit A, regarding the real property and real property rights necessary for the Project. Section 3. The Mayor and City Clerk are authorized and directed to execute a General Warranty Deed for real property identified as Tract No. P37 for purposes of the Project (and legally described therein), in substantially the form attached as Exhibit B, which is hereby approved. Section 4. The Mayor and City Clerk are authorized and directed to execute a General Warranty Deed for real property identified as Tract No. P33 for purposes of the Project (and legally described therein), in substantially the form attached as Exhibit C, which is hereby approved. ,~, ., v n m Y 11 T -p-- . Section 5. The Mayor and City Clerk are authorized and directed to execute a General Warranty Deed for real property identified as Tract No. P18 for purposes of the Project (and legally described therein), in substantially the form attached as Exhibit D, which is hereby approved. Section 6. The Mayor and City Clerk are authorized and directed to execute a General Warranty Deed for real property identified as Tract No. P17 for purposes of the Project (and legally described therein), in substantially the form attached as Exhibit E, which is hereby approved. Section 7. The sections, paragraphs, clauses, and phrases of the Ordinance are severable and if any portion of the Ordinance is declared unlawful by the valid judgment, decree, or injunction order of a court of competent jurisdiction, such ruling shall not affect any of the remaining phrases, clauses, sentences, paragraphs, and sections of the Ordinance and all provisions of the Ordinance not specifically declared to be unlawful shall remain in full force and effect.
