HomeMy WebLinkAbout2005-131 - Planning Advisory Services with Bucher, Willis & Ratliff CorporationBILL N0.2005-131 ORDINANCE N0.2005-131 AN ORDINANCE APPROVING AND AUTHORIZING THE CITY OF RIVERSIDE TO OBTAIN PLANNING ADVISORY SERVICES BY BUCHER, WILLIS & RATLIFF CORPORATION WHEREAS, the City of Riverside, Missouri ("City") desires to engage the services of a planner to provide continued planning advisory services for the city; and WHEREAS, the City desires to retain Bucher, Willis & Ratliff Corporation for the provision of continued planning advisory services. NOW, THEREFORE, be it ordained by the Board of Aldermen of the City of Riverside, Missouri, as follows: Section 1. The City engages Bucher, Willis & Ratliff Corporation to provide planning advisory services for the City pursuant to the specific proposed attached agreement. These services will commence on the date of authorization and shall continue until /N.r 3T Section 2. This ordinance shall be in full force and effect from and after its passage and approval. Passed this 29h day of November 2005. ayor Pro Tem ATTE ity Clerk •r .. ~ ~ r n n' 1 ' t t 't T IC .` A~ AGREEMENT FOR PLANNIN ADVISORY SERVICES THIS AGREEMENT, made thisay of , 2005; BY AND BETWEEN the CITY OF RIVERSIDE, MISSOURI, hereinafter called the "City", and BUCHER, WILLIS & RATLIFF CORPORATION ("BWR"); WHEREAS, as the City requires Brent Miles (the "Consultant"), an employee of BWR, to provide continued planning advisory services including routine consultation with staff, and developers on zoning, subdivision and site plan applications, as well as attendance at City Council, Planning Commission, Board of Zoning Appeals, TIF Commission, and subcommittee meetings, as requested by the City; and WHEREAS, the City finds that the provision of the Services (as defined in Article )) is a public purpose and the City has the capability and desire to retain the Consultant for the provision of such Services to the City. NOW, THEREFORE, IN CONSIDERATION OF THE COVENANTS AND AGREEMENTS herein contained, the parties hereto hereby agree as follows: ARTICLE I SCOPE OF SERVICES A. BWR will provide the services of the Consultant, an experienced Planner having knowledge of Municipal Community and Economic Development operations. B. The Consultant will provide input and review on issues that may include, but not limited to: a. Coordinate the review of applications for Land Use permits, Zoning and Subdivision, Appeals and Variance permitting process with the City staff and designated representatives as requested. b. Formulate and present recommendations to the City Council, Planning Commission, and subcommittees based on staff recommendations, local and statutory regulations and procedures, and sound planning practices as requested. c. Attend City Council, Planning Commission, and subcommittee meetings at which land use, zoning, subdivision, appeal and variance issues are to be presented and present staff reports and recommendations, respond to questions, and offer clarification and assistance as necessary as requested. d. Prepare drafts and draft revisions of staff findings, text amendments, and similar reports necessary to implement the action of the City Council, Planning Commission, and subcommittees on various annexation, zoning, subdivision, appeal and variance matters as requested. e. Meet with City Staff, City Council, Planning Commission, and subcommittees periodically as requested by the City. Confer with designated City staff and designated representatives routinely by phone; and perform special projects and other related services as authorized by the City, such as a traffic analysis, annexation studies, and other related, special studies as requested. Revised BWR PLANNING ADVISORY AGREEMENT November 172005.dac- ,~, ...i i n n i a of ~1 5_ r The Consultant shall perform the above services only upon the authorization of the City Administrator, or other authorized City representatives to be identified by the City. Any services to be performed by the Project Manager, Scott Michie, shall be approved in advance by the City Administrator. ARTICLE II COMPENSATION The Consultant shall provide services on an hourly basis. The City agrees to compensate B WR for the services on a per hour basis at the rates and charges given below. Actual Cost A statement shall be submitted by BWR monthly itemizing the number of hours, services performed and other expenses for the work specifically requested by the City. This statement shall separately itemize expenses. The City shall make payment within thirty (30) calendar days of the date of said statement for all expenses. ARTICLE III NIISCELLANEOUS PROVISIONS This Agreement shall commence upon the date of authorization, and shall continue until Ma ~ 3 ( , 2006; PROVIDED, HOWEVER, that the City may terminate this Agreement at any time and for anT son by giving to BWR a notice in writing at least thirty (30) days prior to the effective date of such termination. In the event the City terminates this Agreement as herein provided, the City agrees to pay to BWR any and all sums due and owed for services rendered in accordance with the terms of this Agreement to the effective date of such termination.
