Henrietta Derrel-Cust of Records P.S.. „~ RESOLUTION N0.2009-02 A RESOLUTION APPOINTING HENRIETTA DERRELL CUSTODIAN OF POLICE RECORDS TO THE RIVERSIDE DEPARTMENT OF PUBLIC SAFETY AND THE ESTABLISHMENT OF A FEE SCHEDULE FOR DOCUMENT DISSEMINATION IN COMPLIANCE WITH CHAPTER 610 OF THE REVISED STATUTES OF MISSOURI, COMMONLY KNOWN AS THE SUNSHINE LAW WHEREAS, Section 610.023.1, RSMo, provides that a public governmental body is to appoint a custodian to maintain that body's records and the identity and location of the custodian is to be made available upon request; and WHEREAS, Section 610.026, RSMo, sets forth that a public governmental body shall provide access to and, upon request, famish copies of public records; and WHEREAS, Section 610.028.2, RSMo, provides that a public governmental body shall provide a reasonable written policy in compliance with sections 610.010 to 610.030, RSMo, commonly referred to as the Sunshine Law, regarding the release of information on any meeting, record or vote. NOW, THEREFORE, BE IT RESOLVED the Board of Aldermen of the City of Riverside, Missouri hereby adopts the following policy to apply to the Riverside Department of Public Safety in the management of their police records and the dissemination there of: Section 1 That Henrietta Derrell be and hereby is appointed custodian of the records of Riverside Deparhnent of Public Safety and that such custodian is located at the Records Unit, the Riverside Department of Public Safety's headquarters located at 2990 NW Vivion Road, Riverside, Missouri 64150 during normal business hours, Monday through Friday, 8:00 AM to 5:00 PM, with the exception of holidays. Section 2 That said custodian shall act upon as soon as possible all requests for access to or copies of a public police record, but in no event later then the end of the third business day following the date of the request is received by the custodian. If access to the public record is not granted immediately, the custodian shall give a detailed explanation of the cause for further delay and the place and eazliest time and date that the record will be available for inspection. If a request for access is denied, the custodian shall provide, upon request, a written statement of the grounds for such denial. Such statement shall cite the specific provision of law under which access is denied and shall be furnished to the requester no later than the end of the third business day following the date that the request for the statement is received. Section 3 Written requests to inspect or reproduction of police records shall be on a form provided by the Department of Public Safety ..,,, Section 3 That the fees to be chazged for access to or furnishing copies of records shall be as hereinafter provided: Fee Schedule $5.00 per copy. Note: Fees may not exceed 10 cents per page for paper copies 9 by 14 or smaller, plus an hourly fee for duplicating time not to exceed the average hourly rate of pay for clerical staff of the public governmental body. Research time may be billed at actual cost. Section 4 That the Riverside Department of Public Safety shall comply with sections 610.010 to 610.030, RSMo, the Sunshine Law, as now existing or hereafter amended. ~rd Passed this day of February, 2009. ~_ Mayor Kathleen L.
