BILL N0.2004-42 ORDINANCE N0.2004-42 AN ORDINANCE AMENDING TITLE VI, CHAPTER 622 OF THE MUNICIPAL CODE OF THE CITY OF RIVERSIDE, MISSOURI, BY AMENDING SECTION 622.050: LICENSE APPLICATIONS WHEREAS, the legislature of the State of Missouri revised a provision regarding the minimum age requirement for dancers in adult cabazets during its 2003 legislative session; and WHEREAS, the City of Riverside, Missouri (the "City") and its staff have conducted a comprehensive review of the City's Municipal Code (the "Code") sections regarding adult entertainment and have determined that the language changed by the Missouri Legislature in 2003 is not properly reflected in the current version of the Code; and WHEREAS, the City staff and the Board of Aldermen have reviewed, examined and deemed adoption of the amendments to be advisable and in the City's best interests for the promotion of the health, safety and welfare of the residents of the City; and WHEREAS, the City deems it advisable to hazmonize, to the extent possible, its ordinances with the statutes of the State. NOW, THERFORE, be it ordained by the Boazd of Aldermen of the City of Riverside, Missouri, as follows: Section 1. Section 622.050 of the Municipal Code of the City of Riverside, Missouri are hereby amended as follows: SECTION 622.050: LICENSE APPLICATIONS [Subsection A. is unchanged.] B. Manager Or Entertainer License. All persons desiring to secure a license to be a manager or entertainer shall make a verified application with the City Clerk. All applications shall be submitted in the name of the person proposing to be a manager or entertainer. All applications shall be submitted on a form supplied by the City Clerk and shall require all of the following information: [Subsections 1-4 aze unchanged.] 5. The applicant shall present to the City Clerk, who shall copy, documentation that the applicant has attained the age of nineteen (19) years at the time the application is submitted. The provisions of the Municipal Code of the City of Riverside, Missouri revised and/or enacted herein shall not be construed to revive any former ordinance, clause or provision of the Municipal Code of the City of Riverside, Missouri. Section 3. The sections, paragraphs, clauses, and phrases of the Ordinance are severable and if any portion of the Ordinance is declared unlawful by the valid judgment, decree, or injunction order of a court of competent jurisdiction, such ruling shall not affect any of the remaining phrases, clauses, sentences, paragraphs, and sections of the Ordinance and all provisions of the Ordinance not specifically declared to be unlawful shall remain in full force and effect. Section 4. This Ordinance overrides any conflicting provision or regulation within the Municipal Code of the City of Riverside, Missouri. Section 5. This ordinance shall take effect immediately.
