AN ORDINANCE AUTHORIZING AND ADOPTING THE REZONING OF CERTAIN
PROPERTY LOCATED ALONG GATEWAY DRIVE SOUTH TO JUMPING BRANCH
CREEK ON VIVION ROAD FROM "CPO" CIVIC AND PROFESSIONAL OFFICE
DISTRICT TO "C-1" GENERAL COMMERCIAL DISTRICT
WHEREAS, at its meeting on May 13, 2004, the Planning and Zoning Commission of the City
of Riverside, Missouri (the "Commission's conducted a public hearing wherein it considered and
reviewed a rezoning proposal for certain property abutting on the West side of Gateway Drive and on
Vivion Road, such property more particularly and legally described below and to be rezoned from
"CPO" Civic and Professional Office District to "C-1" General Commercial District; and
WHEREAS, the Commission recommended approval of the rezoning proposal on May 13,
2003; and
WHEREAS, the Board of Aldermen of the City of Riverside, Missouri, at its regular meeting of
May 18, 2004, conducted a public hearing regarding, and considered and reviewed, the rezoning
proposal and the recommendation of the Commission regarding the same; and
WHEREAS, at its meeting, the Board of Aldermen determined adoption and approval of the
proposed rezoning to be in the City's best interests and to promote the public health, safety and
welfare.
NOW, THEREFORE, be it ordained by the Board of Aldermen of the City of Riverside,
Missouri; as follows:
Section 1. The Board of Aldermen approves the rezoning proposal for the properties which
abut Gateway Drive on the West Homing from the business commonly known as Leibrand's
Automotive South to Vivion Road, and then abutting Vivion Road on the West and running South
from the Gateway Drive-Vivion Road intersection to Vivion Road's intersection with or crossing of
Jumping Branch Creek, and which are more particularly described on Exhibit A attached hereto, and
hereby changes the zoning of such property from "CPO" Civic and Professional Office District to "C-
1" General Commercial District.
Section 2. The Mayor shall have authority to take such actions and to execute such
documents as she shall deem reasonably necessary to cant' out the provisions and intent of this
ordinance.
Section 3. This ordinance shall take effect immediately.

Gary and Sheila Ann Jenkins, said Southwest corner being also on the North line of a
parcel of land owned by Rebecca Sue Ricker, shown as parcel number 23-2.0-04-200-
001-034-000, on Platte County, Missouri Assessor map No. 23-2.0-04-2001ast revised
January, 2000 by JAW; thence West along said North line to the Northwest comer of said
