HomeMy WebLinkAbout2003-09-02 Minutes of Regular Meeting of Boazd of Aldermen of City of Riverside, Missouri September 2, 2003 A regular meeting of the Boazd of Aldermen of the City of Riverside, Missouri, was held in the City Hall, of Riverside, Missouri, on September 2, 2003 at 6:30 p.m. Those in attendance were Mayor Betty Burch, Aldermen Burris, Looker, Darata, Legaazd, Beard and Flaws. Also present were, Louise Rusick, City Clerk, Chief Wylie Simpson, Brent Miles, Planning and Zoning Coordinator, John Jackson, City Engineer, John McClelland, Matt Kitzi and Ben Prell, City Attorney's office. Visitor's Discussion Brian Jones discussed his idea to rehabilitate the Northcrest and Homestead Apartments. He said he would like to work with the city to have housing under Section 7 and 42 guidelines and is looking for the city's support to take the project to the next level. He said the scope of rehabilitation and renovation for the Line Creek Projects would be approximately $17,000 per unit (dwelling) or $$68,00 for a four plex. The lower units must be torn down to concrete and this will cost more. There aze (124) one hundred twenty-four units presently. For landscaping four units, $2,000 would be spent. These units would be renovated in conjunction with the existing surroundings. He said he has a drawing and would match the color and color scheme as much as possible. There would be new roofs and window coverings and the exterior would have low maintenance. There would be a $300 annual fee for low maintenance reserve. The azchitect has a long list of replacements. One unit would be used for a rental office. No club house is planned. No one can be denied rental, unless there is a criminal background. Mayor Burch said since $10,000,000 is being spent on the levee, streets and additional improvements, the city would like to see something "very nice." Alderman Bums asked for an explanation of Section 42. The renter's income could not be more than $36,000 and capping out at $38,000 a yeaz and in the 40- 50%rnedium income. A guess for subsidized units aze between sixteen and twenty-two per cent. Rent would be $435-$465 month and deposits would be charged. Alderman Looker asked about the process that must be followed. Mr Jones said he would work with the city and county and there is a time line that all paperwork for the project request must be turned into Jefferson City by October. There would be aten-yeaz compliance for the investor with the developer to have rent structures. A 20-35 year note would be owed to the state. A mix of credits and low interest loans with afifteen-year compliance. The intention is to draw interest to couples of two and three. A bedroom would be added on some units. He has applied for Missouri Development Bonds. He said he would agree to an occupancy permit and inspections would be welcome and would give the city a copy of the guidelines. Mins 9/2/03 Mr. Jones asked if this would be a TIF district. He said bonds would be issued with Platte County (4% or 9%). He is now working with Gilmore & Bell regarding tax credits and bonds. The bond request is $4.5 million. If the project starts in May or June at 9%, by January 2004 rate would be four percent. This property will move to foreclosure if this idea of Mr. Jones is not successfixl. It was mentioned the same idea was spoken about a yeaz ago from some affiliates and that there are second and third mortgages on the Homestead Road properties and Northcrest. Gate Woods Jim Trimble, Gate Woods Development LLC spoke regarding a letter he Development received from FEMA stating the city should file for a map change (the floodway and floodplain maps). He has aerial photos of the Kansas City trunk sewer line that the creek had been partially relocated to its present location. In June 1969-June 1970 the approval for the development of the drive- Inn Theater was granted by the Board of Aldermen. The present location of the creek existed in 1969. The maps from the National Flood Insurance Program in 1977 showed the old 1964 GS. In 1987 the map was revised in the same way with the creek running through the drive-inn theater and this hadn't been so since twenty years before. The Engineer's granted a no-rise certificate and the city approved it. In review of the map, showing this in the flood plain, the bank can't lend money. Jim feels since there is a lowered flood elevation, the city would need to request a map change. The flood plain is lower because of the new construction of SOs' Street. He feels it is up to the city to tell FEMA this information because it relates to the map. Jim met with a Missouri FEMA representative and it was stated the 1977 and 1987 the maps can be corrected because this was their error. Mr. Trimble is asking the city to have the FEMA maps changed. David Blackburn, City Administrator said the State Emergency Management Association (SEMA) has checked the counties studies to adjust the maps and this could take 3-5 years. Also, regardless of the past, concerning the floodway, an application needs to be completed and someone needs to show where the floodway lies (the city or developer) saying where lies. If this is FEMA's error, the developer could pick up the FEMA cost to redo the map for engineering cost and the contractor. Jim said it would be 90-120 days before all this can be done and it takes another 3-4 months after FEMA receives it. As for 50'" Street, the city reports the flow level reduced because of larger culverts. Advancing $1.3 million A discussion was held regazding the city advancing $1.3 million to the to the Levee district Riverside Quindaro Bend Levee District of Platte County, Missouri for the Levee project and paying ESI's bills for August. Asbestos survey John read the asbestos survey bids for the White City Motel, BKT, Inc, bids read Karr's and Leibrands: Occu-tech, Inc. $3,275 Clayton Group $3,250 Mins. 9/2/03 Public Hearing Mayor Burch opened the Public Hearing at 7:33 p.m. previously continued from Continued August 19`s requesting a Special Use Pernrit in the Flood Hazard Area by Available Construction. Public Hearing As there were no comments from the public, the Public Hearing was closed Closed at 7:33 p.m at 7:33 p.m. Mayor and Aldermen Mayor Burch asked if the azea on the side of the building would accommodate Discussion fire service and it was stated the azea is 16' wide. Alderman Beazd asked if this was in the corps "critical zone" and John Jackson said it is not. Alderman Burris asked where the retaining wall would be placed. He was told at the back of the property on the dry side of the floodway within about 20' and the wall is 9 ''/z' high in some places. The back of the building to the retaining wall (lane) is 16' at the front and 18' at the back and the faz side and a 35' radius to tum around. The distance from the street is 55 feet. Special Use Permit Alderman Flaws moved to approve a Special Use Pemrit with four conditions for Available Const. (1) The applicant provide the city with documentation from an engineer licensed Approved with in the state of Missouri that the fill being placed in the flood hazazd area meets conditions floodplain requirements (2) The fill should be seeded or otherwise planted to reduce erosion or nmoff (3) Obtain a Missouri Depaztment of Natural Resources Land Disturbance permit due to size of land being greater than one (1) acre and (4) Obtain a building pemrit and submit with stamped plans to construct retaining wall for Available Construction to place fill in the floodplain during construction, seconded by Alderman Bums, the vote was: Aye: Aldermen Burris, Flaws, Darata, Legaazd, Beazd and Looker. Building Permit for Pinnacle Imports New Public Safety Bldg water line relocation Motion carries. Alderman Flaws moved to approve a building permit for Pinnacle Imports LLC, 614 NW Platte Valley Drive to build a twelve (12) by ten (10) foot office, seconded by Alderman Burris, the vote was: Aye: Aldermen Flaws, Dazata, Legaard, Beard, Looker and Bums. Motion carries. John stated the water line on the W. side of Vivion Rd side of the City Hall is to be relocated and does not believe a change order is needed. Mins. 9/2/03 Phone cable John said the city was given a $35,000 credit for the city installing the phone discussion on NW cable conduit underground on NW (upper) Gateway. Recess A brief recess was called at 8:13 p.m Reconvened The Mayor and boazd answered to roll call at 8:25 p.m Public Safety comments Chief Simpson said a demonstration of the cold draft misting system was held for the last ten (10) days. This system cools the firefighters down. Bill No. 2003-81 Alderman Looker moved to place Bill No. 2003-81 on its fast reading, Authorizing the City said Bill authorizing the City of Riverside, Missouri to employ Jim Hare to employ Jim Haze as the Codes Enforcement/Building Inspector at a annual salary of as Codes Enforcement $35,000.00 and to be effective September 3, 2003 with full benefits and a six month working test period and after six months of employment and completion of IBC Building Inspector Residential Certification, the salary will be increased by $1,000.00 annually, seconded by Alderman Dazata, the vote was: Aye: Aldermen Flaws, Legaard, Beard, Burris, Darata and Looker. Nicholas C Jackalone Alderman Looker moved to approve employing Nicholas Claude Jackalone hued as full time P.S. as a full time Public Safety Dispatcher in the Department of Public Safety Dispatcher, Approved effective September 17, 2003, seconded by Alderman Burris, the vote was: Aye: Aldermen Flaws, Dazata, Legaazd, Beard and Looker.
