BILL N0.2004-78 ORDINANCE N0.2004-78 AN ORDINANCE AMENDING TITLE IV, SECTIONS 410.087 REGARDING BUILDING RESTRICTIONS AND REGULATIONS IN DISTRICTS ZONED "GP" GENERAL PLANNED DEVELOPMENT WHEREAS, the City of Riverside, Missouri (the "City', is charged with protecting the public, health, safety and welfare, and desires to do so fairly and responsibly; and WHEREAS, the City desires to implement zoning mechanisms intended to attract commercial investment and business, to increase the property values of current property owners, and to ensure that businesses and uses are attractive and aesthetically pleasing in their appearance; and WHEREAS, the City Planning and Zoning Commission, at a public hearing held June 24, 2004, considered and discussed amendments to the City Code's Section regarding the GP District, and specifically provisions which address the maximum height of buildings in the GP District; and WHEREAS, after such consideration and discussion, the Planning and Zoning Commission recommended that the City's Board of Aldermen adopt the proposed amendments; and WHEREAS, during a public hearing held during its meeting of July 6, 2004, and again at its meeting of August 3, 2004, the -Board of Aldermen considered and discussed the proposed amendments and the recommendation of the Planning and Zoning Commission; and WHEREAS, the Board of Aldermen has determined it to be in the City's best interests to accept the Planning and Zoning Commission's recommendation and adopt the proposed amendments, NOW, THEREFORE, be it ordained by the Board of Aldermen of the City of Riverside, Missouri, as follows: Section 1. Section 410.087.B.3(16) of the City Code of the City of Riverside is hereby amended and hereafter shall which shall read, in its entirety, as follows: SECTION 410.087: "GP" GENERAL PLANNED DEVELOPMENT DISTRICT B. 3. Every application for "GP" Districts and any amendments to an approved development plan shall be accompanied by a development plan containing the following information: (16) Location of proposed buildings. and structures and existing buildings and structures to remain, with written dimensions of setback from proposed street right-of--way and adjacent property lines, dimensions of building width and length, number of floors, gross floor area per floor, height above grade, and total building area. Residential buildings shall identify, in addition, the number of dwelling units per floor and the total number of dwelling units. Section 2. Section 410.087.D.5 of the City Code of the City of Riverside is hereby deleted and replaced with the following language, and hereafter shall read, in its entirety, as follows: SECTION 410.087: "GP" GENERAL PLANNED DEVELOPMENT DISTRICT D. Standards in "GP"Districts. 5. Site requirements. a. Height. Building height shall be a maximum of five stories or seventy five (75) feet subject to the ability to provide adequate public safety services b. Setback from streets. Minimize building setbacks from the street, moving parking areas from the front to the sides or rear to the extent feasible, given the proposed use of the site and the character of adjoining uses. Where buildings exceed three stories or thirty- five (35) feet in height, there shall be a minimum setback of thirty (30) feet from all property lines. For each additional ten (10) feet in height greater than thirty-five (35) feet, the setback shall increase by two (2) feet. c. Parking. Parking lot pavement shall be shielded from the street by low berming to the maximum extent feasible. d. Loading areas. Any loading area within an area subject to this area shall be buffered with landscape materials in conjunction with earthen berms. -2- . - Section 3. All Ordinances and parts thereof conflicting herewith are hereby repealed. Section 4. If any section, subsection, subdivision, paragraph, sentence, clause or phrase in this Ordinance, or the application thereof to any circumstances, is for any reason held to be unconstitutional or invalid or ineffective by any court of competent jurisdiction, such decision shall not affect the validity or effectiveness of the remaining portions of this Ordinance.
