HomeMy WebLinkAbout2003-10-07~- Minutes of Regulaz Meeting of Boazd of Aldermen of City of Riverside, Missouri October 7, 2003 A regulaz meeting of the Boazd of Aldermen of the.City of Riverside, Missouri, was held in the City Hall, of Riverside, Missouri, on October 7, 2003 at 7:30 p.m Those in attendance were Mayor Betty Burch, Aldermen Burris, Looker, Darata, Legaard, Super and Beazd. Also present were, David Blackburn, City Administrator, Louise Rusick, City Clerk, Chief Wylie Simpson, John Jackson, City Engineer, Matt Kitzi and Ben Prell, City Attorney's office. Minutes, Aug.12, 2003 Alderman Beard moved that the minutes of August 12, 2003 be approved, Approved seconded by Alderman Legaazd, the vote was: Aye: Aldermen Bums, Darata, Legaazd, Beard and Looker. Abstain: Alderman Super. Motion carries. Minutes, Sept.16, 2003 Alderman Legaard moved that the minutes of Septemberl6, 2003 be approved Approved as corrected, seconded by Alderman Looker, the vote was: Aye: Aldermen Legaard, Burris, Dazata, Beard, Super and Looker. Motion carries. Minutes, Sept. 22, 2003 Alderman Legaazd moved that the minutes of September 22, 2003 be approved Approved seconded by Alderman Looker, the vote was: Minutes, Sept. 24, 2003 Approved Letter Agreement for additional services requested by TranSystems, Approved Minn. 10/7/03 Aye: Aldermen Dazata, Beard Legaard, Bums, Super and Looker. Motion carries. Alderman Looker moved that the minutes of September 24, 2003 be approved as corrected, seconded by Alderman Super, the vote was: Aye: Aldermen Darata, Super, Legaazd, Beard, Looker and Burris. Motion carries. Alderman Looker moved to approve a letter agreement for additional services for West Platte Road Street Improvements in the amount of $81,363, seconded by Alderman Dazata, the vote was: Aye: Aldermen Super, Darata, Burris, Legaard, Beard and Looker. Motion carries. Frank Weatherford's Frank Weatherford, TranSystems Corp. will, at the October 2161 meeting, comments provide the board with a breakdown of funding of the I-635 Interchange project. Discussion regazding A discussion was held by John Jackson, City Engineer regarding the fence that the fence along the levee runs along the levee, stating the fence does not have to be eight feet high, only four or five feet. Four foot high fence Alderman Looker moved to approve a four foot high fence (no bazbwire) along the levee along the levee, seconded by Alderman Burris, the vote was: Approved Aye: Aldermen Darata, Legaard, Beazd, Looker, Burris and Super. Motion carried. Discussion regarding A discussion was held regazding the repair/maintenance of the brick walkway at the brick walkway the E.H. Young Riverfront Pazk. John will obtain estimates and present at the at the E.H. Young next board meeting. River&ont Pazk Brent discussed Brent Miles, Community Development and Planning Coordinator, discussed a the 2002 National proposal for the 2002 National Electrical Code. Further research is being done Electrical Code by the city staff. Brent said a Flood Plain Management workshop was held on September 30'" at City Hall with FEMA and SEMA representatives, George Riedel and Connie Wisneski. Brent presented the board with a progress report (floodplain development issues) and lots that are currently located within the identified floodway at Gate Woods Development, development is at a standstill. Chief Simpson's Chief Simpson announced, Dispatcher Nicholas Jackalone's resignation as of October 7, 2003. Mayor Burch's Mayor Burch mentioned a committee to be appointed, i.e. two (2) city Comment employees and (2) board members, Aldermen Looker and Alderman Super for the landscaping along W. Platte. Municipal Court Alderman Legaazd moved to approve the Municipal Court Report for Report Approved September, seconded by Alderman Burris, the vote was: Alderman Dazata, Bums, Legaard, Beard, Looker and Super. Motion carries. Proclamation Alderman Legaazd moved to approve a proclamation declaring October Approved as National Breast Cancer Awazeness month, seconded by Alderman Dazata, the vote was: Aldermen Burris, Legaard, Beazd, Looker, Super and Darata. Motion carries. Mies. 10/7/03 Bill No. 2003-93 Alderman Burris moved to place Bill No. 2003-93 on its fast reading, Payment of said Bill authorizing the payment of certain indebtedness listed therein, Indebtedness seconded by Alderman Dazata, the vote was: Aye: Aldermen Darata, Burris, Legaard, Beazd, Super and Looker. Motion carries. Ordinance No. 2003-93 Alderman Darata moved to place Bill No. 2003-93 on its second reading, Approved and upon passage of same become Ordinance No. 2003-93, seconded by Alderman Looker, the vote was: Aye: Aldennen Super, Darata, Burris, Legaazd, Beard and Looker. Motion carries Bill No. 2003-94 Alderman Looker moved to place Bill No. 2003-94 on its fast reading, Authorizing the city said Bill authorizing the City of Riverside, Missouri to opt out of state to opt out of state imposed sales tax holiday, seconded by Alderman Darata, the vote was: tax holiday Aye: Aldermen Legaazd, Looker, Super and Darata. No: Aldermen Beard and Bums. Motion carries. Ordinance No. 2003-94 Alderman Super moved to place Bill No. 2003-94 on its second reading, Approved and upon passage of same become Ordinance No. 2003-94, seconded by Alderman Dazata, the vote was: Aye: Aldermen Super, Dazata, Looker and Legaard. No. Aldermen Beazd and Bums. Motion carries. Aldermen's comments Alderman Super asked about the Salvation Army Agreement the city previously entered into. Mayor Burch explained this was agreed upon because of the services the Salvation Army offers. Alderman Looker asked if there were any trees available to locate where the ones that were destroyed by the tornado. A discussion was held, no final decision. Recess A brief recess was called at 9:00 p.m. Reconvened The Mayor and board answered to roll call at 9:15 p.m. Mins. 10/7/03 Motion for Closed Alderman Darata moved that the meeting go into closed session, pursuant to Session RSMo 610.021(1) for discussion of Legal Issues, RSMo 610.021(2) Real Estate and 610.021(3) Personnel Issues with the City Attorney, seconded by Alderman Looker, and the vote was: Aye: Alderman Beard, Darata, Bun•is, Super, Looker and Legaazd. Motion Carries. Motion for Open Alderman Legaazd moved that the meeting go into open session at Session seconded by Alderman Dazata, and the vote was: Aye: Alderman Burris, Looker, Dazata, Legaazd, Beard and Super. Mayor's comment A senior writer with the Wall Street Journal met with Mayor Burch spending all day Wednesday and Thursday a.m and then the visitor traveled about the city talking to different people. $7,500 Approved Alderman Looker moved to approve paying $7,500 to Finnegan, Conrad & to Finnegan, Conrad Peterson, the city's defense regarding the water rate case, seconded by for the city's defense Alderman Beard, the vote was: in the water rate case Aye: Aldermen Burris, Looker, Darata, Legaard, Beard and Super. City erk ' Minn. 10/7/03 BILL N0.2003-94 ORDINANCE N0.2003-94 AN ORDINANCE AUTHORIZING THE CITY OF RNERSIDE, MISSOURI TO OPT OUT OF STATE IMPOSED SALES TAX HOLIDAY WHEREAS, the Missouri General Assembly has passed and the Governor has signed, Senate Biil 11 that established a so-called "Sales Tax Holiday" for the second weekend in August, 2004 and WHEREAS, the legislation does not provide for the reimbursement to local governments for lost revenues, and WHEREAS, the sales tax holiday will significantly reduce local revenues, and WHEREAS, municipalities depend on sales tax revenues to provide essential services for the citizens, including police, fire, parks, street, code enforcement, etc., and WHEREAS, these sales taxes were approved by a vote of the people who expect the promised services, and WHEREAS, the legislation authorizes local governments to opt out of the sales tax holiday by ordinance of the governing body, NOW THEREFORE BE TT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF RNERSIDE, MISSOURI AS FOLLOWS: Section One. The City of Riverside, Missouri hereby determines that it will prohibit the provisions of Section 144.049 RSMo. 2003, from exempting sales of certain clothing, personal computers, certain computer software, and school supplies that occur within the boundaries of said City during August 13, 2004 through August 1 S, 2004 from local sales taxes. Section Two. The City Clerk is hereby directed to send written notice to the State of Missouri Department of Revenue as soon as possible, but no later than July 9, 2004, of the decision to opt out of the "Sales Tax Holiday," by forwarding a letter and certified copy of the ordinance.
