REGULAR MEETING
BOARD OF ZONING ADJUSTMENT
RIVERSIDE, MISSOURI
Monday, June 30, 2008
6:00 p.m.
The Board of Zoning Adjustment for the City of Riverside, Missouri, met in regular session in the Board of Aldermen
Chambers at City Hall, 2950 NW Vivion Road, Riverside, Missouri.
The meeting was called to order at 6:00 p.m. Answering roll call were Fred Buckley, Gale Perkins, Jeff Warren and Dean
Lefstad. Members absent: Marvin Pool. Also present: Jackie Carlson from Shafer Kline and Warren Inc. and Sarah Wagner
Administrative Clerk.
Approval of Minutes from Dean Lefstad moved to approve the Minutes from February 7, 2008.

Jeff Warren seconded and the motion passed.
Variance Grant for Daniel Gale Perkins opened the public hearing at 6:01 p.m.
and Erin Nystrom- 5021
and 5023 NW High Drive Jackie Carlson with Shafer Kline and Warren, Inc. gave a staff report.
Terrace She explained that the applicants, Daniel and Erin Nystrom, were
requesting a variance from the minimum lot with requirement of 80 feet
to allow a lot split at the property located at 5021 and 5023 NW High
Drive Terrace. The property is currently a legal non-conforming
situation as there are 2 principal uses (primary residences) located on
the same single-family residential lot. The applicant is looking to split
the lot in order to sell the two houses / properties individually. In order
for the lot split to be approved a variance to the minimum lot width
standard of 80 feet must be granted. Besides the lot split, the applicant
is not proposing any changes to the site or buildings at this time. The
proposed lot split meets all other requirements of the UDO and staff
recommends approval.
Marvin Pool arrived at 6:06 p.m.
Lefstad asked what the ages of the two houses were and when the lot
with requirement came into effect.
Carlson replied that the UDO was adopted in 2006, but the lot with
requirements remained the same as those adopted in the 1970 code.
There are no records of any permits being issued, so a precise date of
when the houses were constructed is unclear.
Marvin Pool commented that one of the houses is very small at only 500
square feet.
Carlson replied that before the UDO there were no minimum
requirements for square footage.
Lefstad asked what the previous use of the building was.
Carlson replied that the City does not have any record of it being used

as anything other than a single family residence.
Lefstad asked how the utilities were set up between the two houses.
Carlson said that the applicant would have that information.
Perkins asked what would happen if any major changes were done to
the smaller house.
Carlson replied that if the house was damaged over 50% it would have
to be rebuilt to meet current code and there would be enough room on
the lot to meet all required setbacks if it were rebuilt to current codes.
Pool asked if the small house was occupied.
Carlson replied that it had been rented out in the past, but now the
applicant is trying to sell it as two separate owner occupied units which
is in conformance with the Master Plan to have more owner occupied
housing.
Stephanie Collins from Beacon of Assurance, Inc. addressed the Board
on behalf of the applicant. She explained that the gas and electric for
the two houses were separate, but the water would need to be split.
Lefstad asked about the layout of the small house.
Collins explained that it was a one bedroom, one bathroom house.
Perkins asked when the houses were built.
Collins replied that the small house was built sometime in the 1950’s
and the larger house was built sometime in the 1970’s
Dick Grogan of 5017 NW High Drive Terrace addressed the Board. He
commented that he did not think that the small house was hooked up to
the sewer.
Collins replied that both houses were hooked up to the sewer system.
Carlson commented that the utilities are something that will be
reviewed as part of the lot split application.
John Rus of 5024 NW High Drive Terrace addressed the Board and said
that he would like to see more owner occupied housing.
Collins said that the intent is to sell the two houses, but will rent them
out if necessary.
Perkins closed the public hearing at 6:24 p.m.
Pool moved to approve the variance to allow the lot located at 5023 to
be less than the required 80 foot width.
Fred Buckley seconded and the motion passed.

Pool seconded and the meeting was adjourned.
