Minutes of Regular Meeting of Board of Aldermen of City of Riverside, Missouri March 5, 2002 A regular meeting of the Board of Aldermen of the City of Riverside, Missouri was held in the City Hall of Riverside, Missouri on March 5, 2002 at 7:30 p.m. Those in attendance were Mayor Betty Burch, Aldermen Burris, Beard, Wedua, Darata, Legaard, and Flaws. Also present were David Blackburn, City Administrator, Louise Rusick, City Clerk, John McClelland and Matt Kitzi, City Attorneys office. Minutes, February 19, 2002 Alderman Beard moved that the minutes of February 19, 2002 be Approved approved as corrected, seconded by Alderman Legaard, the vote was: Aye: Aldermen Burris, Flaws, Darata, Legaard, Beard and Wedua. Motion carries. Minutes, February 26, 2002 Alderman Wedua moved that the minutes of February 26, 2002 be Approved approved as corrected, seconded by Alderman Burns, the vote was: Aye: Aldermen Flaws, Darata, Burris, Legaard, Beard and Wedua. Motion carries. Building Permit for Colin Alderman Beard moved to approve a building permit for Colin Campbell, 4303 NW Gateway, Campbell, 4303 NW Gateway to reinstall new garage door and add a Approved roof over top of door, seconded by Alderman Legaard, the vote was: Aye: Aldermen Darata, Burris, Legaard, Beard, Wedua and Flaws. Motion carries. Public Hearing Opened Mayor Burch opened the Public Hearing at 7:35 p.m. to consider Bill No. 2002-36, said Bil] amending the Riverside City Code, Title IV, provisions related to Single-Family Residential Buildings in Districts Zoned "R-1". Comments from Visitors Steve Begshaw, Home Builders Association, 600 E. 103`d St, Kansas City, Mo spoke saying his concern with the proposed Bill is the "Basement portion of definition". After John McClelland explained, he said he was satisfied with the proposed Bill. Lily Trimble, 5503 NW Foxhil] Road, Parkville, Mo asked about the basement portion, out of the ground, counted as floor space. John stated it depends on the grade. Toni Looker stated Section 3 of the Bill, Restoration of damaged non- conforming building was discussed and passed at the previous Planning and Zoning meeting and asked for clarification, "If an old house is destroyed, can it be built back as was before if the house is more than fifty percent destroyed?" She was told, "no", only if less than fifty percent of it is destroyed. Public Hearing After discussion, Mayor Burch continued the Public Hearing until sixty Continued in sixty days days. City Administrator Comments David said Public Works is requesting to contract with Damon Pursell Construction Co to grind up the massive amount of limbs and brush. Alderman Beard suggested asking Pursell Construction to bring an end- up trailer to haul all the limbs brush to Northwood Road and dump on his property and to obtain a Fee to do so, up to $5,000 maximum. City Engineer Comments John Jackson said the Construction Manager (McCown & Gordon, Contract for the Public Safety Building is finished. John recommended Banderas Construction for the 50`" Street improvements. George Butler & Assoc. Alderman Beard moved to accept George Butler Associates for plan Approved for plan review review proposal on the Argosy expansion, seconded by Alderman proposal on Argosy expansion Darata, the vote was: Aye: Aldermen Burris, Flaws, Darata, Legaard, Beard and Wedua. Motion carries. Request to purchase 2 type- Alderman Beard moved to purchase two typewriters for Public Safety and writers for Court & Public Safety Court, IBM, Mode1500, State Bids at $659 each from MTC, seconded by Approved Alderman Flaws, the vote was: Aye: Aldermen Flaws, Darata, Legaard, Beard, Wedua and Burris. Motion carries. Court Report for February Alderman Darata, moved to approve the Court Report for February, Approved seconded by Alderman Wedua, the vote was: Aye: Aldermen Legaard, Burris, Beard, Flaws, Darata and Wedua. Motion carries. Bill No. 2002-27 Alderman Flaws moved to place Bill No. 2002-27 on its first reading, Payment of Bills said Bill authorizing the payment of certain indebtedness listed therein, seconded by Alderman Beard, the vote was: Aye: Aldermen Flaws, Burris, Darata, Beard, Legaard and Wedua. Motion carries. Ordinance No. 2002-27 Alderman Burris moved to place Bill No. 2002-27 on its second reading Approved and upon passage of same, become Ordinance No. 2002-27 seconded by Alderman Wedua, the vote was: Aye: Aldermen Flaws, Darata, Beard, Legaard, Wedua and Burris. Motion carries. Bill No. 2002-28 Alderman Beard moved to place Bill No. 2002-28 on its first reading, Amend. Title II of the City Code said Bill amending Title II of the Municipal Code of the City of by adding Sect. 210.315 re: Riverside, Missouri by adding Section 210.315 regarding the crime of theft of motor fuel theft of motor fuel, seconded by Alderman Wedua, the vote was: Aye: Aldermen Burris, Darata, Flaws, Legaard, Beard and Wedua. Motion carries. Ordinance No. 2002-28 Alderman Legaard moved to place Bill No. 2002-28 on its second reading Approved and upon passage of same, become Ordinance No. 2002-28 seconded by Alderman Wedua, the vote was: Aye: Aldermen Flaws, Darata, Beard, Legaard, Wedua and Burris. Motion carries. Bill No. 2002-29 Alderman Beard moved to place Bill No. 2002-29 on its first reading, Amend. Title II of the City Code said Bill amending Title II of the Municipal Code of the City of by adding Sec. 210.265 regarding Riverside, Missouri, by adding Section 210.265 regarding the sale the sale of met amphetamine of met amphetamine precursor drugs, seconded by Alderman Darata, precursor drugs the vote was: Aye: Aldermen Flaws, Darata, Burris, Legaard, Wedua and Beard. Motion carries. Ordinance No. 2002-29 Alderman Darata moved to place Bill No. 2002-29 on its second reading Approved and upon passage of same, become Ordinance No. 2002-29 seconded by Alderman Wedua, the vote was: Aye: Aldermen Flaws, Darata, Beard, Legaard, Wedua and Burris. Motion carries. Bill No. 2002-30 Alderman Beard moved to place Bill No. 2002-30 on its first reading, Amend. Title II of the City Code said Bill amending Title II of the Municipal code of the City of Chapt. 210, Art, XII; Smoke Free Air Riverside, Missouri, by adding Section 210 Article XII relating to and sale and possession of smoke free air and the sale and possession of tobacco products, tobacco products seconded by Alderman Wedua, the vote was: Aye: Aldermen Darata, Beard, Legaard, Wedua, Burris and Flaws Motion carries. Ordinance No. 2002-30 Alderman Flaws moved to place Bill No. 2002-30 on its second reading Approved and upon passage of same, become Ordinance No. 2002-30 seconded by Alderman Beard, the vote was: Aye: Aldermen Flaws, Darata, Beard, Legaard, Wedua and Burris. Motion carries. Bill No. 2002-31 Alderman Darata moved to place Bill No. 2002-31 on its first said Bill Amend. Ordinance No. 2002-31 Alderman Beard moved to place Bill No. 2002-31 on its second reading Approved and upon passage of same, become Ordinance No. 2002-31 seconded by Alderman Darata the vote was: Aye: Aldermen Flaws, Darata, Beard, Legaard, Wedua and Bums. Motion carries. Bill No. 2002-32 Alderman Beard moved to place Bill No. 2002-32 on its first reading, Amend. the City Code by said Bill amending the Municipal Code of the City of Riverside, modifying Sect. 130.180 and Missouri, by modifying Section 130.180 and adding Section 200.050 adding Sect. 200.050 relating relating to pre-release inquiries on prisoners convicted of crimes or to pre-release inquiries on held on suspicion of charges, seconded by Alderman Flaws, the vote prisoners convicted of crimes was: or held on suspicion of charges Aye: Aldermen Darata, Beard, Legaard, Wedua, Burris and Flaws. Motion carries. Bill No. 2002-33 Alderman Legaard moved to place Bill No. 2002-33 of the City Amend. Title II of the City of Riverside, Missouri, by amending Section 205.090 regarding animal Code by amend. Sects. 205.090 regulations and prohibited acts, seconded by Alderman Beard, regarding animal regulations the vote was: and prohibited acts Aye: Aldermen Darata, Beard, Legaard, Wedua, Burris and Flaws. Motion carries. Ordinance No. 2002-33 Alderman Wedua moved to place Bill No. 2002-33 on its second reading Approved and upon passage of same, become Ordinance No. 2002-33 seconded by Alderman Darata the vote was: Aye: Aldermen Flaws, Darata, Beard, Legaard, Wedua and Burris. Motion carries. Bill No. 2002-34 Alderman Beard moved to place Bill No. 2020-34 on its first reading, Amend. Sect. 435.010 relating to fees for building permits Alderman Beard moved to place Bill No. 2002-37 on its first reading, said Bill amending Title IV of the Municipal Code of the City of Riverside, Missouri by amending Section 435.010 relating to fees for building permits, seconded by Alderman Flaws, the vote was: Aye: Aldermen Burris, Flaws, Darata, Legaard, Beard and Wedua. Motion carries. Ordinance No. 2002-37 Alderman Flaws moved to place Bill No. 2002-37 on its second reading Approved and upon passage of same, become Ordinance No. 2002-37 seconded by Alderman Darata the vote was: Aye: Aldermen Flaws, Darata, Beard, Legaard, Wedua and Burris. Motion carries. Bill No. 2002-38 Alderman Beard moved to place Bill No. 2002-38 on its first reading Amend. Title IV of the City said Bill amending Title IV of the Municipal Code of the City of Code amend. Sect. 485.180 Riverside, Missouri by amending Section 485.180 and Section 485.200 and Sect. 485.200 related to related to the submittal of minor and major subdivision plats, seconded submittal of minor and major by Alderman Darata, the vote was: subdivision plats Aye: Aldermen Flaws, Darata, Legaard, Beard, Wedua and Burns. Ordinance No. 2002-38 Alderman Wedua moved to place Bill No. 2002-38 on its second reading Approved and upon passage of same, become Ordinance No. 2002-38 seconded by Alderman Bums the vote was: Aye: Aldermen Flaws, Darata, Beard, Legaard, Wedua and Burris. Motion carries. Ordinance No. 2002-39 Alderman Beard moved to place Bill No. 2002-39 on its second reading Approved and upon passage of same, become Ordinance No. 2002-39 seconded by Alderman Burris, the vote was: Aye: Aldermen Flaws, Darata, Beard, Legaard, Wedua and Burns. Motion carries. Mayor Burch's' comments Mayor Burch mentioned the trip to Jefferson City, the Missouri Municipal League Conference, saying each home dock city has hired a lobbyist. Eleven home dock cities have casinos. Legislation being presented is to take fifty cents of cities home dock fee and pay to trust funds created for law enforcement and fire protection This would amount to $2 million annually. A committee of five wil] meet April ls` or so to discuss this matter. City Administrator comments David said the City purchased a grappler witch attaches to the bobcat for limbs and the cost will be around $2,600. Recess A brief recess was called at 8:45p.m. Reconvene The Mayor and all Aldermen responded to roll call. Motion for Closed Alderman Darata moved that the meeting go into closed session, Session pursuant to RSMo 610.021(1), Legal Issues, RSMo 610.021(2) real estate, and 610.021(3) personnel issues with the City Attorney, seconded by Alderman Beard, the vote was: Aye: Aldermen Darata, Legaard, Beard, Flaws, Wedua and Burns. Motion carries. Motion for Open Alderman Beard moved that the meeting go into open session, Session seconded by Alderman Flaws, the vote was: Aye: Aldermen Legaard, Beazd, Flaws, Wedua, Dazata and Burris. Motion carries. Right-of-Way Alderman Flaws moved to approve the Offer to Purchase and Right-of- Contract with Walter Way Purchase Contract between Walter L. Dowd, Beverly Lumber Co. Dowd, Beverly Lumber Co. and the City of Riverside, Missouri at a cost of $2,598.00, seconded by Approved Alderman Darata, the vote was: Aye: Aldermen Legaard, Darata, Beard, Wedua, Flaws and Burris Motion carries. Right-of Way Alderman Beard moved to approve the Offer to Purchase and Right-of Contract with Marvin/Michael Contract with Marvin and Michael Azorsky, Hamar, Inc. and the City Azorsky, Hamar, Inc. of Riverside, Missouri at a cost of $$4,661.00, seconded by Alderman Approved Flaws, the vote was: Aye: Aldermen Darata, Wedua, Beard, Flaws, Burris and Legaard.
