Board of Aldermen of City of Riverside, Missouri
May 7, 2002
A regular meeting of the Board of Aldermen of the City of Riverside, Missouri was held in the City Hall of
Riverside, Missouri on May 7, 2002 at 7:30 p.m.
Those in attendance were Mayor Betty Burch, Aldermen Bums, Beard, Looker, Darata, Legaard,
and Flaws.
Also present were David Blackburn, City Administrator, Louise Rusick, City Clerk, John Jackson,
City Engineer, Steve Crystal, City Attorney, John McClelland and Matt Kitzi, City Attorneys office.
Minutes, March 19, 2002 Alderman Burris moved that the minutes of May 7, 2002 be
Approved approved, seconded by Alderman Darata, the vote was:
Aye: Aldermen Burris, Flaws, Darata, Beard and Looker.
Abstain: Alderman Legaard.
Motion carries.
Presentation by Visitor Jeremiah Finnegan, Conrad & Peterson, L.C. spoke to the board
updating them on the water rate case. There are five districts involved,
Warrensburg, Mexico, Brunswick, St. Joseph, Joplin and two new
districts, St. Louis Water Co and Jefferson City Water Co. He went on
to explain the 66% increase to Warrensburg which is an ongoing battle
and expressed the importance for Riverside residents to only pay for
Riverside water and not other municipalities water. Mr. Finnegan tries
to persuade the commission to only pay for Riverside water. The last
rate case in August 2001 was won. We are now awaiting the order from
the Commissioner of the Mo. Public Service Commission to see if it
changes its ruling with respect to a big increase, rate shock; this could
be tempered some, We are hoping to end this matter within this year.
Mr. Finnegan is asking for the city to contribute $7,500 and possibly up
to $10,000 for the county authority order, to the fund for the water rate
case. This matter will be discussed by the board and a decision made
soon.
Right-of-Way purchase Alderman Beard moved to approve right-of-way purchase contracts in
Contracts approved connection with the Gateway project for David/Judy Ramsey;
Merritt/Debbie Hilt for $1,566.00; Edward A. Moore, Jr., $1,481.00,
seconded by Alderman Flaws, the vote was:
Aye: Aldermen Burris, Flaws, Darata, Legaard, Beard and Looker.
Motion carries.
Municipal Court Alderman Flaws moved to approve the municipal court report for April,
Approved seconded by Alderman Beard, the vote was:
Aye: Aldermen Burris, Flaws, Darata, Legaard, Beard and Looker.
Motion carries.
Mayor's comments Bruce Culley, city auditor will be at the May 2181 board of aldermen
meeting.
Bill No. 2002-53 Alderman Beard moved to place Bill No. 2002-53 on its first reading,
Payment of Bills said Bill authorizing the payment of certain indebtedness listed therein,
seconded by Alderman Darata, the vote was:
Aye: Aldermen Flaws, Burris, Darata, Beard, Legaard and Looker.
Motion carries.
Ordinance No. 2002-53 Alderman Flaws moved to place Bill No. 2002-53 on its second reading
Approved and upon passage of same, become Ordinance No. 2002-53 seconded
by Alderman Beard, the vote was:
Aye: Aldermen Flaws, Darata, Beard, Legaard, Looker and Burns.
Motion carries.
Bill No. 2002-54 Alderman Beard moved to place Bill No. 2002-54 on its first reading,
Amending the city code said Bill amending the Riverside city code by adding Chapter 227
adding Chapt. 227 re: regarding code enforcement, seconded by Alderman Darata, the vote
code enforcement was:
Aye: Aldermen Burris, Flaws, Darata, Legaazd, Beazd and Looker.
Motion carries.
Ordinance No. 2002-54 Alderman Flaws moved to place Bill No. 2002-54 on its second reading
Approved and upon passage of same, become Ordinance No. 2002-54 seconded
by Alderman Beard, the vote was:
Aye: Aldermen Flaws, Darata, Beard, Legaard, Looker and Bums.
Motion carries.
Bill No. 2002-55 Alderman Beazd moved to place Bill No. 2002-55 on its first reading,
Amending the city code said Bill amending the Riverside city code by deleting and amending
by deleting & amending certain sections of Chapter 215 regarding nuisances, seconded by
Chapt. 215 regarding nuisances Alderman Burris, the vote was:
Aye: Aldermen Darata, Beard, Legaard, Looker, Bums and Flaws.
Motion carries.
Ordinance No. 2002-55 Alderman Darata moved to place Bill No. 2002-55 on its second reading
Approved and upon passage of same, become Ordinance No. 2002-55 seconded
by Alderman Legaard, the vote was:
Aye: Aldermen Flaws, Darata, Beard, Legaard, Looker and Bums.
Motion carries.

Bill No. 2002-56 Alderman Darata moved to place Bill No. 2002-56 on its first reading,
Amending the city code amending the Riverside City Code by deleting and amending certain
by deleting & amending certain sections of Chapter 225, Article II, regarding litter, seconded by
sections of Chapt. 225, Art. II Alderman Beard, the vote was:

Ordinance No. 2002-56 Alderman Flaws moved to place Bill No. 2002-56 on its second reading
Approved and upon passage of same, become Ordinance No. 2002-56 seconded
by Alderman Beazd, the vote was:
Aye: Aldermen Flaws, Darata, Beard, Legaazd, Looker and Bums.

Bill No. 2002-57 Alderman Beard moved to place Bill No. 2002-57 on its first reading,
Amending the city code by amending the Riverside city code by adding Chapter 490 regazding a
adding Chapt. 490 regarding a property maintenance code, seconded by Alderman Darata, the vote
property maintenance code was:
Aye: Aldermen Beard, Legaazd, Bums, Dazata and Flaws.
No: Alderman Looker
Motion carries.
Ordinance No. 2002-57 Alderman Flaws moved to place Bill No. 2002-57 on its second reading
Approved and upon passage of same, become Ordinance No. 2002-57 seconded
by Alderman Darata, the vote was:
Aye: Aldermen Flaws, Darata, Beard, Legaazd, and Bums.
No: Alderman Looker.

Bill No. 2002-58 Alderman Beard moved to place Bill No. 2002-58 on its first reading,
Ratifying the appointment of ratifying the appointment of certain persons as members of the
certain persons to the P&Z Planning and Zoning Commission and setting the terms thereof;
Comm the appointment of Ray Uhl and Shawn Lee to a four year first term,
expiring in May 2006, seconded by Alderman Flaws, the vote was:
Aye: Aldermen Legaard, Looker, Bums, Dazata, Flaws and Beard

Ordinance No. 2002-58 Alderman Beard moved to place Bill No. 2002-58 on its second reading
Approved and upon passage of same, become Ordinance No. 2002-58 econded by
Alderman Flaws, the vote was:
Aye: Aldermen Flaws, Darata, Beard, Legaard, Looker and Bums.

Bill No. 2002-59
Authorizing Shafar, Kline &
Warren to provide additional
Services under the April 16th
Contract
Alderman Flaws moved to place Bill No. 2002-59 on its first reading
said Bill authorizing Shafar, Kline & Warren, Inc. to provide the
following additional services under the contract dated April 16, 2002;
assist city staff in developing recommendations and standards for a
planned commercial overlay zoning district, seconded by Alderman
Darata, the vote was:
Aye: Aldermen Burris, Flaws, Darata, Legaard, Beard and Looker.
Motion carries.
Ordinance No. 2002-59 Alderman Darata moved to place Bill No. 2002-59 on its second reading
Approved and upon passage of same, become Ordinance No. 2002-59 seconded
by Alderman Legaard, the vote was:
Aye: Aldermen Flaws, Darata, Beard, Legaard, Looker and Bums.
Bill No. 2002-60
Amending Appendix A of
of Title IV of the Munici-
pal code of the city related
to financial services uses
Motion carries.
Alderman Flaws moved to place Bill No. 2002-60 on its first reading,
said Bill amending Appendix A of Title IV of the Municipal Code
of the City of Riverside, Missouri related to financial services uses,
seconded by Alderman Beard, the vote was:
Aye: Aldermen Flaws, Darata, Beard, Looker, Burns and Legaard.
Motion carries.
Ordinance No. 2002-60 Alderman Burris moved to place Bill No. 2002-60 on its second reading
Approved and upon passage of same, become Ordinance No. 2002-60 seconded
by Alderman Beard, the vote was:
Aye: Aldermen Flaws, Darata, Beard, Legaard, Looker and Bums.
Motion carries.
Recess A brief recess was called at 8:18 p.m.
Reconvene The Mayor and all Aldermen responded to roll call.
Mayor Burch's announcements There will be a neighborhood garage sale.
There may be hot-air balloon rides available at the Fall Festiaval.
Negotiations are going on with Kansas City, Mo regarding the sewer
rates.
There will be a board of aldermen meeting on May 18`", closed session,
from 9 a.m. to 3 p.m. at the Argosy Casino.
Alderman comments Alderman Looker attended the newly elected officials forum in Kansas
City, Mo and mentioned some items the city's board needs to follow.
John McClelland, City Attorney said some of what was mentioned
applies to Kansas only. Mayor Burch said we are following the rules.

The Economic Development Council sent Price Water House tickets
for distribution to the board members.
Motion for Closed Alderman Flaws moved that the meeting go into closed session,
Session pursuant to RSMo 610.021 (2) Real Estate with the City Attorney's
assistant, seconded by Alderman Beard, the vote was:
Aye: Aldermen Darata, Legaard, Beard, Flaws, Looker and Bums.
Motion carries.
Motion for Open Alderman Beard moved that the meeting go into open session,
Session seconded by Alderman Darata, the vote was:
Aye: Aldermen Legaard, Beard, Flaws, Looker, Darata and Bums.

Motion for Closed Mayor Burch moved that the meeting go into closed session,
Session pursuant to RSMo 610.021(1), Legal Issues, with the City Attorney's
assistant, seconded by Alderman Burns, the vote was:
Aye: Aldermen Darata, Legaard, Beard, Flaws, Looker and Bums.
Motion canies.
