Boazd of Aldermen of City of Riverside, Missouri
May 28, 2002
A special meeting of the Boazd of Aldermen of the City of Riverside, Missouri was held in the
City Hall of Riverside, Missouri on May 28, 2002 at 6:30 p.m.
Flaws.
Those in attendance were Mayor Betty Burch, Aldermen Bums, Beard, Looker, Darata, and
Alderman Legaard arrived at 6:35 p.m.
Also present were David Blackburn, City Administrator, Louise Rusick, City Clerk, John Jackson,
City Engineer and from the City Attorney's office, John McClelland.
Visitor Comments David Johnson, Maxus Properties spoke regarding their property on Argosy
Pazkway. Mr. Johnson presented a conceptual drawing to the boazd members
requesting consideration and input to develop a recreational vehicle park in the
area. He stated parking is being discussed with the Argosy officers and they
like the idea of a recreational vehicle park that would be by the railroad tracks.
Also, being considered is purchasing the property owned by Mr. Jamison.
In addition to an RV Park, anine-hole golf course, store alls, tennis court and a
miniature golf course is a conceptual idea.
Mayor Burch said the real estate matter would be discussed in closed session at
the June 4"' meeting.
Gate Woods Discussion Lillie Trimble on behalf of Gate Woods Development, L.L.C. explained the first
ideas for the property. She mentioned the land was purchased in 1978. Mrs.
Trimble presented the board with a packet of information in reference to the
Gate Woods Development project. Sandra Schmude assisted Mrs. Trimble with
the presentation. One of the first ideas was a bridge then the cost was
considered and a Planning and Zoning Commission member said [he bridge
would not be a good idea as there would not be dual access. In 1998 they started
working on the tracts. In the process they were told the zoning ordinance stated
they had to have lot lines and with that, the units would not fit on the lots.
Mrs. Trimble then showed the current proposal. She asked, "Are there any more
reports?" Mayor Burch said they had just received one from John Jackson, he
inspected the property today, and the board had not reviewed the report as yet.
She asked to discuss openly, with each member of board, their main issues
regarding the property.
Alderman Flaws said the information he had received in the last 2-3 weeks on
the drainage problem, problems that have been there, and not addressed. He
said the, "water problem" he has his own idea and is not mentioning.
Alderman Beard said there were two issues. He wanted to know if project had
to be being built according to plans when they were first approved and if the
covenants were written as such, until the properties are sold and if someone
would be doing upkeep on the common area.

Alderman Legaard asked if the Planned District was sold would the next owner
have to do a Planned District or could it be changed.
Alderman Darata said many things have been discussed and agree with them.
She said sees quality in the design of the homes and can't wait until building
starts.
Alderman Burris said he couldn't see where the Preliminary Plat agrees with the
Final Plat so he would like to know, "What is the real plat?" The creek is a big
issue. He doesn't think the Riverside people should have to pour money into the
development. He asked, "Who's going to take care of maintenance fees until
the lots aze sold?" He said 50'" Street is an issue. There is a major question
regarding the'/z shaze and easements.
Mrs. Trimble said the drainage and water feature was repealed. She stated 50'"
Street has some problems that have been there for over two years.
Mayor Burch said her issues were the same as the boazds. She said, "We can't
build a street for Gate Woods only"and she referred to a resident who requested
this in the past and the city denied the request. Mrs. Trimble said she wasn't
asking to do so. Mayor Burch asked if there was going to be any modular
homes. Mrs. Trimble said, "No."
Mrs. Trimble said they were open to changes and ready to move forward
Recess A brief recess was called at 7:15 p.m.
Reconvened The Mayor and all Aldermen responded to roll call at 7:33 p.m.
Mrs. Trimble's Greenfield Villages' covenants were mentioned. She obtained a copy
comments of theirs, and other subdivision's covenants. None of them had assessments.
The balance of the landscaping would be done by the developer and the rest
by the Homes Association. The developer maintains the common area. The
finished lots will be assessed and the developer maintains all azeas until the lots
are sold.
Comments The Homes Association usually exists for twenty years. After all the lots are
regarding the Homes sold, the Homes Association takes over. Officers are appointed and the
Association association is responsible for the dues and all other fees. This continues unless
stopped after the twenty years.
Mrs. Trimble's Mrs. Trimble said the assessments would be paid at fifty per cent.
comments The vacant area is the common area and there is no assessment.
The undeveloped area is non-assessable. There aze twenty-five lots that utilities
are not in and non-assessable. Once they aze platted and the lots saleable,
assessments will begin. After one lot is sold and it sits, Gate Woods
Development, L.L.C. takes care of the maintenance. Assessments are $50.00
per lot.
The 2"d phase plat is to be replatted. the balance of the land the east and will
become part of the Homes Association when it is recorded. The Home
Association will maintain unplatted land.

The homeowner will put $500.00 in a working capital fund for unforeseen
things that might come up. The owner is responsible for their own property
maintenance. The common area is the Homes Association responsibility when
the owner moves in. The annual maintenance fee is $100.00. Fifty-six homes
would be $5,600. Special Assessments can be done raise more funds for the
Homes Owners Association.
There aze seventy-three houses in the modified Planned District with 78 square
foot lots.
The excessive area of the common area is forty-three per cent. Basically half of
the common area is 32-33 per cent that meets the requirement of the Planned
District. The 30 % requirement maintained is the common area. The city
ordinance states a certain number of lots per acre.
Mrs. Trimble spoke about the water feature that started in January 2000. There
was an idea to put a weir in. In March, 2000 the engineer met with Robert
Combs and others. The Department of Natural Resources said a weir could not
be done. Kansas City, Mo sent a letter in February 2000 saying if the developer
wanted to reroute the sewer lines, they could do so. Dams have not been on the
plans for sometime. They aze now. There is a 4 to I slope that is a dangerous
slope and this was stated in the transcript. The Conservation Department
recommended a 3 to 1 slope. Mr. Trimble explained the slopes on all sides, inlet
and outlet structures.
Mr. Trimble said he agrees with the drainage easement on the northeast side and
Gate Woods is drafting the easement.
Mrs. Trimble said there is a trail laid out and not being asphalted yet. It will be
completed when the houses are finished.
Corrective work is to be done on the Swale, lots 39,42 and 43. Mr. Combs
addressed the northeast and southwest drainage problems.
Alderman Beazd Alderman Beazd said for the weirs, the city needs as built drawing. The 20"
overflow pipe needs to have inflow structure to keep the pipe from washing out.
As to the water feature, as built drawing on the slopes by the engineer would be
satisfactory.
The city needs amended Department of Natural Resources permit that shows
changes in the water feature.
Mr. Trimble said the Corps of Engineers authorized the original plans. The
Department of Natural Resources approved the water feature and Gate Woods
has the documentation along with the revised plan from Gate Woods engineer,
Mr. Robert Combs. The city wants the documentation. A letter is to be
presented to the Mayor and boazd from Combs Engineering.
Recess A brief recess was called at 8:50 p.m.
Reconvened The Mayor and all Aldermen responded to roll call at 9:03 p.m.

Mrs. Trimble started with Fiftieth Street discussion referring to Exhibit E in the
covenants and Shafer, Kline and Warren letters. Gate Woods Development sent
a letter on January 29s' on disagreements and never got any feedback. It has
been since 1999 working on the 50`h Street problem.
Gate Woods doesn't feel they owe 50% on the clearing and grubbing. Gate
woods will only go to the property line. They only want to pay 12 ''/z% of
clearing and grubbing. They feel they are not obligated for 50% on the stacked
stone wall.
Alderman Legaard asked, "What are you willing to pay?" Mrs. Trimble said
One-half of $95,000.
Mayor Burch's recommendations was for the board members to walk the line
and street and study the sheet on percentages. Gate Woods Development is to
return with all items asked for by the board. Gate Woods distributed proposed
copies of an ordinance.
If everything is in place, a special meeting can be held Monday, June 3rd at 7:00
p.m.
Audit for June 30, 2001 Alderman Burris moved to approve the audit for July 1, 2001 through June 30,
Approved 2002 by Bruce Culley, CPA, seconded by Alderman Beard, the vote was:
Aye: Aldermen Burris, Looker, Darata, Legaard, Beard and Flaws.
Motion carries.
Adjournment By unanimous decision, the meeting adjourned at 9:48 p.m.
