Minutes of Regular Meeting of
Board of Aldermen of City of Riverside, Missouri
July 2, 2002
A regulaz meeting of the Board of Aldermen of the City of Riverside, Missouri, was held in the
City Hall, of Riverside, Missouri, on July 2, 2002, at 7:30 p.m.
Those in attendance were Mayor Betty Burch, Aldermen Burris, Looker, Darata, Legaard, Beard
and Flaws.
Also present were David Blackburn, City Administrator, Kathleen L. Rose, Acting Secretary, John
Jackson, City Engineer and Matt Kitzi, City Attorney's office.
Minutes, June 18, 2002, Alderman Legaard moved that the minutes of June 18, 2002, be
Approved approved as corrected; seconded by Alderman Darata, the vote was:
Aye: Aldermen Burris, Looker, Darata, Legaard, Beard, and Flaws.
Motion carries.
Mayor Burch introduced Gary Creason, Project Engineer for Riverside
Quindazo Bend Levee District. Mr. Creason will office out of
Coleman Industrial Construction at 4030 IVW Vandepopuliere Road.
Motion to Open Aldermen Beazd moved that Public Hearing be opened for Gary Smith,
Public Hearing Full- Moon Homes, for building lot on Lakota Court; seconded by
Aldermen Burris, the vote was:
Aye: Aldermen Burris, Looker, Darata, Legaazd, Beard and Flaws.
Motion carries.
Gary Smith, Full-Moon Homes, 8134 NW Walnut Way, Parkville, Mo.
made presentation for Board consideration to construct a modular
home on Lot 12 of Indian Hills. Steve Warger, Engineer, and Bill
Quitmeier, Attorney, were also present. Smith submitted a drainage
study and color rendering of proposed 1764 s.f. raised-ranch structure,
3 bdrm., 2 bath, fmished basement, with 24' x 32' gazage. Smith stated
that he had received approval from Planning Commission on June 13,
2002. Smith stated he had determined subsequent to the Planning
Commission meeting to enhance the facade of the structure and to
include some stone material, extra gable, turn posts, and balusters.
Dennis Jones, 4501 NW Lakota Court, made a presentation on behalf
of the neighbors with regazd to the proposed structure. Jones stated that
the proposed structure would look odd compazed to other homes in the
area; he also stated that the placement of the structure on the lot would
be elevated above the other homes and this structure would ultimately
not enhance the property values of the surrounding homes.
Mike Fuller, 4423 NW Indian Lane, made presentation against this
proposed structure stating that the house did not fit the lot and he
believed that the other residents in the neighborhood were being taken
advantage of.
Alderman Beard inquired when and how much Jones and Smith had
paid for their homes, respectfully: Jones stated 1992-$115,000;
Smith stated 2001-$180,000.00
Mayor Burch had Acting Secretary, Kathleen Rose, read a letter
from Indian Hills' resident, Cy Houston; see attached.
Alderman Bums stated his concerns with the amount of concrete
and the possibility of a reduction in value if the structure did not
sell. Smith stated that the sale price would be $184,900.
Smith stated that a different company, Pinnacle out of North
Cazolina, would be used for this site, and not the company he used to
build the two houses on Osage. Smith indicated that Pinnacle has been
in business 6 to 7 yeazs.
Alderman Burns inquired about the difference between modulaz and
manufactured homes. Smith stated that a manufactured home such
as a mobile home was built to a HUD code standazd which was a
lower code standard than astick-built home. He stated a modulaz
home is manufactured in sections and transported to site for placement
and has 2 x 12 truss system. He stated neighbors would find this
type of construction less intrusive.
Alderman Burris inquired where the proposed structure fell
in respect to low, middle, or high end of the products Pinnacle sold...
Smith stated that this particular home was a basic floor plan for a high
end home that had been revised and expanded and was more like a
custom design; Aldermen Bums stated that his review of the Pinnacle
website indicated that the subject model was at the "low end".
Alderman Burris inquired if a front to back split style of home would
have been a better choice. Smith stated that would require 9' walls and
significant grading. He could lower the front door by using a 25' set
back as opposed to the required 35' building set back. City staff
indicated that such a modification to the set back would require a
variance from the Boazd of Zoning Adjustment.
Alderman Looker inquired about the berm on back and the grade, and if
water would pool on front steps. Smith stated that berm was designed
to drain into the city storm sewer system and that the grade was
approved by the city engineer, and the water would not pond on the
front steps.
Alderman Looker inquired how much of a difference would the
10' setback makes. City Engineer, John Jackson, stated that it would
drop the front of the house 4 to 5 feet.
Alderman Darata inquired why araised-ranch style of home was
chosen. Smith stated that this design would best fit the terrain of lot,
and that a 7.12 pitch on roof had a lower profile.
Alderman Dazata inquired about the possibility of using lazge stone
or interlocking wall in place of concrete. Smith stated that the project
had akeady gone beyond his original cost projections and that such
additions were cost prohibitive.
Alderman Legaard inquired if there were any other homes
manufactured by Pinnacle in Platte County or this azea and if Smith had
built any other homes other than the ones in Riverside. Smith stated
no.
Alderman Legaazd inquired if Smith lived in a modulaz home and if
he felt that this was the only model that would work on this lot. Smith
stated he did not live in a modular home and that for size and price
range this style would be best suited.
Alderman Beazd inquired if curb inlets and manhole A-5 and A-4 had
to be built. Steve Warger, Engineer, stated that those were already in
place.
Alderman Beazd inquired about storm water drainage. Wazger stated
that the drainage is in pipe to city storm sewer.
Alderman Beard inquired about the driveway slope and whether the
front yard slope was mow able. City Engineer, John Jackson, stated
that the driveway was a 13 or 14% slope. Smith stated that he was
familiar with steep grades and that it would be mow able.
Alderman Flaws inquired about the absence of windows on the sides
of the house and no indentations, relief or setbacks of rooms. Smith
stated the added ornamentation of shutters; one octagonal window and
the dropped roofline on the porch would enhance the looks of the
home. Smith stated he was taking a difficult lot and making the best of
it.
City Engineer, John Jackson stated that if the house was moved 10'
closer, it would lower the house 3'.
Mayor Burch inquired if lazge rocks would be a better solution to
staking the sod for the swell on the Jones' side of the home and
if the berm on the George side of the home would be aesthetically
attractive and provide an adequate job for the drainage. Steve Warger
stated either rock or sod would work but believed grass would be
better. He also indicated that the drainage would be fine and would
not flood.
Mayor Burch told the Boazd that Mr. Smith had offered to sell
the property to the City.
Mayor Burch informed the Boazd that they have 90 days from
the date of the Planning Commission recommendation on
June 13, 2002, to make a final decision on this matter.
Closed Public Hearing Mayor Burch closed public hearing at 8:38 p.m.
An attendance list is attached hereto.
Smith inquired as to why a final decision was being tabled.
Mayor Burch stated that the additional time would allow for
other options such as appraisals. Mayor Burch stated that
this matter would be tabled to August 6, 2002.
Attorney Quitmeier related to the Board that Mr. Smith had
complied with all zoning and building codes and that the
City's codes allowed for this type of home to be built. Quitmeier
stated that it appeared that the City was making Mr. Smith
"jump through hoops" to obtain this permit.
City Attorney, Matt Kitzi, stated that to table this decision for
30 days was appropriate and that the code allowed under
435.040 C (3f) the Board to consider whether a pernvt adversely affects
or reduces property values and under 435.040 C (3d) to determine
that the public, health, safety and welfaze shall be protected.
Motion to Table Alderman Beazd made a motion to table until 8/6/02; seconded by
Alderman Burris, the vote was:

Motion to Break Alderman Darata made a motion to take a 15-minute break; seconded
by Alderman Legaazd, the vote was:

Call to Order Mayor Burch called meeting to order at 9:00 p.m.
Special Use Permit Bryan Ruoff, Warman Design, 1828 Swift, North Kansas City, Mo.
Master Tech and presented applications for Special Use Permit for Dave Ramsey,
Ramsey Motors Ramsey Motors and J.R. Hilt, Master Tech to operate an auto
4357 NW Gateway. sales lot and auto repair service at 4357 NW Gateway, Riverside, Mo.
Mr. Ruoff stated that these two businesses were being relocated due to
construction of the levee and that the Planning Commission had
recommended approval of these permits pursuant to two applications
and two fees being submitted. They also were going before the Board
of Zoning Adjustment for cone-foot variance.
Mayor Burch inquired if this permit needed to be approved
before or after any building plans would be submitted. Mr. Ruoff stated
that his clients were trying to avoid unnecessary costs and needed this
approval before they moved on to the next step. City Attorney
Matt Kitzi stated that there was no particulaz order necessary because
they would not be able to use the Special Use permit until they got
their building permit, etc.
Alderman Beazd inquired that at this time they were just asking for
Special Use Permit to move across the street. Mr. Ruoff stated, yes.
Motion to Approve Alderman Beazd made a motion to approve the Special Use Pemrit for
Special Use Permit Ramsey Motors for automobile sales at 4357 NW Gateway,
Ramsey Motors Riverside ,Mo., seconded by Alderman Looker; and the vote was:
Aye: Alderman Burris, Looker, Darata, Legaard, Beazd and Flaws.
Motion carries.
Motion to Approve Alderman Burris made a motion to approve the Special Use Permit
Special use Permit for Master Tech Automotive for automobile repair at 4357
Master Tech Automotive NW Gateway, Riverside, Mo., seconded by Alderman Looker, and the
vote was:
Aye: Alderman Bums, Looker, Dazata, Legaazd, Beard and Flaws.
Motion Carries.
City Administrator City Administrator, David Blackburn reported to the Board that the
Comments change in the lager's benefit to the city employees would have
a 45-day waiting period.
Motion to Approve Alderman Burris made a motion to approve posting the notice of
Posting Notice of Change change to the Employees Lager's Benefit plan; seconded by Alderman
to Lager's Benefit plan Dazata; and the vote was:
Aye: Aderman Bums, Looker, Darata, Legaard, Beazd and Flaws.
Motion Carries.
City Engineer City Engineer, John Jackson, reported to the Board that there
Comments is a problem with the construction on 50`s Street. The contractor,
SOs' Street Banderas, is unable to find a solid bottom on a portion of the Street.
Terracon has been called in and recommended a geogrid mat
system of multiple layers to correct the problem There will be
a change order request in the amount of $25,255.00.
Alderman Beazd inquired if this job was bid as an unclassified
excavation and Jackson stated yes. Aldenvan Beazd inquired
whether an undercut 4' and placing 6" of shot rock would be
a good alternative. Jackson stated that he didn't believe that
would work. The ground is muck and the job is currently shut
down.
Motion to Approve Alderman Flaws recommended approval of the change order
501h Street in the amount of $25,255.00; seconded by Alderman Bums, and
Change Order the vote was:
Aye: Alderman Burris, Looker, Darata, Legaazd, Beard and Flaws.
Motion Carries.
Bond for Pernut City Engineer, John Jackson, reported that ESI had made application
to Haul on City for permit to haul on city streets. They will be hauling up to one
Streets million cubic yards of dirt for the levee project. Jackson stated
he had contacted other cities to deternvne if they required bonds,
however, he would recommend a minimum $100,000 bond.
Alderman Beard inquired what the haul route would be. Jackson
stated off Northwood Road, over 9 Highway and down Mattox.
Alderman Beard inquired what was determined from Missouri
State Highway and Jackson stated MoDot had not been contacted.
Mayor Burch stated that we needed more time to investigate what
the Parkville Special Road District and MoDot required and this
matter would be taken up at the next meeting.
Motion to Approve Mayor Burch reported that the Riverside Chamber of Commerce had
Chamber of Commerce submitted application for a liquor license for the Riverfest for
Liquor License Friday and Saturday, September 20'" & 21", 2002. Public Safety
Director, Wylie Simpson, stated he had signed off on said application.
Alderman Flaws made a motion to recommend approval of the
Riverside Area Chamber of Commerce Liquor License; seconded by
alderman Beazd; and the vote was:
Aye: Alderman Burris, Looker, Dazata, Legaard, Beazd and Flaws.
Motion Carries.
Duector of Public Duector of Public Safety, Wylie Simpson, thanked the Mayor and
Safety Comments Boatd of Aldermen for the recent change in benefits for the employees.
Duector of Public Safety, Wylie Simpson, requested approval to
purchase two 2003 Ford Crown Vic police interceptor vehicles in
the amount of $20,656.36. He reported that two vehicles currently
in the fleet would be sold and the proceeds from the sale would
be spent to equip the two new vehicles.
Motion to Approve Alderman Flaws made a motion to approve the purchase of two
2 Police Vehicles 2003 Crown Vic police interceptor vehicles for the purchase
price of $20,656.36; seconded by Bums, and the vote was:
Aye: Alderman Burns, Looker, Dazata, Legaard, Beard and Flaws.
Motion Carries.
Duector of Public Safety, Wylie Simpson, reported that he had
received a letter from Cousin's Fireworks, aka, Dishonest Don's,
requesting permission to perform a Class B shoot on Saturday
July 6, 2002, across from the Homestead Road Pazk. Simpson
stated he would consider their request after obtaining a clearance
letter from the Riverside Baptist Church officials.
Bill No. 2002-74 Alderman Burris moved to place Bill No. 2002-74 on its first
Payment of Bills reading, said Bill authorizing the payment of certain indebtedness
listed therein, seconded by Alderman Flaws; and the vote was:
Aye: Alderman Burris, Looker, Dazata, Legaazd, Beazd and Flaws.
Motion Carries.
Ordinance No. 2002-74 Alderman Flaws moved to place Bill No. 2002-74 on its second
Approved reading and upon passage of same, become Ordinance No. 2002-74;
seconded by Alderman Burris, and the vote was:
Aye: Alderman Burns, Looker, Darata, Legaard, Beard and Flaws.
Motion carries.
Bill No. 2002-75 Alderman Darata moved to appoint Kathy Rose, Ward III, a member
Pazk Boazd Appointment of the Park Board for a four year term, seconded by Beard; and the
vote was:
Aye: Alderman Burris, Looker, Dazata, Legaazd, Beard and Flaws.
Motion Carnes.
Ordinance No. 2002-75 Alderman Bums moved to Place Bill No. 2002-75 on its second
Approved reading and upon passage of same become Ordinance No. 2002-75;
seconded by Alderman Beazd, and the vote was:

Motion Carries.
Bill No. 2002-76 Alderman Beazd moved to authorize the employment of Christopher
Employ Christopher Green Green as a part time employee at the Riverside Community Center;
seconded by alderman Flaws, and the vote was:
Aye: Alderman Bun•is, Looker, Dazata, Legaard, Beard and Flaws.
Motion Carries.
Ordinance No. 2002-76 Alderman Flaws moved to place Bill No. 2002-76 on its second reading
Approved and upon passage of same become Ordinance No. 2002-76; seconded
by Alderman Legaazd, and the vote was:

Bill No. 2002-77 Alderman Beazd moved to authorize the employment of Simpson
Employ Simpson Razdin Razdin as a part time employee to perform custodiaUmaintenance
duties; seconded by Alderman Flaws, and the vote was:
Aye: Alderman Burns, Looker, Dazata, Legaazd, Beard and Flaws.
Motion Carries.
Ordinance No. 2002-77 Alderman Flaws moved to place Bill No. 2002-77 on its second reading
Approved and upon passage of same become Ordinance No. 2002-77; seconded

Alderman Alderman Legaazd inquired about the lazge item pickup arranged
Comments with Deffenbaugh Disposal and whether we could secure a
definite day of the month and time so that residents would know
Those large items could be disposed of at that time. City Administrator,
David Blackburn, stated he would look into the matter.
Alderman Legaard reported that she had attended the Pazk Boazd
meeting held on July 1, 2002.
Alderman Looker inquired whether the mosquito problem atRenner-
Brenner pazk had been dealt with. City Administrator, David
Blackburn stated he had forgotten about it and would check into it.
Alderman Burris inquired if there was anything we could do about
the weeds and the condition of the building at Skyline Inn.
Alderman Flaws inquired about the exposed black pipe outside
the front door of City Hall and when it would be buried. City
Engineer, John Jackson, stated that they were waiting for the
dirt to settle but would have the Public Works get started on it.
Alderman Darata inquired about the weeds and general outside
maintenance at the Post Office. Mayor Burch asked the City
Administtator to write a letter addressing these issues.
Motion for Closed Alderman Beard moved that the meeting go into closed session,
Session pursuant to 610.021(2) Real estate and 610.021(3) Personnel
Issues with the City Attorney; seconded by Alderman Bums,
and the vote was:
Aye: Alderman Burris, Looker, Darata, Legaazd, Beard and Flaws.

Levee Design Study of $25,000 to the Corp of Engineers to complete a design study for
West Platte Road relocation of the levee gate on West Platte Road; seconded by
Alderman Burris; and the vote was:

Dear Board:
I am writing concerning the July 2, 2002 Alderman meeting. I catmot attend this meeting
due to work commitments and therefore offer this letter in my absence. It has come to
my attention that Full Moon Homes will be appearing before the Boazd requesting a
building permit to place a prefabricated home on the vacant lot on Lakota Court, in
Indian Hills Estates. I have reviewed the proposed plan and have several concerns about
it.
The proposed plan does not fit the character and cotrtext of the other houses in the
subdivision. As you are aware, the houses in Indian Hills Estates were built under
covenant guidelines that created a subdivision where the house styles were selected so
that they would blend in with the natural terrain of the land and respect the "woodsy"
landscape of the azea. Several floor plans (front-to-back split, ranch, two-story, split
entry, side-to-side split, reverse 1 %z story, reverse 2 story, etc.) were utilized so that the
houses fit naturally, no matter how the lot sloped. The houses also have character traits
such as multiple rooflines, facade features that create multiple lines of relief, and brick
and/or stone enhancements on the froirts. In addition, the houses have features such as
shutters and decorative trim elements that give the houses character and make them
architecturally interesting. The proposed plan is very "box like" with minimal attempt to
provide multiple roof lines, ~ minimal attempt to provide fagade relief, and no attempt
to incorporate brick, stone, or trim features that add character and architectural interest.
The plan's features clearly do not respect all of the other houses in the subdivision,
Due to the terrain of the subdivision, some of the houses required retaining walls. In all
cases, natural rock was utilized as a means of blending the house into the terrain of the lot
and allowing the subdivision to blend into the heavily wooded and hilly character of tbe
subdivision. The proposed plan is a raised ranch. Placing a raised ranch on the subject
lot (the lot slopes significantly uphill from the street to the back of the lot) creates the
need for significant retaining walls on the front of the house. The retaining walls are a
very visual feature of the front of the house and the proposed use of poured concrete does
not fit the nature and character of the other houses in the subdivision. Quite fi~ankly, the
proposed plan looks h7ce a box sitting on top of a hill, rather than a house that is
appropriately integrated into the terrain of the lot.
The proposed boxy raised ranch plan with retaining walls along the driveway and front
stairs is a plan that appears to be 1950's in style. The oldest houses in Indian Hills
Estates are approximately 11 years old and incorporate exterior features (multiple roof
lines, fagade relies; and mixture of modern materials) that reflect modern residential
architecture. I recently researched houses in southern Platte County that have sold in the
$175,000 - $185,000 range within approximately the last year. I did not find any boxy

raised ranch plans trimmed out with significant concrete retaining walls. I also found that
the list of sold houses typically have the architectural features/character traits mentioned
above. I think it would be prudent for the proposed plan to reflect what would sell in the
current marketplace. If the house does not sell, it will either sit for a long time or the
price will have to be significantly reduced below the value of the other houses in the
subdivision. In either case, both situations will more than likely hurt the value of the
other houses in the subdivision,
In summary, I think the features of the proposed plan do not fit in with the character of
the other houses in Indian Bills Estates or the character of the City of Riverside. The city
has completed construction of the new city hall, community center, and reconstruction of
most city streets, curbs, and sidewalks. Many of the street projects required construction
of retaining walls. The city incorporated natural rock retaining walls. This creates a
much nicer look that is consisten with the idea of building to an architectural character
within the context of heavily wooded and hilly terrain. Similarly, the proposed lot is the
focal point as you turn onto I.akota Court. I would hate to look down Lakota Court and
see a house that is truly out of character with the rest of the subdivision. The proposed
plan appears to be a poor fit for this lot. I would think that there are other styles that
would fit the terrain of the lot much better. No matter what style of house is built, it
should be consistent with the character of the rest of the subdivision. Allowing a house
to be built that will not compliment Indian Hills Estates and the City of Riverside is an
insult to every homcew~r who has akeady made their investment based on the other
houses in the subdivision. Please do not let an ill-conceived plan disrupt the quality and
ambiance of a nice subdivision.
