Boazd of Aldermen of City of Riverside, Missouri
August 20, 2002
A regular meeting of the Boazd of Aldermen of the City of Riverside, Missouri, was held in the
City Hall, of Riverside, Missouri, on August 20, 2002, at 7:30 p.m.
Those in attendance were Mayor Betty Burch, Aldermen Butris, Looker, Dazata, Legaazd, Beazd
and Flaws.
Also present were David Blackburn, City Administrator, Louise Rusick, City Clerk, John Jackson,
City Engineer, Chief Wylie Simpson and Matt Kitzi, City Attorney's office.
Minutes, August 6, 2002, Alderman Legaard moved that the minutes of August 6, 2002, be
Approved approved, seconded by Alderman Beard, the vote was:
Aye: Aldermen Bums, Flaws, Darata, Legaard, Beard and Looker.
Motion carries.
Public Hearing Opened Mayor Burch opened the Public Hearing for consideration to amend
at 7:33 p.m. Chapter 440, Article II of the Riverside City Code by adding Section
440.117 regarding use of modular units as temporary building for
commercial or industrial use and requiring a special use permit for the
same.
Public Hearing Closed As there were no comments or discussion, the hearing was closed.
at 7:35 p.m.
City Engineer comments Discussion regarding the Missouri American Water turnkey contract
for water main extension tabled until a further date.
Discussion for Banderas Construction Company's cost for the W. SOs'
Street extension will be discussed at a later date as John Jackson will
see about re-negotiating with the contractor.
Jim Trimble, representing Jim Trimble spoke regarding SOm Street. Mr. Trimble thinks Banderas
Gate Woods Development Construction Company's cost for the W. 50"' Street extension is too
high. He said this is half again as much for the shorter piece of the
road.
Jim said one-half of the first phase cost is $58,500.
He said Gate Woods is willing to donate additional ground, and if Gate
Woods does this, they want credit for their half of the easements and if
the city would be willing to vacate the property from the cul de sac to I-
635.
The discussion also was on Gate Woods and Gary Lily sharing
easements. Additional discussion regazding the 50"` Street extension
would be moved over to the Gate Woods property and give Gary Lily
four (4) driveway cuts plus one (1) additional one at the end and shaze
the cost.
Alderman Beard asked if Gate Woods would be willing to give the city
credit for its vacation of a certain road, such credit to be applied against
the Gate Woods credit for dedication of the right-of-way. (The right of
way from the cul de sac to I-635) 11,980 sq. ft, one-half to Gate Woods
and one-half to Gary Lily).
He also asked if the appraisal price on the property is as it exists
now or developed property. Mr. Trimble said, "On the property as it
exists now."
Gary said the street is a public road and is caving in and he has owned
the property for fifteen years.
Attorney, Matt Kitzi suggested this all be drawn up on paper and
discussed.
Chief Simpson's comment Chief Simpson recommended hiring Bethany D. Volkman as a full
time dispatcher.
Bethany D. Volkman Alderman Flaws moved to approve hiring Bethany D. Vollcman as a
hired as full time dispatcher full time dispatcher at $26,000 annually with full benefits with a one
Approved year work test period. She would start after completion of the required
physical on August 21, 2002, seconded by Alderman Beard, the vote
was:
Aldermen Legaazd, Flaws, Dazata, Beazd, Looker and Bums.
Motion carries.
Recess A brief recess was called at 8:25 p.m.
Reconvene The Mayor and all Aldermen responded to roll call at 8:31 p.m.
Visitor comments Evelyn Poe, 3002 NW Florence, Riverside, Mo mentioned the ,
overgrown trees in the retaining wall and the weeds need to be cut at
the back fence.
Larry Meyer with Public Works will investigate and obtain a cost and a
letter will be sent to the post office asking to take care of this matter.
Bill No. 2002-92 Alderman Flaws moved to place Bill No. 2002-92 on its first reading,
Payment of Bills said Bill authorizing the payment of certain indebtedness listed therein,
seconded by Alderman Beazd, the vote was:
Aye: Aldermen Looker, Flaws, Dazata, Legaard, Beard and Bums,
Motion carries.
Ordinance No. 2002-92 Alderman Bums moved to place Bill No. 2002-92 on its second reading
Approved and upon passage of same, become Ordinance No. 2002-92 seconded
by Alderman Flaws, the vote was:

Bill No. 2002-93 Alderman Beard moved to place Bill No. 2002-93 on its first reading,
Amending Ord. 96-136 said Bill amending Ordinance No. 96-136 electing changes under the
electing changes under the Missouri Local Government Employee's Retirement System, to adopt a
Mo. Local Govern. Emp's. change in the contributions from covered employees, changing the
Retirement System requirement of no contributions from covered employees in accordance
with the provision of 70.705 and 70.730, RSMo 1994, as amended by
RSMo RSMo 1998 supplement, seconded by Alderman Flaws, the vote
was:

Ordinance No. 2002-93 Alderman Dazata moved to place Bill No. 2002-93 on its second reading

Alderman Dazata moved to place Bill No. 2002-94 on its first reading,
said Bill approving the issuance of not to exceed $1,350,000.00 tax
increment revenue bonds, series 2002 (L-385 levee project); pledging
in and assigning TIF revenues for the purpose of paying the principal of
and interest on the bonds; and approving related matters, seconded by
Alderman Beazd, the vote was:
Aldermen Dazata, Flaws, Looker, Legaazd, Beazd and Bums.

vote was:

Authorizing the execution
of a real estate purchase
agreement by the city of
Lot 12, Indian Hills Estates,
Full Moon Homes LLC
Alderman Dazata moved to place Bill No. 2002-98 on its first reading,
authorizing the execution of a real estate purchase agreement for the
purchase by the city of "All of Lot 12, Indian Hills Estates, a
subdivision in Riverside, Platte County, Missouri" (the "Property" from
Full Moon Homes LLC)" for no more than $27,000, seconded by
Alderman Flaws, the vote was:

Aye: Aldermen Flaws, Looker and Darata.
No: Aldermen Burris, Legaard and Beard.
The vote being a 3-3 tie, the Mayor broke the tie, voting, Aye.
Motion carries.
Ordinance No. 2002-98 Alderman Darata moved to place Bill No. 2002-98 on its second
Approved reading and upon passage of same, become Ordinance No. 2002-98,
seconded by Alderman Flaws, the vote was:
Aye: Aldermen Flaws, Looker and Darata.
No: Aldermen Burris, Legaard and Beazd.
The vote being a 3-3 tie, the Mayor broke the tie, voting, Aye.
Motion carries.
Alderman Bums' comment Alderman Bums said he thought the city is setting a precedence by
approving this agreement by abdicating the power that was given to the
board by the people who elected them to do the best job they can to put
the assets of the city to proper use.
Bill No. 2002-99 Alderman Beard moved to place bill No. 2002-99 on its first reading,
Approving and authorizing said Bill approving and authorizing the City of Riverside to obtain
the city to obtain planning planning services by Shafer, Kline & Warren, Inc. to perform monthly
services by Shafer, Kline & on-call planning services for the City pursuant to specific proposed
Warren to perform monthly scope of services commencing on August 15'" and continuing until
on-call planning services December 31, 2002, seconded by Alderman Darata, the vote was:
Aye: Aldermen Looker, Flaws, Darata, Legaazd, Beard and Bums.
Motion carries.
Ordinance no. 2002-99 Alderman Darata moved to place Bill No. 2002-99 on its second
Approved reading and upon passage of same, become Ordinance No. 2002-99,
seconded by Aldermen Burris, the vote was:
Aye: Aldermen Looker, Flaws, Dazata, Legaard, Beard and Bums.
Motion carries.
Aldermen's comments Alderman Bums asked what the black barrels were doing at the old
Sinclair station. Alderman Beard said this is round two (2) of the EPA
test.
Alderman Looker mentioned the city spraying for mosquitoes Sunday
evening. She suggested spraying later in the evening.
Motion for Closed Session Alderman Flaws moved that the meeting go into closed session at
8:55 p.m. pursuant to RSMo 610.02 (2) Real Estate with the City
Attorney, seconded by Alderman Burns, the vote was:
Aye: Aldermen Beard, Darata, Burns, Flaws, Looker and Legaard.
Motion carves.
Motion for Open Session Alderman Beard moved that the meeting go into open session,
seconded by Alderman Burris, the vote was:
Aye: Aldermen Darata, Burris, Beard, Looker, Legaard and Flaws.
Motion carries.
Mayor Burch's comment Mayor Burch said the Kessinger-Hunter proposal would be read and
discussed at the meeting next week.
Adjournment By unanimous decision, the board adjourned 9:19 p.
