HomeMy WebLinkAbout2009-036 - Wastewater CollectionBILL N0.2009-36 ORDINANCE N0.2009-36 AN ORDINANCE AUTHORIZING THE CITY OF RIVERSIDE, MISSOURI TO ENTER INTO AN AMENDED COOPERATIVE AGREEMENT WITH THE CITY OF KANSAS CITY, MISSOURI FOR OPERATION OF A WASTEWATER COLLECTION SYSTEM WHEREAS, the City of Riverside, Missouri ("City") and the City of Kansas City, Missouri ("KCMG") are parties to a Cooperative Agreement dated February 17, 1998, (the "Agreement") pursuant to which the City transferred ownership of all sanitary sewer lines within the City on the date of the Agreement to KCMG; and KCMG agreed to provide ongoing maintenance of the sewer system and treatment of wastewater, along with establishing the rates to be chazged by KCMO to the users of the system in the City; and WHEREAS, the Agreement was amended effective June 1, 2002, to adjust the rates charged to the users of the system; and WHEREAS, the Agreement, as amended, has expired and a further extension is in the best interests of the City and its residents; and WHEREAS, under the provisions of Section 250.010 RSMo., the City is authorized to provide funds for the cost of operation of a sewerage system. NOW, THEREFORE, be it ordained by the Board of Aldermen of the City of Riverside, Missouri, as follows: Section 1. The Board of Aldermen fmds that the residents of the City have experienced substantial increases in water rates chazged by Missouri-American Water Company in the last two yeazs, as well as increases in other utility rates. The Board of Aldermen further fmds that the economy is experiencing a severe economic downturn, including loss of jobs, and reduction in home values, and anticipated increases in sewer rates would pose a further economic hardship on the residents of the City. Section 2. The City is hereby authorized to enter into an extension of the Agreement with KCMG, under which the Monthly Service Charge and Volume Charge for residential service presently billed to each user shall be eliminated for a period of two yeazs from the effective date of the extension, and the cost of the service shall be paid by the City directly to KCMG. For the purposes of this Ordinance, "residential service" means sewer service at a location receiving water service at the residential water rate under Missouri-American Water Company tariffs and schedules. Section 3. The Mayor, City Administrator, City Attorney and other City staff are hereby authorized and directed to take all action necessary to implement the terms of this Ordinance. Section 4.
