HomeMy WebLinkAbout2002-09-03Minutes of Regular Meeting of Board of Aldermen of City of Riverside, Missouri September 3, 2002 A regular meeting of the Boazd of Aldermen of the City of Riverside, Missouri, was held in the City Hall, of Riverside, Missouri, on September 3, 2002, at 7:00 p.m. Those in attendance were Mayor Betty Burch, Aldermen Burris, Looker, Darata, Legaard, Beazd and Flaws. Also present were David Blackburn, City Administrator, Louise Rusick, City Clerk, John Jackson, City Engineer and Matt Kitzi, City Attorney's office. Motion for Closed Alderman Looker moved that the meeting go into closed session, Session pursuant to 610.021(2) Real estate and 610.021(3) Personnel Issues with the City Attorney; seconded by Alderman Burris, and the vote was: Aye: Alderman Beazd, Darata, Burris, Flaws, Looker and Legaard. Motion Carries. Motion for Open Alderman Flaws moved that the meeting go into open session, Session seconded by Alderman Legaard, and the vote was: Aye: Alderman Burris, Looker, Daza[a, Legaard, Beazd and Flaws. Motion Carries. Public Hearing Opened Mayor Burch opened the Public Hearing concerning the amendment of Article II, Section 440.115(B) of the Riverside City code regarding special use permit regulations and requirements applicable to adult entertainment businesses. As there were no public comments, Mayor Burch closed the pubic hearing at 7:36 p.m. David presented the board and Mayor with a map illustrating the area of the Adult and Entertainment district. Public Hearing Opened Mayor Burch opened the Public Hearing to consider amending Section 410.088 the Civic and Professional Office District by reducing (f) 2. Setbacks, (b)Side yard on each side of building not less than 10 feet from the side lot line(c) Rear yazd-the depth of the reaz yazd shall be at least 10 feet from the rear lot line. Michael Duffy, Shafer, Kline and Warren, Inc. explained his report to the board that he had previously given to the Planning Commission regarding building setback. Public Hearing Closed Mayor Burch closed the Public Hearing at 7:50 p.m. Impact Fees Discussed A short discussion was held regarding impact Fees to partially recover costs of increased impact on city streets. Mike Duffy said this would require a study. Matt said this would require a public hearing and would be assessable only upon the development of property (building permits), which increases traffic. Bill No. 2002-105 Alderman Flaws moved to place Bill No. 2002-105 on its first reading, Pay Bills aid Bill authorizing the payment of certain indebtedness listed therein, seconded by Alderman Beard and the vote was: Aye: Aldermen Looker, Flaws Darata, Legaard, Beard and Burris. Motion carries. Ordinance No. 2002-105 Alderman Burris moved to place Bill No. 2002-105 on its second reading Approved and upon passage of same, become Ordinance No. 2002-105 seconded by Alderman Beard and the vote was: Aye: Aldermen Darata Legaard, Beard, Looker, Burns and Flaws. Motion carries. Bi112002-106 Alderman Beard moved to place Bill No. 2002-106 on its first reading, Amending Art. II, Sect. 440.115 amending Article II, Section 440.115(B) of the Riverside City code (B) of the city code re: special regarding the special use permit regulations and requirements use permit regulations & re- applicable to adult entertainment businesses, seconded by Alderman quirements applicable to Adult Flaws and the vote was: Entertainment businesses Aye: Alderman Legaard, Beard, Burris, Flaws and Darata. Motion carries. Ordinance No. 2002-106 Alderman Flaws moved to place Bill No. 2002-106 on its second reading Approved and upon passage of same, become Ordinance No. 2002-106 seconded by Alderman Looker and the vote was: Aye: Aldermen Burris, Looker, Beard, Flaws, Darata and Legaard. Motion carries. Bill No. 2002-107 Alderman Darata moved to place Bill no. 2002-107 on its first reading, Amend. Sect. 410.088 the CPO said Bill amending Section 410.088 the Civic and Professional Dist. by reducing (f) 2. Ordinance No. 2002-107 Alderman Beard moved to place Bill No. 2002-107 on its second reading Approved and upon passage of same, become Ordinance No. 2002-107 seconded by Alderman Burris and the vote was: Aye: Aldermen Flaws, Darata, Legaard, Beard, Looker and Burns. Bill no. 2002-108 Placing a 90 day moratorium acceptance of applications for and issuance of bldg. permits and grading permits for use in certain districts zoned "GP" in the city Motion carries. Alderman Beazd moved to place Bill No. 2002-108 on its first reading, said Bill placing a ninety day moratorium on the acceptance of on the applications for and the issuance of building permits and grading the permits for use in certain districts zoned "GP" within the City of Riverside, seconded by Alderman Legaard and the vote was: Aye: Aldermen Looker, Flaws, Dazata, Legaard, Beazd and Burris. Motion carries. Ordinance No. 2002-108 Alderman Flaws moved to place Bill No. 2002-108 on its second reading Approved and upon passage of same, become Ordinance No. 2002-108 seconded by Alderman Darata the vote was: Aye: Aldermen Beard, Looker, Burris, Legaard, Darata and Flaws. Motion carries. Bill No. 2002-109 Alderman Legaard moved to place Bill No. 2020-109 on its first Authorizing the Mayor to reading, said Bill authorizing the Mayor to execute a contract with execute a contact with Hoefer, Wysocki Architects to provide architectural services for Hoefer, Wysocki Architects the construction of a new Public Safety Facility, seconded by Alderman to provide services for Bums and the vote was: constructing a new P.S. Ordinance No. 2002-109 Alderman Beard moved to place Bill No. 2002-109 on its second reading Approved and upon passage of same, become Ordinance No. 2002-109 seconded by Alderman Legaard and the vote was: Aye: Aldermen Burris, Looker, Beard, Flaws, Darata and Legaard. Motion carries. Change of Use Permit Alderman Flaws moved to approve a Change of Use Permit for Steve for Steve Withers, Withers, Steve's Heating and Cooling, 4252 NW Riverside St, Steve's Heating & Cooling, seconded by Alderman Beard and the vote was: Approved Aye: Aldermen Burris, Flaws, Darata, Legaard, Beard and Looker. Motion carries. Building Permit Alderman Beard moved to approve a Building Permit for Dennis Dennis Tschihart Tschihart, Pride Cleaners, 1843 NW Vivion Road, seconded by Pride Cleaners Alderman Legaard and the vote was: Approved Aye: Aldermen Flaws, Burns, Darata, Legaard, Beard and Looker. Motion carries. Mike Flowers, Aylett Mike Flowers, Aylett Survey Co, 201 NW 72"d St, Gladstone, Mo Survey gave the board spoke to the board regarding a proposed new car wash at 2806 a summary of a proposed NW Vivion Road mentioning some issues. The storm sewer new car wash is a minor one to be worked on. When improvements to NW Vivion Road are initiated, the applicant will provide one relocated entrance centrally located and close the two existing entrances. If any cars backed up on Vivion Road on Saturday, for example, the eastern most entrance would be blocked. It is recommended the landscaping be deferred until the proposed street improvements are completed or within three (3) years of the building permit, whichever is first. The details and color schemes were explained and are all in compliance with the CPO regulations. Examples of the stone and colors were shown. The existing fence will be moved back some. As to the grease interceptor, there is no requirement. Check clean out. Special Use Permit Alderman Looker moved to approve a Special Use Permit for J.P. J.P. Filger, Filger Oil Co. Motion carries. Building Permit Alderman Flaws moved to approve a Building Permit for James for James Upschulte, Upschulte Enterprise, Inc. (Mean Genes Pizza & Deli, Mean Gene's Pizza & Deli, 4603 NW Gateway, seconded by Alderman Beard and the vote was: Approved Aye: Aldermen Burris, Flaws, Darata, Legaard, Beard and Looker. Motion carries. .. s Right-of-Way Purchase Alderman Looker moved to approve offer to purchase right-of purchase contracts way purchase contracts in connection with the Vivion Road and NW Approved Gateway project for Thomas and Connie Holloway in the amount of $15,461.00, N. Dean and Janice C. Lawrence, $7,606.00, Lesa Parson. $2,861.00 and Richard P. Enloe, $1,566.00, Request for Proposals Alderman Legaard moved to approve request for proposals for Approved Design and Finance for the I-635Nandepopulier Rd Highway Interchange in Riverside, Mo, seconded by Alderman Bums, the vote was: Aye: Aldermen Legaazd, Beazd, Looker, Darata, Flaws and Burris. Motion caries. Chief Simpson's comment Public Safety conducted the MDA boot collection at NW Gateway and NW Vivion Rd intersection and 2401 W. Platte Rd. Seven hundred fifty dollars was donated to Muscular Dystrophy, this being a great success and tribute to the motorists and residents. Aldermen comments Alderman Legaard thanked the officers for collecting for MDA. She mentioned how nice Officer Noll was. Alderman Bums said he had heard the carillon only once. Recess A brief recess was called at 8:30 p.m. Reconvene The Mayor and all Aldermen answered to roll call at 8:40 p.m. Motion for Closed Alderman Flaws moved that the meeting go into closed session, Session pursuant to 610.021(1) Legal Issues, 610.021(2) Real estate and 610.021(3) Personnel Issues with the City Attorney; seconded by Alderman Legaazd, and the vote was: Aye: Alderman Beard, Darata, Burris, Flaws, Looker and Legaard. Motion for Open Alderman Darata moved that the meeting go into open session, Session seconded by Alderman Legaazd, and the vote was: Aye: Alderman Dazata, Burris, Beard, Looker, Legaard and Flaws. Motion Carries. Mayor Burch read the letter Steve Crystal, City Attorney wrote to John Kessinger, Kesinger & Hunter. Adjournment By unanimous decision, the meeting adjourned at 9:5 .m. - i 5 City Clerk
