Board of Aldermen of City of Riverside, Missouri
November 19, 2002
A regulaz meeting of the Boazd of Aldem-en of the City of Riverside, Missouri, was held in the
City Hall, of Riverside, Missouri, on November 19, 2002 at 7:30 p.m.
Those in attendance were Mayor Betty Burch, Aldermen Burris, Looker, Darata, Beard and Flaws.
Absent, Alderman Legaard.
Also present were David Blackburn, City Administrator, Louise Rusick, City Clerk, John Jackson,
City Engineer, Steve Crystal, City Attorney and Matt ICitzi, City Attorney's office.
Minutes, October 29, 2002 Alderman Flaws moved that the minutes of October 29, 2002 be
Approved approved, seconded by Alderman Beazd, the vote was:
Aye: Aldermen Bums, Flaws, Dazata, Beard and Looker.
Absent: Alderman Legaard.
Motion carries.
Minutes, November 5, 2002 Alderman Beard moved that the minutes of November 5, 2002 be
Approved approved as corrected, seconded by Alderman Looker, the vote was:
Aye: Aldermen Bums, Flaws, Darata, Beazd and Looker.
Absent: Alderman Legaazd.
Motion carries.
Public Hearing Opened Mayor Burch opened the Public Hearing to consider a request for a
Special Use Permit to allow the sale of used vehicles at 4305 NW
Gateway.
No comments from the audience.
Public Hearing Closed Mayor Burch closed the Public Hearing at 7:30 p.m.
Alderman Legaard, present Aldenman Legaazd arrived at 7:33 p.m.
Used car lot discussion Michael Duffy, consultant for the city said the conditions
recommended by the Planning Commission for the used caz lot were to
defer landscaping or screening at the back. Cars are to be kept from
locating in the 15' buffer strip. A couple of large planters are needed in
the front.
There are two other businesses on the property, a detail shop and tow
lot that have claimed to have been there since 1977. A business license
has not been issued for the last year. An evaluation is being done and
letters will be sent to the property owner and tenant.
Special Use Permit for Alderman Looker moved to approve granting a Special Use Permit for
3-D Cars, 4305 NW Gateway 3-D Cars- Colin Campbell, property owner and Walt Wells, tenant at
Approved 4305 NW Gateway for the sale of used vehicles, seconded by
Alderman Legaazd, the vote was:
Aye: Aldermen Flaws, Dazata, Legaazd, Beazd, Looker and Bums.
Motion carries.
Bill Browning, Fairway, Kansas made a request to the board to approve
the building permit extension for Argosy.
John Jackson, City Engineer said the design package, with minor detail
exceptions, has been reviewed and approved by the city's code
consultant, George Butler Associates and is compliant recommending
the permit be issued. Work is going on in the basin and barge area and
the completion date is by the end of the year. December 2003 is the
building completion date.
Building Permit for Argosy Alderman Darata moved to approve the building permit for the Argosy
Expansion, Approved Casino expansion, seconded by Alderman Legaard, the vote was:
Aye: Aldermen Legaard, Beard, Looker, Burris, Darata and Flaws.
Motion carries.
Change of Use Permit Alderman Flaws moved to approve a Change of Use Permit for Eaton
for 4124 NW Riverside St. Investments, owner of the property and Chris Roberts, tenant and
Approved owner of Syntech Custom Contracting, 8029 N. Everton, Kansas City;
Mo. for the property at 4124 NW Riverside Street, seconded by
Alderman Looker, the vote was:
Aye: Aldermen Looker, Beard, Legaard, Burris, Flaws and Darata.
Motion carries.
Building Permit Discussion Mike Duffy said the footings and foundation plans for 5106 NW
Merrimac were up to code to stabilize the house. All code
requirements have been met.
John said the plans meet structural requirements. He had no design as
to how the water runs. John will investigate the grading for drainage.
Alderman Legaard asked if the drainage would go onto the neighbor's
property and Mr. Moss said, "No".
Alderman Beard asked if the building will be jacked up and then the
foundation walls poured. Mr. Moss said two contractors would do the
work.
Building Permit Alderman Beazd moved to approve issuing a building permit to replace
for 5106 NW Merrimac the failed foundation walls and footings for David Moss, owner at
Approved 5106 NW Merrimac, seconded by Alderman Burris, the vote was:
Aldermen Darata, Flaws, Bums, Legaard, Beazd and Looker.
Motion carries.
Building Permit comments John said he reviewed the building plans for 4357 NW Gateway and
they were satisfactory.
Brian Ruoff said the foundation was poured today. The building is to
be delivered December l lthe and the completion date is January 15s'.
Mike Duffy said a chain link fence would be placed azound the sides of
the building. Landscaping and fencing is required but defer ed for
three years or when the Gateway Redevelopment is finished. The
surface of the lot is shown to be 3" asphalt with a 4" base. In order to
be in compliance with our codes, it needs to be 3" asphalt with and 8"
base. Asphalt curbing is being installed in the back. Mike says
moving the cars could break up the curb and concrete curbing should
be considered. If asphalt is installed, observance should take place for
any maintenance. David Ramsey said concrete parking blocks were to
be placed in front of the asphalt curb.
Alderman Burris asked about the chain link fence aesthetics and
protection. He thought spray painting would have a more softening
look. Dave Ramsey said there is a green coated powdered fencing
being considered.
Trees will be planted as soon as possible.
Building Permit Alderman Beard moved to approve issuing a building permit for
for 4357 NW Gateway Mastertech/Ramsey Motors at 4357 NW Gateway, seconded by
Approved Alderman Flaws, the vote was:
Aye: Aldermen Burris, Legaazd, Flaws, Beard, Darata and Looker.
Motion carries.
City Engineer Comment John said Pazkville has hired Shafer, Kline and Warren to design and
contract for installation of a new force main along Route 9 from
Riverchase to the Burlington Pump Station. He asked if a pemut was
required. Mayor Burch said Kansas City will issue the permit since
they own the sewer lines in Riverside.
Kansas City Power & Light plans to install a secondary electrical feed
from a source near the intersection of Argosy Pkwy and the Burlington
RR crossing to the Argosy Casino as a backup service. Argosy
requested that if the service is necessary it should be underground.
Argosy said they would not pay extra for underground and talk to the
city. Mayor Burch said the city is not paying for an underground line.
City Administrator Comments Bruce Culley, Auditor for the city will be at the December 3'a meeting
with the audit report.
John Lutjen Assoc. The three bids received for surveying the Quindazo Bend Development
Approved to do surveying azea were:

Development Area John Lutjen $8,968.00-17 working days completion
Aylett Survey- not to exceed $12,000
Anderson Survey- $58,000, 60 -90 days completion
Alderman Looker moved to approve John Lutjen & Assoc. to perform
survey work for the Quindazo Bend Development Area
at accost of 8,968.00, seconded by Alderman Darata, the vote was:
Aye: Aldermen Bums, Flaws, Dazata, Legaazd and Beazd.
Abstain: Alderman Beazd.
Motion carries.
Recycling Presentation Kathy Rose, 4905 NW Hillside and Gloria Hickman, 3601 NW 50'~ St.
gave a presentation on recycling. Kathy illustrated to the boazd the
city's logo on the recycling tubs. The tubs are to be placed on the
opposite side of the driveway from the trash. Magazines, aluminum
and steel cans, milk jugs, plastic bottles with necks are all acceptable
items. There is a triangle with a 1 or 2 inside it on plastics meaning it
is recyclable. Newspapers are to be put in paper bags so they won't
blow away then put the bag on top of the recyclables in the tub. Glass is
not acceptable, nor is yazd waste.
There will be a container placed at the 3050 NW Vivion Road for
public use. Five tons a month would need to be placed in the bin to pay
for the cost of the tubs. This will be put in place the first week in
December. It will be emptied every other week. In March or April
Deffenbaugh will add more items to the collection.
Saturday morning Kathy and Gloria will be going street-to-street
educating the people on recycling and explaining the process.
Bill No. 2002-125 Alderman Flaws moved to place Bill No. 2002-125 on its first reading,
Pay Bills said Bill authorizing the payment of certain indebtedness listed therein,
seconded by Alderman Beazd and the vote was:
Aye: Aldermen Looker, Flaws Darata, Legaazd, Beazd and Bums.
Motion carries.
Ordinance No. 2002-125 Alderman Beard moved to place Bill No. 2002-125 on its second reading
Approved and upon passage of same, become Ordinance No. 2002-125 seconded by
Alderman Flaws and the vote was:
Aye: Aldermen Darata Legaard, Beazd, Looker, Burris and Flaws.
Motion carries.
Recess A brief recess was called at 8:36 p.m.
Reconvene The Mayor and all Board members answered to roll call.
Aldermen comments Alderman Burris said the lights are not lit at the River&ont Park.
John said the lights on the Bell Tower and ground lights all work
together. It was suggested the bulbs be loosened or removed.
Aldermen Legaazd asked if someone checks on building permits when
the building work is in progress and when the work is complete. John
said, "Yes, he does the check."
She asked about table and chairs for the pazk. David is checking with
the state. He will report on this at the next boazd meeting.
Alderman Burris asked if there were plans to resurface Cliffview Drive.
John said he's not had a chance to look at this yet.
It was stated when the new Public Safety Building is being built and as
the parking lot done, the matter will be taken up at that time.
Alderman Bums said there were twenty-seven Mayors, City
Administrators, Alderman and two Professors for the combined
grouping at the MML Leadership program. An array of information
was presented.
Mayor Burch said the music in the bell tower needs to be changed.
David reminded the board of the Economic Development Council Job
Awards Development luncheon at Argosy.
David asked the board about City Hall closing Friday, November 29m
and it was unanimously agreed to do so.
Electric underground cables Alderman Beard moved to approve burying the underground conduits
and other associated devices for electric lines at a future date on the
upper half of Gateway, seconded by Alderman Burris, the vote was:
Aye: Aldermen Legaard, Flaws, Darata, Beazd and Bums.
Abstain: Alderman Looker.
Motion carries.
Cooper, Robinson Architects Alderman Looker moved to approve Cooper, Robinson, Architects
for the first phase of the Master Plan for the Quindazo Bend
Development, seconded by Alderman Burris, the vote was:
Aye: Aldermen Looker, Bums, Darata, Legaazd, Beard and Flaws.
Motion carries.
Motion for Closed Alderman Beard moved that the meeting go into closed session,
Session pursuant to 610.021(1) Legal Issues, 610.021(2) Real estate and
610.021(3) Personnel Issues with the City Attorney; seconded by
Alderman Flaws, and the vote was:
Aye: Alderman Beazd, Datata, Burris, Flaws, Looker and Legaazd.
Motion Carries.
Motion for Open Alderman Darata moved that the meeting go into open session,
Session seconded by Alderman Legaard, and the vote was:
Aye: Alderman Dazata, Burris, Beard, Looker, Legaazd and Flaws.
Motion Carries.
