R-2022-006 A RESOLUTION APPROVING AND ENDORSING APPLICATION TO THE LAND AND WATER CONSERVATION FUND PROGRAM FOR FUNDING OF THE RIVERSIDE MUNICIPAL POOL AND SPLASHGROUND PROJECT BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF RIVERSIDE, MISSOURI AS FOLLOWS: THAT the Riverside Board of Aldermen hereby approves and endorses the application to the Land and Water Conservation Fund (LWCF) Program for funding for the construction of the Riverside Municipal Pool and Splashground Project: and FURTHER THAT the City of Riverside (City) currently has the written commitment for the minimum 50% matching share for the project elements that are identified in the application and will allocate the necessary funds to complete the project; and FURTHER THAT in the event a grant is awarded, the City will commit the necessary financial resources to operate and maintain the completed project in a safe and attractive manner for public access in perpetuity; and FURTHER THAT in the event a grant is awarded, the City is prepared to complete the project within the time period identified on the signed project agreement; and FURTHER THAT in the event a grant is awarded, the City will comply with all rules and regulations of the LWCF Program, applicable Executive Orders; all federal and state laws that govern the grant applicant during the performance of the project, and stewardship requirements after the project is completed; FURTHER THAT the Mayor of the City is authorized to sign the application for federal assistance and any other official project documents that are necessary to obtain such assistance, including any agreements, contracts or other documents that are required by the State of Missouri or the U.S. Department of the Interior, National Park Service. FURTHER THAT the Mayor, the City Administrator, and other appropriate City officials are hereby authorized to take any and all actions as may be deemed necessary or convenient to carry out and comply with the intent of this Resolution and to execute and deliver for and on behalf of the City all certificates, instruments, agreements and other documents, as may be necessary or convenient to perform all matters herein authorized; and FURTHER THAT this Resolution shall be in full force and effect from and after its passage and approval. MO 780-2705(11-21) CITY OF RIVERSI MISSOURI Upstream from ordinary. 2950 NW Vivion Road Riverside, Missouri 64150 MEMO DATE: January 14, 2022 AGENDA DATE: January 18, 2022 TO: Mayor and Board of Aldermen FROM: Noel Bennion RE: Application to the Land & Water Conservation Fund (LWCF) BACKGROUND: Receiving a grant from the LWCF requires the City to commit to preserving the project land, in perpetuity, for a recreational purpose. According to the National Park Service (NPS), this is to "guarantee that our nation's past investments in its treasured recreation and open space resources will be honored." The site of the Riverside Municipal Pool will need to remain as a recreational amenity in perpetuity. If an inevitable change to this property is required in the future, the City would need to apply for conversion. Conversion of property can be approved subject to review by the NPS. There are examples of conversions in other communities. These often trade the initial recreation property for a property of equal or greater value. BUDGETARY IMPACT: The grant funds requested are $500,000.00. For the LWCF, the City is required to provide a minimum of 50% matching funds or donations. Below are the proposed contributions for the project. The total budget matches the Five Year Capital Improvement Plan for the Fiscal Year 2022 Budget. City Funds (for current Master Plan) $33,800.00 County Partnership Grant $1,000.000.00 LWCF Grant $500.000.00 City Additional Funds $I,186,200.00 Total Budget $2,720,000.00 RECOMMENDATION: Staff recommends approval of the resolution to apply for the LWCF grant.
