I AN ORDINANCE APPOINTING A CITY PUBLIC DEFENDER AND AUTHORIZING AND APPROVING A CONTRACT BETWEEN THE CITY OF RIVERSIDE AND FRANKIE NAVRATIL FOR PUBLIC DEFENDER SERVICES WHEREAS, the need exists for a Public Defender position during Municipal Court hearings; and WHEREAS, the Mayor and Board of Aldermen find it is in the best interest of the City to appoint Frankie Navratil to serve in the capacity of Public Defender until a successor is duly appointed and qualified; NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF RVERSIDE, MISSOURI, AS FOLLOWS: SECTION 1 — APPOINTMENT. Frankie Navratil is hereby appointed to serve as City Public Defender until a successor is duly appointed and qualified. SECTION 2 — CONTRACT FOR SERVICES. The Contract for Public Defender Services between the City and Frankie Navratil in substantially the same form as attached hereto as Exhibit "A: is hereby authorized and approved. The Mayor is hereby authorized to execute the contract and all other documents necessary to the performance thereof, and the City Clerk is authorized to attest thereto. SECTION 3 - CONFLICTS. All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4 - EFFECTIVE DATE. This Ordinance shall be in full force and effect on May 18th, 2022. R se ATTEST: Robin Kincaid, Cit, Clerk CONTRACT FOR PUBLIC DEFENDER SERVICES The City of Riverside, a political subdivision of the State of Missouri "City", and Frankie Navratil "Contractor", enter into this Contract on May 17, 2022, in Riverside, Missouri, on the terms and conditions set forth herein the"Contract": 1. Duration of Contract. This Contract shall commence on May 17, 2022 and shall continue through June 30, 2023. 2. Scope of Services. Contractor shall perform public defender services on court nights in Riverside, Platte County. Missouri. 3. Supervision of Services. Contractor shall supervise the services provided under this Contract. City will deal only through Contractor. who shall be responsible for the proper execution of the services provided under this Contract, Contractor shall be responsible to City for the acts and omissions of Contractor's employees, agents, and interns, and any other persons performing any of the services under this contract for Contractor. 4. Compensation. In consideration for Contractor's performance, City shall pay Contractor the amount of $300.00 per visit. The compensation paid to Contractor has a condition precedent thereto that Contractor's attorneys are performing their duties diligently and professionally. 5.Compliance with Applicable Laws. Contractor, at his/her sole cost and expense, shall comply with all federal, state and local laws and regulations in performing the work and providing the services specified in this Contract. 6.Non-discrimination. No discrimination shall be made in the employment of persons under this Contract because of the race, color, national origin. ancestry, religion, age, sex or handicap of such person. 1 7. Severability. Should any provision herein be found or deemed to be invalid, this Contract shall be construed as not containing such provision, and all other provisions which are otherwise lawful shall remain in full force and effect. To this end the provisions of this Amended Contract are declared to be severable. 8. Entire Agreement. This Contract is the entire agreement of the parties. There are no understandings or agreements pertaining to this Contract except as are expressly stated in writing in this Contract or in any document attached hereto or incorporated herein by reference. 9. Modifications. All amendments and/or modifications to this Contract must be in writing and signed by both parties. 10. Termination. Any party may terminate this Agreement at any time, with or without cause, by giving written notice to the other party of such termination and specifying the effective date thereof. However, if Contractor terminates, then Contractor agrees to fully resolve any open cases she has at the time of termination, free of charge, or handle such cases until properly transferred to new counsel.
