R-2022-045 A RESOLUTION AUTHORIZING NEW HORIZONS ENTERPRISE, LLC TO REMOVE THE OBELISK LOCATED AT 5025 NW TAYLOR MEMORIAL BLVD. BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF RIVERSIDE, MISSOURI AS FOLLOWS: THAT the obelisk in front of the Kansas City Current's training facility obstructs the viewshed of the training facility. The obelisk was constructed before the training facility's conceptualization and is not compatible with the area's design aesthetics. New Horizons Enterprise, LLC has offered to remove the obelisk at no cost to the City, which the Board determines to be in the best interests of the City. FURTHER THAT the Board of Aldermen authorize New Horizons Enterprise, LLC to remove the obelisk from the City's right-of-way located at 5025 NW Taylor Memorial Blvd., subject to the following conditions: i) no compensation shall be paid to New Horizons Enterprise, LLC by the City; ii) New Horizons Enterprise, LLC submits a certificate of insurance to the City Clerk with minimum amounts of $1,000,000 for any one person in a single accident or occurrence, $3,000,000 for all claims arising out of a single accident or occurrence, and statutory workers' compensation coverages; iii) The obelisk,base, and foundation shall be removed to the top of the footings; iv) The surrounding concrete slab, including the footing, shall be completely removed; v) Upon completion of all concrete removal, the disturbed area shall be restored with a central crown six inches (6") higher and sloping downward to the established grade of the area as a whole to assure proper drainage of stormwater; vi) Any and all damage to surrounding landscape, irrigation, concrete, or other items shall be repaired by New Horizons Enterprise, LLC; vii) All debris from the removal must be disposed of at an approved landfill; viii) New Horizons Enterprise, LLC obtains City demolition and right-of-way permits and complies with all applicable federal, state, county, or city laws.
