BOARD OF ALDERMEN

Tuesday, December 20, 2022
6:00 p.m.
The Board of Aldermen for the City of Riverside, Missouri, met in regular session in the Board
of Aldermen Chambers at City Hall, 2950 NW Vivion Road, Riverside, Missouri, on Tuesday,
December 20, 2022.
Mayor Rose called the meeting to order at 6:05 p.m. Those in attendance were, Mayor Kathy
Rose, Aldermen Sal LoPorto, Nathan Cretsinger, Jill Beck (by Zoom), Steve Palma, Dawn
Cockrell, and Robert Milner (arrived at 6:21).
Also present were City Administrator Brian Koral, Community Development Director Mike Duffy,
City Clerk Robin Kincaid, and City Attorney Paul Campo.
MOTION TO ENTER INTO Alderman LoPorto moved to enter closed session pursuant to
CLOSED @ 6:09 P.M. RSMo 610.021 (1) Legal Action and litigation, and RSMo
610.021 (2) Leasing, Purchase, or sale of real estate, RSMo
610.021(3) Hiring, firing, disciplining, or promoting a particular
employee, when personal information about the employee is
discussed, and RSMo 610.021 (13) Individually identifiable
personnel records, performance ratings or records pertaining to
employee or applicant for employment, second by Alderman
Cretsinger.
Yes: LoPorto, Cretsinger, Cockrell, Beck, and Palma.
Motion carried 5-0.
MOTION TO ADJOURN Alderman Cretsinger moved at 6:48 p.m. to adjourn closed
CLOSED @ 6:48 P.M. session with no action taken, second by Alderman Milner.

Motion carried 6-0.
REGULAR SESSION Mayor Kathy Rose called the Regular Session Meeting to order at
7:00 p.m.
Those in attendance were Mayor Kathy Rose, Aldermen Sal LoPorto, Nathan Cretsinger, Jill
Beck (by Zoom), Dawn Cockrell, Steve Palma, and Rob Milner.
Also present were City Administrator Brian Koral, Community Development Director Mike Duffy,
City Clerk Robin Kincaid, Public Works Director Tom Wooddell, City Engineer Travis Hoover,
Police Chief Chris Skinrood, Fire Marshal Keith Payne, Human Resources Manager Amy
Strough, Finance Director Erika Benitez, Capital Projects/ Parks Noel Challis Bennion, and IT
Manager Jason Ketter. City Attorney Paul Campo was also present.
PLEDGE OF ALLEGIANCE Mayor Rose led the Pledge of Allegiance.
PUBLIC COMMENT None.
BRIEFING
Prosecuting Attorney Amy Ashelford briefed the Mayor and Board
of Aldermen regarding the newly passed law of recreational
marijuana along with some of the issues that need addressed
through possible city code changes and possible concerns that
the municipal court and the police department are asking for
direction from the Board, such as: does Riverside want to take a
stand on marijuana, what will you want me to prosecute, what
direction do you want us to go, so that the Police and Prosecutor
are on the same page? We want to protect our citizens and make
sure they are safe and following the law.
CONSENT AGENDA
Alderman Milner moved to approve the consent agenda with the
resolution R-2022-136 pulled for further discussion, second by
Alderman Cockrell.
Yes: Milner, Cockrell, Beck, LoPorto, Palma, and Cretsinger.
Motion carried 6-0.
MINUTES OF 12-06-22
Alderman Milner moved to approve the minutes of the December
6, 2022 meeting, second by Alderman Cockrell.
Yes: Milner, Cockrell, Beck, LoPorto, Palma, and Cretsinger.
Motion carried 6-0.
COURT REPORT
Alderman Milner moved to approve the court report for the month
of November 2022, second by Alderman Cockrell.

REGULAR AGENDA
RESOLUTION 2022-136
Alderman Cretsinger moved to approve Resolution 2022-136
Bill Pay
authorizing the expenditure of funds for fiscal year 2022-2023 for
weeks ending December 911 and December 1611 in the amount of
$1,780,633.94, second by Alderman Cockrell.
Yes: Cretsinger, Cockrell, Milner, Palma, and LoPorto.
No: None.
Abstain: Beck
Motion carried 5-0-1.
PUBLIC HEARING
Mayor Rose opened the public hearing at 7:22 p.m. to consider
Outdoor Storage SUP
a Special Use Permit for Outdoor Storage at 3910 NW Helena
3910 NW Helena Rd
Rd., in the City of Riverside, Missouri.
Community Development Director Mike Duffy asked that this
public hearing be continued. Mayor Rose then asked for a Motion
to continue the public hearing to January 3, 2023.
Alderman Palma moved to continue the public hearing to the
January 3, 2023 regular meeting, second by Alderman Milner.
Yes: Palma, Milner, LoPorto, Cretsinger, Cockrell, and Beck.
Motion carried 6-0.
PUBLIC HEARING Mayor Rose opened the public hearing at 7:23 p.m. to consider
Outdoor Storage SUP an amendment to the Special Use Permit for Outdoor Storage at
3001 NW Platte Rd. 3001 NW Platte Road, in the City of Riverside, Missouri.
Community Development Director Mike Duffy stated that this is a
request for modification to an existing SUP for outdoor storage at
Thompson Gas. This was heard by the Planning and Zoning
Commission and recommended for approval unanimously.
Pictures were shown and Duffy explained this will be a temporary
structure for an 18-month period to determine if it is the solution
they are looking for and then they would move to a more
permanent solution. Mayor Rose then asked if there were any
other questions or comments to be made, hearing none, she
closed the public hearing at 7:28 p.m.
BILL NO.2022-063 City Clerk Robin Kincaid gave first reading of Bill No. 2022-063.
Thompson Gas SUP Alderman Milner moved to accept first reading and place Bill
2022-063 on second and final reading, second by Alderman
Cockrell.
Yes: Milner, Cockrell, Beck, LoPorto, Cretsinger, and Palma.
Motion carried 6-0.
City Clerk Kincaid gave second reading of Bill No. 2022-063.

2022-064 on second and final reading, second by Alderman

City Clerk Kincaid gave second reading of Bill No. 2022-064.

Welch Police Hire Alderman LoPorto moved to accept first reading and place Bill
2022-065 on second and final reading, second by Alderman
Cockrell.

BILL NO. 2022-066 City Clerk Robin Kincaid gave first reading of Bill No. 2022-066.
Gilmore & Bell Agreement City Administrator Brian Koral reported that this is a continuation
of an agreement with Gilmore & Bell as they do an annual
analysis of refunding bonds that will mature in 2025, so we will
continue this work for couple more years at a cost around $900
each year.
Alderman LoPorto moved to accept first reading and place Bill
2022-066 on second and final reading, second by Alderman
Palma.

BILL NO.2022-067 City Clerk Robin Kincaid gave first reading of Bill No. 2022-067.
Easement Acquisition Capital Projects/ Parks Noel Challis Bennion stated that this is
regarding the Vivion Trail Project from St. Joseph to Mulberry and
there are four property owners that we need to discuss various
easement acquisitions. This process is required on the project due
to the involvement of federal funding.
Alderman Cretsinger moved to accept first reading and place Bill
2022-067 on second and final reading, second by Alderman
Milner.
Yes: Cretsinger, Milner, LoPorto, Beck, Palma, and Cockrell.
Motion carried 6-0.
City Clerk Kincaid gave second reading of Bill No. 2022-067.

BILL NO. 2022-068 City Clerk Robin Kincaid gave first reading of Bill No. 2022-068.
2023 HHW with MARC Robin reported that this is the City's annual renewal with an
increased amount of $580.88.
Alderman Cretsinger moved to accept first reading and place Bill
2022-068 on second and final reading, second by Alderman
Cockrell.

RESOLUTION 2022-137 Finance Director Erika Benitez explained that this is a clean-up
Amend 2021-2022 Budget to the 2021-2022 budget.
Alderman LoPorto moved to approve Resolution 2022-137
amending the fiscal year 2021-2022 annual budget for the City of
Riverside, Missouri, second by Alderman Milner.
Yes: LoPorto, Milner, Cretsinger, Beck, Palma, and Cockrell.
Motion carried 6-0.
RESOLUTION 2022-138 Finance Director Erika Benitez explained the foreseen changes
Amend 2022-2023 Budget necessary for the 2022-2023 budget to keep our fund balances
aligned.
Alderman LoPorto moved to approve Resolution 2022-138
amending the fiscal year 2022-2023 annual budget for the City of
Riverside, Missouri, second by Alderman Cockrell.
Yes: LoPorto, Cockrell, Cretsinger, Milner, Beck, and Palma.
Motion carried 6-0.
RESOLUTION 2022-139 Capital Projects/Parks Manager Noel Challis Bennion reported
Crossland CO B that this change order is a deduct, along with a few details.
Alderman LoPorto moved to approve Resolution 2022-139
approving change order 8 to the agreement with Crossland
Construction Company, Inc for additions and renovations
Riverside Public Safety resulting in a revised contract amount of
$4,823,219.52 for such purposes, second by Alderman
Cretsinger.
Yes: LoPorto, Cretsinger, Milner, Palma, Beck, and Cockrell.

RESOLUTION 2022-140 Capital Projects/Parks Manager Noel Challis Bennion explained
Crossland CO 9 the detailed changes requested in this resolution.
Alderman Milner moved to approve Resolution 2022-139
approving change order 9 to the agreement with Crossland
Construction Company, Inc for additions and renovations
Riverside Public Safety resulting in a revised contract amount of
$4,852.489.46 for such purposes, second by Alderman Cockrell.
Yes: Milner, Cockrell, Beck, LoPorto, Cretsinger, and Palma.
Motion carried 6-0.
CITY ADMINISTRATOR City Administrator Brian Koral communicated that through the
amendment to legalize recreational marijuana, municipalities have
an option to levy a 3% sales tax through the city on sales through
any dispensaries licensed in our city. Koral gave estimates on the
collection of this sales tax, it must be voted on by the citizens of
the city, and the Board would need to consider an ordinance to
place the question on the April election ballot by January 17� if
they chose to do so. Following discussion, the Board gave general
consensus to bring an ordinance for consideration in January
2023.
Koral reminded the Board that city offices will be closed the next
two Mondays in observance of Christmas and New Year's
holidays. The City flags are flying at half-staff in honor of the
passing of former Mayor Betty Burch. He then shared an
Upstream from Ordinary story by sharing an email thanking the
Riverside Police Department being attentive to remind the resident
to keep their garage door closed. On behalf of our staff to each of
you, we wish you a Merry Christmas!

ENGINEERING
Nothing to report.
FINANCE
Finance Director Erika Benitez showed by PowerPoint
presentation for the November 30, 2022 financial status. She
highlighted the funds and balances for income and expenses. The
investment portfolio was shown.
FIRE
Fire Marshal Keith Payne reported that Santa on the f retruck went
great, and the residents enjoyed it with a great turnout.
POLICE
Police Chief Chris Skinrood reviewed the November 2022 stats.
We are very busy, and we are seeing thefts to diesel vehicles that
is a concern that is very expensive repair as well.
PUBLIC WORKS
Public Works Director Tom Wooddell stated that they are
prepared for the weather that is possibly heading for our area.
LEVEE BOARD
City Engineer Hoover reported that there is a meeting January
18'h.
MAYOR'S DISCUSSION
Mayor Rose commented that last Tuesday evening she went to
the Mid -Continent Library for a monthly meeting to support the
project for Riverside's library. There seems to be internal issues
with their budget, but after discussions, we have been guaranteed
by vote they will move forward with our library project.
This has been an incredible year. So much has been
accomplished, staff and the Board has done so many wonderful
things. I appreciate everything thing you all have done for me,
thank you for your love and support, this has been a difficult time.
We will have her memorial next Wednesday at the community
center, and I want this to be a community celebration, because my
mother started so many of the projects in Riverside. She cut the
ribbon on this building, just so many things and she loved this
community. I wish everyone a Merry Christmas and a Happy New
Year.
