HomeMy WebLinkAbout2008-032 - ETC InstituteBILL N0.2008-32 ORDINANCE N0.2008-32 AN ORDINANCE AUTHORIZING THE CITY OF RIVERSIDE TO ENTER INTO AN AGREEMENT FOR SERVICES WITH, AND PAY CERTAIN FUNDS TO, ETC INSTITUTE WHEREAS, ETC Institute, Ina ("Conhactor") is a corporation providing services, including certain public survey and information compilation services {"Services"); and WHEREAS, Contractor desires to provide such Services and requires funding to provide services to the City; WHEREAS, the City finds that the provision of the Services is a public purpose and the City has the capability and desire to retain Contractor for the provision of such Services to the City. NOW, THEREFORE, BE IT ORDAINED, by the Board of Aldermen of Riverside, Missouri, as follows: Section I. The City finds that the provision of the Services contributes to the welfare of the City as well as the economic and social potential of the City and its residents, that the Services are important to the welfare of the City and that the provision of funds to assist in providing such Services are for a public purpose. Section 2. The City of Riverside shall pay Contractor a total of Eleven Thousand Seven Hundred and Eighty-One Dollars ($11,781.00) in exchange for his Services pursuant to a Contract for Services and Scope of Work (the "Conh~act"), in substantially the form attached as Exhibit A, which is hereby approved. Section 3. The Mayor and City Clerk are authorized and directed to execute the Contract, execution of such document being conclusive proof of such approval. The Mayor, City Clerk and City Administrator are each authorized and directed to perform all acts and execute any other documents necessary or desirable to effectuate the intent of this Ordinance. Section 4. The sections, paragraphs, clauses, and phrases of the Ordinance are severable and if any portion of the Ordinance is declared unlawful by the valid judgment, decree, or injunction order of a court of competent jurisdiction, such ruling shall not affect any of the remaining phrases, clauses, sentences, paragraphs, and sections of the Ordinance and all provisions of the Ordinance not specifically declared to be unlawful shall remain in full force and effect. ROSE ATTEST: C Y CLERK Contract for Services and Scope of Work Between ETC Institute and the City of Riverside, Missouri ARTICLE I: SCOPE OF SERVICES 1. Overview of Services to Be Performed. ETC Institute will design and administer a citizen survey for the City of Riverside, Missouri. The survey will be administered during February/March of 2008. The final report will be completed by March 28, 2008. Maximum fixed fee. The total fee for the project is $11,781. This includes $8,946 to design and administer the survey, $1,260 for crosstabulations, and $1,575 to complete 25- 50 business surveys. ETC Institute's responsibilities. The tasks that will be performed by ETC Institute as part of this agreement include the following: a. finalizing the methodology for administering the survey based on input from the City. b. designing a resident survey instrument that is up to 15 minutes in length (6-7 pages), and a business survey up to 3 pages in length.. c. selecting a random sample of households to be surveyed d. setting up the database e. conducting a pretest of the survey instruument f. completing 400 surveys by a combination of mail and phone (ETC Institute's costs includes all labor, postage and printing associated with the administration of the survey). The results of a random sample of 400 completed surveys will have a precision of at least +/-5% at the 95% level of confidence. g. conducting data entry and quality control review for all completed surveys h. providing complete printouts of the data i. providing crosstabulations for up to five demographic variables. j, conducting benchmarking analysis that shows how the results for Riverside compare to other cities in Kansas and Missouri. ETC Institute Page 1 of 3 k. conducting importance-satisfaction analysis to identify the types of improvements that will have the most impact on satisfaction with city services. I. completing a final report that will include an executive summary, charts and graphs, benchmarking analysis, importance-satisfaction analysis, tables showing the results to all questions on the survey, and a copy of the survey instrument. m. making an on-site presentation of the survey results to the City. 4. Responsibilities for the City of Riverside will include the following: a. approving the survey instrument b. providing a cover letter for the mail version of both business and resident surveys c. identifying requests for subanalysis of the data as appropriate d. supplying the addresses for households and businesses in the City. ARTICLE II: PAYMENT FOR SERVICES 1. Invoices will be submitted upon completion of tasks described in Article I, Section 3, of this agreement as follows: a. Invoice #1: $4,123. The first invoice will be submitted upon completion of tasks a, b, c, d, and e. The deliverable for this payment will be an approved copy of the survey instrument. b. Invoice #2: $5,890. The second invoice will be submitted upon completion of tasks f, g, and h. The deliverable for this invoice will be a printout that shows the overall results for 400 completed surveys. c. Invoice #3: $1,768. The third invoice will be submitted upon completion of task i, j, k, 1, and m. The deliverable for this invoice will be 10 color copies of the final report, which will include crosstabulations, benchmarking analysis, and importance- satisfaction analysis. ARTICLE III: MISCELLANEOUS PROVISIONS Change in Scone. The Scope of Services for this contract shall be subject to modification or supplement upon the written agreement of the contracting parties. Any such modification in the Scope of Services shall be incorporated in this agreement by supplemental agreement executed by the parties. ETC Instihite Page 2 of 3 2. Termination of Contract. This agreement may be terminated by either party upon 14 days written notice in the event of substantial failure by the other party to perform in accordance with the terms hereof through no fault of the terminating party. If the contract is terminated by the City, the City shall reimburse ETC Institute for the full value of any tasks that have been initiated, up to the total amount of the next scheduled invoice. 3. 12irrhts to Use the Data. ETC Institute has the right to use the data as a component of ETC Institute's DirectionFinder® benchmarks, but ETC Institute will not release specific results for the City of Riverside without written approval from the City.
