AN ORDINANCE APPROVING AN INTERGOVERNMENTAL COOPERATION
AGREEMENT BETWEEN THE CITY OF RIVERSIDE, MISSOURI AND SOUTHERN
PLATTE FH2E PROTECTION DISTRICT FOR THE PURPOSE OF FIRE
PROTECTION MUTUAL AID TO THE CITY OF RIVERSIDE AND THE CITY OF
HOUSTON LAKE; AUTHORIZING THE EXECUTION THEREOF; AND APPROVING
CERTAIN ACTIONS RELATED THERETO.
WHEREAS, the City provides fire suppression services to its residents and, through
mutual aid, to the residents of Houston Lake; and
WHEREAS, the City desires.to upgrade the services available to its residents and the
residents of Houston Lake by providing high levels of fire prevention, education, suppression,
medical first response and water rescue services; and
WHEREAS, in order to better serve the residents in significant emergency situations the
City wishes to be able to request assistance from the Southern Platte Fire Protection District (the
"District") when such assistance is needed; and
WHEREAS the District has agreed to provide assistance to the City upon request for
significant emergency situations where such assistance is needed; and
WHEREAS the City and the District have drafted a cooperation agreement setting forth
the terms of the agreerent.
NOW THEREFORE BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE
CITY OF RIVERSIDE, MISSOURI AS FOLLOWS:
Section 1. This Ordinance is intended and is hereby determined and declared to be
necessary to accomplish and serve the public purpose of enhancing and improving the City's fire
protection services.
Section 2. The City of Riverside shall enter into an agreement whereby Southern Platte
Fire Protection District agrees to provide assistance to the City and its residents in certain
emergency situations. (the "Intergovernmental Cooperation Agreement").
Section 3. The execution and delivery of the Intergovernmental Cooperation Agreement,
in substantially the form attached hereto as Exhibit A, is approved, and the Mayor is authorized
to execute the Agreement and to take such other actions reasonably necessary to carry out the
intent of this Ordinance on behalf of the City, the execution of the Agreement being conclusive
evidence of such approval.
Section 4. The Mayor, the City Administrator, the City Attorney and other appropriate
City officials are hereby authorized to take any and all actions as may be deemed necessary or
convenient to carry out and comply with the intent of this Ordinance and to execute and deliver
for and on behalf of the City all certificates, instruments, agreements and other documents, as
may be necessary or convenient to perform all matters herein authorized.
Section 5. This Ordinance shall be in full force and effect from and after its passage and
approval.

INTERGOVERNMENTAL COOPERATION AGREEMENT
BETWEEN
THE CITY OF RIVERSIDE, MISSOURI
AND
SOUTHERN PLATTE FIRE PROTECTION DISTRICT
THIS AGREEMENT ("Agreement"), made and entered into this 15` day of May, 2008,
by and between THE CITY OF RIVERSIDE, MISSOURI ("City"), a fourth class city and
political subdivision of the State of Missouri, and the SOUTHERN PLATTE FIRE
PROTECTION DISTRICT ("District"},apolitical subdivision of the State of Missouri.

WHEREAS, the parties hereto are governmental entities and fire service organizations
qualified under the law to secure to their respective geographical areas the benefits of aid with
each other in fire service equipment, personnel and other resowces for the protection of life and
property at the time of a significant emergency such as fires, emergency medical incidents,
rescue incidents, hazardous material occurrences and natural disasters or at the time emergency
services are given as a result of a request for assistance under certain circumstances; and
WHEREAS, the City also provides fire protection services to Houston Lake on a paid
contractual basis; and
WHEREAS, the City desires to upgrade the services available to its residents and the
residents of Houston Lake by providing high levels of fire prevention, education, suppression,
medical first response and water rescue services; and
WHEREAS, the District desires to enhance the services provided to its Dish•ict's
residents by expanding its current fire prevention, education, suppression, medical first response
and water rescue services capabilities, and by using additional revenues available under this
agreement will offset additional costs of these expanded services that would otherwise be borne
solely by its taxpayers; and
WHEREAS, there might arise in said City's jurisdiction an emergency requiring
emergency response services to which District can make a more timely response or the City
requires assistance in fulfilling its assigned coverage responsibilities as a result of a significant
reduction of resources due to an on-going emergency response, and
WHEREAS, the District is a duly authorized provider of such services in accordance
with Missouri State Statutes; and,
WHEREAS, a determination has been made by the City Council of City and Board of
District that the following Agreement is a cost effective mechanism to provide such services.

NOW, THEREFORE, for and in consideration of the mutual promises and covenants
contained herein, the parties hereto agree as follows:
Upon request for aid assistance, the District fire service organization will send
equipment, personnel and other resources to any point within the City fire service
organization jurisdiction and Houston Lake jurisdiction; provided, however, that
response is to be given only when in the judgment of the fire chief, or such chief's
designee, can reasonably furnish such assistance without unreasonably imperiling the
safety of its citizens served by District.
2. The parties agree not to call for assistance unless significant emergency circumstances
exist wherein the City and resources have been significantly reduced by emergency
responses. The parties mutually understand and agree that this contract was not
entered into for the purpose of a reduction of staffing by either party.
3. The incident commander in chazge of the responding District shall be the sole judge
of how much assistance can be furnished under the circumstances of each particular
case. It is agreed that the parties shall not be liable in any way to the other, or to its
inhabitants or to any other person, firm or corporation for any failure to give requested
assistance.
4. Any dispatch of equipment and personnel pursuant to this Agreement is subject to the
following conditions:
a. Any request for aid shall include a statement of the significant emergency
circumstances and the requested resources and shall specify the location for
response.
b. The parties agree to operate and coordinate the emergency incident within the
organizational framework of the Emergency Incident Management System as
adopted by the Heart of America Metro Fire Chiefs Council.
c. The responding operational departments shall be under the immediate
supervision of the person designated by the responding department.
d. A responding department shall be released by the requesting department when,
in the judgment of the incident commander, the services of the responding
department are no longer required. Provided, however, it is mutually
recognized that each party owes its primary allegiance and fire services to its
own citizens. Therefore, the responding District may be recalled by its fire
chief, or chief s designee, if, in that officer's opinion, a significant need exists
for the responding District to render services within its normal service area.

5. In consideration for the District's furnishing such equipment, personnel, and services, the
City shall follow Appendix A for services to the response area of Houston Lake and
Appendix B for responses within the City. In addition, the responding District shall be
reimbursed by the requesting City for consumables utilized at the significant emergency
site.
6. This Agreement shall continue until December 31, 2008.
7. The parties may elect to amend or specify additional provisions by adding a mutually
agreed upon written addendum to the Agreement.

APPENDIX A
RSPSD/SPPPD Agreement 3 December, 2007
Houston Lake Response Area
In consideration for the District's furnishing such equipment, personnel, and services, the
City shall aimually pay to District an amount equal to $19,000.
Inconsideration of the payment of such sum of money, District agrees to pay all of its
expenses of organization, operation and all costs of acquiring, supplying and maintaining the
necessary personnel with which to control fire and provide medical first response and light
rescue services within the Houston Lake response area. The City shall pay no additional
monies to District, except for reimbursement for consumables, as set forth in Section 5 of the
Agreement.
The City agrees to pay its amrual obligation as outlined above for the calendar year within
thirty (30) days of the dated Agreement.

APPENDIX B
City Response Area
In consideration for the District's furnishing such equipment, personnel, and services,
the City shall quarterly pay to District an amount equal a sum of services rendered, as
detailed in the most current Missouri Department of Natural Resources Hazardous
Substances Emergency Response Cost Recovery Information.
In consideration of the payment of such sum of money, Dishict agrees to pay all of its
expenses of organization, operation and all costs of acquiring, supplying and maintaining the
necessary personnel with which to control fire and provide medical first response and light
rescue services within the City response area. The City shall pay no additional monies to
District, except for reimbursement for consumables, as set forth in Section 5 of the
Agreement.
The City agrees to pay its quarterly obligation as outlined above for the calendar year within
thirty (30) days of an itemized, detailed bill. The itemized, detailed bill will be submitted to
the City, tluough the Director of Public Safety for City at the end of each calendar quarter.
