HomeMy WebLinkAbout1936 Approving Final Plat of Riverside Soccer and Second Plat, a Replat of Lots 1 and 2 of Riverside SoccerBILL NO. 2023-045 ORDINANCE NO. 1936 AN ORDINANCE APPROVING THE FINAL PLAT OF RIVERSIDE SOCCER, SECOND PLAT, A REPLAT OF LOTS 1 AND 2 OF RIVERSIDE SOCCER, A SUBDIVISION IN THE CITY OF RIVERSIDE, PLATTE COUNTY, MISSOURI. WHEREAS, Application No. PC23-10, submitted by KC WFC Training, LLC requesting approval of the final plat of Riverside Soccer, Second Plat, a replat of Lots 1 and 2 of Riverside Soccer, a minor subdivision in the City of Riverside. Platte County, Missouri, was referred to the Planning Commission, and WHEREAS, the Planning Commission considered the application on June 22, 2023 and rendered a report to the Board of Aldermen recommending that the final plat be approved, and WHEREAS, that it is in the best interests of the City of Riverside, Missouri to approve the final plat Riverside Soccer, Second Plat as set forth herein; NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF RIVERSIDE, MISSOURI, AS FOLLOWS: SECTION 1 — APPROVAL OF FINAL PLAT. That the Final Plat of Riverside Soccer, Second Plat, a subdivision of the City of Riverside, Platte County, Missouri, a true and correct copy of which is attached hereto and incorporated herein, is hereby approved, platting the property legally described in Exhibit "A" attached hereto. SECTION 2 — APPROVAL OF DEDICATION. That the City of Riverside approves dedication of the streets, municipal uses, easement, access, and utilities shown on the plat, not heretofore dedicated to the public on property owned by the City as shown on the plat. SECTION 3 - ACCEPTANCE OF DEDICATION. That the City of Riverside hereby further accepts the dedication of on the plat of all streets, municipal uses, easement, access, and utilities shown on the plat, not heretofore dedicated to the public is hereby accepted for the purpose as therein set out. SECTION 4 — REPEAL OF ORDINANCES IN CONFLICT. All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed. SECTION 5 — SEVERABILITY CLAUSE. The provisions of this ordinance are severable and if any provision hereof is declared invalid, unconstitutional, or unenforceable, such determination shall not affect the validity of the remainder of this ordinance. SECTION 6 — EFFECTIVE DATE. This ordinance shall be in full force and effect from and after the date of its passage and approval. Easements An easement is hereby granted to the City of Riverside, Missouri, for the purpose of locating, constructing, operating, and maintaining facilities for water, gas, electricity, sewage, telephone, cable tv, surface drainage, and grading, including, but not limited to, underground pipes and conduits, pad mounted transformers, service pedestals, any or all of them upon, over, under and along the strips of land designaed as utility easements, by virtue of their existence, do hereby covenant, consent, and agree that they shall be suordinate to said public right of way in the event that additional public right of way is dedicated over the location of the utility easement. Where other easements are desidnated for a particular purpose, the use thereof shall be limited to that purpose only. All of the above easements shall be kept free from any and all obstructions which would interefere with the cosntruction or reconstruction of proper, safe and continuous maintenance of the aforesaid uses and specifically there shall not be built thereon or thereover any structure (except driveways, paved areas, grass, shrubs and fences) nor shall there be any obstruction to interfere with the agents and employees of Riverside, Missouri, and its franchised utilities from going upon said easement and as much of the adjoining lands as may be reasonbaly necessary in exercising the rights granted by the easement. No excavation of fill shall be made or operation of any kind or nature shall be performed which will reduce or increase the earth coverage over the utilities above stated or the appurtenances thereto without a valid permit from the department of public works as to utility easements and/or written approval of the director of water services as to water main easements. Analysis Overview: The applicant is requesting a replate to accommodate the construction of their new Academy building. While the applicant will own both lots, they would like the Academy building to be all on lot 2. There for they are requesting that approximately 78 feet of the southern portion of the lot line between lots 1 and 2 be shifted approximately 36 feet to the west. Site Layout: The land included in the plat does not require any new right-of-way or easements. All roads and utilities to the site have been installed. Conformance to Comprehensive Master Plan: The modified plat and proposed use is in conformance with the Comprehensive Master Plan. Recommendation Staff finds the application in conformance with the Comprehensive Master Plan, UDO and previously approved final plat, and therefore, recommends approval of Replat of Lots 1 and 2 of Riverside Soccer.
