HomeMy WebLinkAbout2023-06-20 Regular Meeting MintuesMINUTES REGULAR MEETING BOARD OF ALDERMEN RIVERSIDE, MISSOURI Tuesday, June 20, 2023 6:00 p.m. The Board of Aldermen for the City of Riverside, Missouri, met in regular session in the Board of Aldermen Chambers at City Hall, 2950 NW Vivion Road, Riverside, Missouri, on Tuesday, June 20, 2023. Mayor Rose called the meeting to order at 6:06 p.m. Those in attendance were, Mayor Kathy Rose, Aldermen Rob Milner, Jill Beck, Nathan Cretsinger, and Jason Draut. Aldermen Dawn Cockrell and Steve Palma were absent for closed session. Also present were City Administrator Brian Koral, City Clerk Robin Kincaid, and Community Development Director Mike Duffy (joined at 6:46 p.m.). City Attorney Paul Campo and Special Counsel Joe Bednar were also in attendance. MOTION TO ENTER INTO CLOSED @ 6:06 P.M. MOTION TO ADJOURN CLOSED @ 6:56 P.M. Alderman Beck moved to enter closed session pursuant RSMo 610.021 (1) Legal Action and litigation, RSMo 610.02 (2) Leasing, Purchase, or sale of real estate, 610.021(3) Hiring, firing, disciplining or promoting a particular employee, when personal information about the employee is discussed, RSMo 610.021 (12) Sealed bids and related documents, until the bids are opened; and sealed proposals and related documents or any documents related to a negotiated contact until a contract is executed, or all proposals are rejected, RSMo 610.021 (13) Individually identifiable personnel records, performance ratings or records pertaining to employee or applicant for employment, second by Alderman Cretsinger. Yes: Beck, Cretsinger, Milner, and Draut. Motion carried 4-0. Alderman Cretsinger moved at 6:56 p.m. to adjourn closed session with no action taken, second by Alderman Milner. REGULAR SESSION Mayor Kathy Rose called the Regular Session Meeting to order at 7:00 p.m. Those in attendance were Mayor Kathy Rose, Aldermen Nathan Cretsinger, Jason Draut, Rob Milner, and Jill Beck. Aldermen Steve Palma and Dawn Cockrell were absent. 1 Also present were City Administrator Brian Koral, Community Development Director Mike Duffy, City Clerk Robin Kincaid, Public Works Director Tom Wooddell, City Engineer Travis Hoover, Police Chief Chris Skinrood, Fire Chief Gordon Fowlston, and Finance Director Erika Benitez. City Attorney Paul Campo and Special Counsel Joe Bednar were in attendance. PLEDGE OF ALLEGIANCE Mayor Rose led the Pledge of Allegiance. PUBLIC COMMENT None. CONSENT AGENDA Alderman Beck moved to approve the consent agenda as presented, second by Alderman Milner. Yes: Beck, Milner, Draut, and Cretsinger. Motion carried 4-0. MINUTES OF 06-06-23 COURT REPORT Alderman Beck moved to approve the minutes of the June 6. 2023, meeting, second by Alderman Milner. Yes: Beck, Milner, Draut, and Cretsinger. Motion carried 4-0. Alderman Beck moved to approve the court report for the month of May 2023, second by Alderman Milner. Yes: Beck, Milner, Draut, and Cretsinger. Motion carried 4-0. RESOLUTION 2023-061 Alderman Beck moved to approve Resolution 2023-061 Purchase Cyber Liability Ins authorizing the purchase of cyber liability insurance from Gallagher Insurance for the annual premium in an amount not to exceed $10,750.00, second by Alderman Milner. Yes: Beck, Milner, Draut and Cretsinger. Motion carried 4-0. RESOLUTION 2023-062 C01 Dondlinger & Sons RESOLUTION 2023-063 C07 Kenton Brothers Alderman Beck moved to approve Resolution 2023-062 approving change order 1 to the agreement with Dondlinger and Sons Construction Company, Inc for 2022 Line Creek Trail Connector resulting in a revised contract amount of $544,136.50 for such purposes, second by Alderman Milner. Yes: Beck. Milner, Draut, and Cretsinger. Motion carried 4-0. Alderman Beck moved to approve Resolution 2023-063 approving change order 7 to the agreement with Kenton Brothers Locksmiths, Inc for additional equipment and labor identified during the City Complex Video and Access Control Project resulting in a revised contract amount of $793,245.41 for such purposes, second by Alderman Milner. Yes: Beck, Milner, Draut. and Cretsinger. Motion carried 4-0. REGULAR AGENDA PUBLIC HEARING Chapter 100 Bonds for Soccer BILL NO. 2023-033 Chapter 100 Bonds for Soccer BILL NO. 2023-034 Conflict of Interest Mayor Rose opened the public hearing at 7:01 p.m. in accordance with Chapter 100 requirements to provide an opportunity for any affected taxing district to provide comments in support of or in opposition to a plan for industrial development before consideration by the City. Any representative of a political subdivision or other taxing jurisdiction affected by the plan may provide comments at this time for the Plan for an Industrial Development Project for a Soccer Complex Project (Parcel B), in the City of Riverside, Platte County, Missouri. Community Development Director Mike Duffy explained that this is for the development of Parcel B of the KC Current Soccer Complex. This is for the youth soccer fields. This is a Public Hearing and notices were sent to all the surrounding taxing jurisdictions, to allow them an option to weigh in on this project. They will be issuing bonds for the construction of the project and providing a sales tax exemption on the materials. Duffy then pointed out the location of Parcel B. Special Counsel Bednar further explained the purpose of this agreement for soccer. Gilmore and Bell representative Sarah Granath was introduced and then answered questions of the Board. Mayor Rose asked if there were any further questions or comments and hearing none, closed the public hearing at 7:10 p.m. City Clerk Robin Kincaid gave first reading of Bill No. 2023-033. Alderman Milner moved to accept first reading and place Bill 2023-033 and final reading, second by Alderman Draut. Yes: Milner, Draut, Cretsinger, and Beck. Motion carried 4-0. City Clerk Kincaid gave second reading of Bill No. 2023-033. Alderman Cretsinger moved to approve Bill 2023-033 and enact said bill as ordinance, second by Alderman Beck. Yes: Cretsinger, Beck, Milner, and Draut. Motion carried 4-0. City Clerk Robin Kincaid gave first reading of Bill No. 2023-034. Kincaid then explained that this is considered by the Board bi- annually and the advantages of having this ordinance in place. Alderman Milner moved to accept first reading and place Bill 2023-034 on second and final reading, second by Alderman Beck. Yes: Milner, Beck, Cretsinger, and Draut. Motion carried 4-0. City Clerk Kincaid gave second reading of Bill No. 2023-034. Alderman Milner moved to approve Bill 2023-034 and enact said bill as ordinance, second by Alderman Beck. Yes: Milner, Beck, Draut, and Cretsinger. Motion carried 4-0. 3 BILL NO. 2023-035 City Clerk Robin Kincaid gave first reading of Bill No. 2023-035. Amend Code -Linear Foot Fee City Administrator Brian Koral commented that this is the bill to amend the code to keep the linear foot fee and adjusting our linear fees. Alderman Milner moved to accept first reading and place Bill 2023-035 on second and final reading, second by Alderman Beck. Yes: Milner, Beck, Cretsinger, and Draut. Motion carried 4-0. City Clerk Kincaid gave second reading of Bill No. 2023-035. Alderman Beck moved to approve Bill 2023-035 and enact said bill as ordinance, second by Alderman Cretsinger. BILL NO. 2023-036 Adopt Compensation Plan BILL NO. 2023-037 Fill Dirt Agreement City Clerk Robin Kincaid gave first reading of Bill No. 2023-036. City Administrator Brian Koral stated that the compensation plan is always presented for consideration prior to the annual budget, which is to be considered later on this agenda. Alderman Draut moved to accept first reading and place Bill 2023-036 on second and final reading, second by Alderman Milner. Yes: Draut, Milner, Cretsinger, and Beck. Motion carried 4-0. City Clerk Kincaid gave second reading of Bill No. 2023-036. Alderman Milner moved to approve Bill 2023-036 and enact said bill as ordinance, second by Alderman Beck. Yes: Milner. Beck, Draut, and Cretsinger. Motion carried 4-0. City Clerk Robin Kincaid gave first reading of Bill No. 2023-037. City Engineer Travis Hoover commented that this is for the next round of fill dirt and I foresee us finishing the Rinker and Maddox sites this year. Alderman Beck moved to accept first reading and place Bill 2023-037 on second and final reading, second by Alderman Milner. Yes: Beck. Milner, Cretsinger, and Draut. Motion carried 4-0. City Clerk Kincaid gave second reading of Bill No. 2023-037. Alderman Milner moved to approve Bill 2023-037 and enact said bill as ordinance. second by Alderman Draut. Yes: Milner, Draut, Beck, and Cretsinger. Motion carried 4-0. 4 BILL NO. 2023-038 Police Hire - Strong City Clerk Robin Kincaid gave first reading of Bill No. 2023-038. Alderman Cretsinger moved to accept first reading and place Bill 2023-038 on second and final reading, second by Alderman Beck. Yes: Cretsinger, Beck. Draut, and Milner. Motion carried 4-0. City Clerk Kincaid gave second reading of Bill No. 2023-038. Alderman Milner moved to approve Bill 2023-038 and enact said bill as ordinance. second by Alderman Draut. Yes: Milner, Draut, Cretsinger, and Beck. Motion carried 4-0. BILL NO. 2023-039 City Clerk Robin Kincaid gave first reading of Bill No. 2023-039. Amend Dev. Agmnt — Soccer Community Development Director Mike Duffy stated that along with the Chapter 100 Bonds for soccer that was voted on earlier, amending the development agreement and the infrastructure agreement is another step to the Parcel B Project moving forward. PowerPoint slides were shown of the locations and development KC WFC will be developing and reviewed details of projected construction. Alderman Cretsinger moved to accept first reading and place Bill 2023-039 on second and final reading, second by Alderman Milner. Yes: Cretsinger, Milner, Beck, and Draut. Motion carried 4-0. City Clerk Kincaid gave second reading of Bill No. 2023-039. Alderman Draut moved to approve Bill 2023-039 and enact said bill as ordinance, second by Alderman Milner. Yes: Draut, Milner, Cretsinger, and Beck. Motion carried 4-0. BILL NO. 2023-040 BlueScope PSA City Clerk Robin Kincaid gave first reading of Bill No. 2023-040. Community Development Director Mike Duffy explained that this is part of the small lot subdivision at 40 West, an industrial subdivision that finishes out industrial development withing Horizons and explained further details of the sale. BlueScope will be built on Lot 1. Alderman Milner moved to accept first reading and place Bill 2023-040 on second and final reading, second by Alderman Beck. Yes: Milner, Beck, Cretsinger, and Draut. Motion carried 4-0. 5 BILL NO. 2023-041 Spencer Fane Amend Fees BILL NO. 2023-042 Collective Bargaining FOP RESOLUTION 2023-064 CO1 Amino Brothers City Clerk Robin Kincaid gave first reading of Bill No. 2023-041. City Administrator Brian Koral stated that this is a rate fee change for Joe Bednar and his associates at bifurcated rates as described in the agreement as there are reimbursable and non -reimbursable rates. Mr. Bednar explained the comparisons with other law firms. Questions were asked by the Board and answered by staff and City Attorney Campo. Alderman Milner moved to accept first reading and place Bill 2023-041 on second and final reading, second by Alderman Beck. Yes: Milner, Beck, Draut, and Cretsinger. Motion carried 4-0. City Clerk Kincaid gave second reading of Bill No. 2023-041. Alderman Milner moved to approve Bill 2023-041 and enact said bill as ordinance, second by Alderman Beck. Yes: Milner, Beck, Draut, and Cretsinger. Motion carried 4-0. City Clerk Robin Kincaid gave first reading of Bill No. 2023-042. City Administrator Brian Koral explained that the police voted for representation by the Fraternal Order of Police Lodge 50 about a year ago. City ordinance requires that the members be in two separate bargaining units, one for front line officers that are non - supervisory positions and one for those in supervisory positions. Both agreements are before you this evening for consideration. Alderman Milner moved to accept first reading and place Bill 2023-042 on second and final reading, second by Alderman Cretsinger. Yes: Milner, Cretsinger, Draut, and Beck. Motion carried 4-0. City Clerk Kincaid gave second reading of Bill No. 2023-042. Alderman Cretsinger moved to approve Bill 2023-042 and enact said bill as ordinance, second by Alderman Milner. Yes: Cretsinger, Milner, Beck, and Draut. Motion carried 4-0. City Engineer Travis Hoover reported that this is one of the fill dirt projects. We didn't have enough dirt to begin the work and Amino worked with us on this 40th Street fill and this is the change order for the work. Alderman Beck moved to approve Resolution 2023-064 approving Change Order 1 to the agreement with Amino Brothers, Co., Inc for 2022 40th Street Project, resulting in a revised contract amount of $1,766,967.40 for such purposes, second by Alderman Milner. Yes: Beck, Milner, Draut, and Cretsinger. Motion carried 4-0. 6 RESOLUTION 2023-065 Task Order #3 Olsson City Engineer Travis Hoover stated that this is for the new intersection at Horizons Parkway and Taylor Memorial and it will be combined with the Gateway and Vivion signal project. Alderman Milner moved to approve Resolution 2023-065 approving Task Order #3 with Olsson, Inc., second by Alderman Beck. Yes: Milner, Beck, Cretsinger, and Draut. Motion carried 4-0. RESOLUTION 2023-066 City Administrator Brian Koral remarked that this is the annual Williams & Campo Amend Fee agreement updating the compensation for our City Attorney that includes a 5% increase to his monthly fee. Alderman Beck moved to approve Resolution 2023-066 approving the updated engagement terms with Williams & Campo, P.C., second by Alderman Milner. Yes: Beck, Milner, Cretsinger, and Draut. Motion carried 4-0. RESOLUTION 2023-067 Bill Pay RESOLUTION 2023-068 2023-2024 Annual Budget Alderman Beck moved to approve Resolution 2023-067 authorizing the expenditure of funds for fiscal year 2022-2023 for weeks ending June 9th and June 16th in the amount of $3,179,051.06, second by Alderman Milner. Yes: Beck, Milner, Draut, and Cretsinger. Motion carried 4-0. Finance Director Erika Benitez state that there were no changes to the budget from the workshop session that the Board reviewed the entire budget and if there are any questions, I would be happy to answer them. Alderman Beck moved to approve Resolution 2023-068 adopting the fiscal year 2023-2024 annual budget for the City of Riverside, Missouri, second by Alderman Milner. Yes: Beck, Milner, Cretsinger, and Draut. Motion carried 4-0. CITY ADMINISTRATOR City Administrator Brian Koral reminded the Board of the special meeting next Tuesday, June 27' to wrap up a few items prior to the end of the year. Our next regular meeting would be on Independence Day Holiday, so we are moving that meeting to Wednesday, July 5th and calendar invites will go out as reminders. On July 6th there will be a Reaching Riverside event at Homestead Park that will include the Park Board meeting. An Upstream Story received by email was received from the Northland Regional Chamber of Commerce thanking staff and the City for allowing them the use of the chamber and meeting rooms, opening up early and helping prepare for each meeting, in the interim that NRCC was without space to hold all their monthly meetings. We have accomplished a lot during tonight's meeting, and we look forward to the coming fiscal year. 7 COMMUNITY DEVELOPMENT Director Mike Duffy reported that there is another Steering Committee meeting for the Comprehensive Plan on July 31 s' with the Steering Committee beginning at 5:30 p.m. and then a joint meeting with the Planning Commission and the Park Board following. We are having many Reaching Riverside events prior to that date, to have more information to take to that July 31st meeting. There have been more responses to the survey online as well. ENGINEERING Nothing to report. FINANCE FIRE POLICE PUBLIC WORKS Finance Director Erika Benitez reviewed by PowerPoint presentation for the May 2023 financial status with 91.7% of the year passed. She reviewed many of the numbers and everything is tracking as expected. Expenses were also reviewed, and investments remain strong. Questions from the Board were answered, and they thanked Erika for her work on these reports and the budget. Fire Chief Gordon Fowlston reported that most of the numbers are much like last month, but their training and inspection hours have increased. Response times remain the same and that is a good thing. Police Chief Chris Skinrood explained that everything is pretty much status quo. Truck traffic in Horizons has seen an up -tick and we are working on reducing that issue. There are generally increases in 911 calls when the weather begins to warm up and/or the holidays. Public Works Director Tom Wooddell reminded the Board that trash and recycle services will be delayed one day this week due to the holiday on Monday. Mayor Rose then stated that because of the Juneteenth Holiday and Father's Day both over the weekend and Monday, E.H. Young Park was an absolute mess. Trash was everywhere and it was disgusting how people treated the park and of course, the bathrooms were out of soap, and everything. The Pickleball Courts were loaded. The book "Free Library" needs some maintenance love, hinges are loose and screws coming out. The birds continue to be a problem on the Story Walk monument/signs, they are a mess. And did you see the ground where the cottonwood tree came down? It looked like you were in the mountains and like snow on the ground. Of course, the ants are a big problem down there, a mess, they are everywhere down there in the cracks of the sidewalks, you need to look at that too. It is a lot of work down there, they do a great job, but there are a lot of people there and it is being utilized. and it has just created many problems. If the two large shelter floors could be sprayed out, that would be helpful because they are a sticky mess. Director Wooddell responded that the issues were noted. 8 LEVEE BOARD Nothing to report. MAYOR'S DISCUSSION Mayor Kathy Rose asked City Administrator Koral where staff was on the IRIS issue? He responded that there is a meeting scheduled with the KCATA to work on an agreement. We hope to have an agreement for the Board to consider at the next meeting. The Riverside Chamber had their monthly Mixology at Red X last week and it was absolutely wonderful. Red X had great snacks and it was a great event. Today was the NRCC monthly luncheon and it was Brad Patterson from the KC Zoo, and he discussed that the aquarium will be opening in September. The zoo is a great thing to have in the city and they have accomplished so much there, at the Kansas City Zoo. Mark your calendars for the July 12th meeting here at City Hall to discuss the World Cup. BOARD OF ALDERMEN Alderman Draut — Hope all the fathers out there had a good Father's Day and that everyone has a great summer. I enjoyed the Reaching Riverside event. Alderman Beck — I feel the same about all the Aldermen Milner reported. Alderman Cretsinger — I am excited to hear more about the transportation for our city. Also, I am excited about the future of our city and the passing of the compensation plan tonight looking at the success of our City. Happy Pride Month.
