AN ORDINANCE APPROVING A 2023 SIDE LETTER AGREEMENT WITH THE
FRATERNAL ORDER OF POLICE, WEST CENTRAL MISSOURI REGIONAL
LODGE 50.
BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF RIVERSIDE,
MISSOURI, as follows:
Section 1. That the 2023 Side Letter Agreement by and between the City of Riverside and
the Fraternal Order of Police, West Central Missouri Regional Lodge 50, attached
hereto and incorporated herein, is approved, and the Mayor is authorized to
execute the same on behalf of the City.
Section 2. That this Ordinance shall be in full force and effect from and after its passage.

APPROVED by a majority of the Board of ldermen and APPROVED by the Mayor of the

Shift Bidding
WHEREAS the City of Riverside, Missouri ("the City") and Lodge No. 50 of the Fraternal Order of
Police ("the Union") are parties to a collective bargaining agreement ("CBA") covering sworn law
enforcement personnel in two separate supervisory and non-supervisory bargaining units; and
WHEREAS the 2023-2026 labor agreements for each of the bargaining units include annual shift
bidding provisions; and
WHEREAS both of the labor agreements specify that "No officer shall serve more than three
consecutive years on either night or day shifts"; and
WHEREAS the bargaining units are now participating in shift bidding for 2024; and
WHEREAS multiple bargaining unit members have been on either day or night shifts for three or
more consecutive years; and
WHEREAS the Lodge filed a grievance on October 26, 2023, contesting application of the three-
year limit to the current bid; and
WHEREAS the parties have determined that there was a misunderstanding during contract
negotiations as to whether the three consecutive year limit would begin to run at the start of the
2023 labor agreements or would instead count all consecutive time already served on any
employee's current shift; and
WHEREAS the parties wish to resolve this matter on a cooperative and mutually agreeable basis,
without the need to resort to the contractual grievance resolution process;
NOW THEREFORE, the parties agree as follows:
1. The parties understand that the "three consecutive year" limit refers to cumulative
consecutive time spent,and does not re-start upon ratification of a new labor agreement.
2. Due to the misunderstanding referenced above, the City agrees that it will not enforce
the three consecutive year limit until the bid that takes place in October of 2025,for 2026
work assignments.
3. During the October 2025 shift bid, the City will identify all Officers, Corporals and
Sergeants who have worked either day or night shifts for three or more consecutive years.
That group of Officers, Corporals and Sergeants will then bid in seniority order for
positions that meet the requirement for them to move to the opposite schedule. If any
Officer, Corporal or Sergeant in this group submits a non-compliant bid, management
shall ignore the bid and assign the Officer, Corporal or Sergeant to any available compliant
position, at its discretion.
4. Officers, Corporals and Sergeants who have not reached or exceeded the three-year
same-shift limit at the time of the October 2025 shift bid will not be eligible to submit bids
in October of 2025 until after all Officers, Corporals and Sergeants who are required to
move to an opposite shift have been placed in compliant positions. Once that is
completed, the remaining Officers, Corporals and Sergeants will participate in ordinary
seniority-based bidding for whatever positions remain available.
5. The Union will not submit, and the City shall not be required to process, any grievance
challenging the above procedure or any effects resulting from application of the above
procedure.
6. Shift bidding shall return to the normal procedure in October of 2026,with the three-year
limit remaining in effect.
7. This Settlement Agreement fully resolves all issues raised in the grievance filed on
October 26, 2023.
8. This Settlement Agreement shall not establish a precedent with respect to any matter
other than the specific issues described herein and shall not be presented in evidence in
connection with any other dispute.
9. This Settlement Agreement shall not be construed to change the meaning of the labor
agreements or to create any precedent requiring any future grace periods.
