HomeMy WebLinkAbout2023-12-19 Regular Meeting Minutes MINUTES REGULAR MEETING BOARD OF ALDERMEN RIVERSIDE, MISSOURI Tuesday, December 19, 2023 5:30 p.m. The Board of Aldermen for the City of Riverside, Missouri, met in regular session in the Aldermen Chambers at 2950 NW Vivion Road, Riverside, Missouri, on Tuesday, December 19, 2023. Mayor Rose called the meeting to order at 5:35 p.m. Those in attendance were, Mayor Kathy Rose, Aldermen Jill Beck, Dawn Cockrell, Nathan Cretsinger (joined by Zoom at 5:45 pm), Jason Draut, Rob Milner, and Steve Palma. Also present were City Administrator Brian Koral, City Clerk Robin Kincaid, HR Manager Amy Strough, Fire Chief Gordon Fowlston, Assistant Fire Chief Jason Snarr, Community Development Director Mike Duffy, and City Attorney Paul Campo. MOTION TO ENTER INTO Alderman Milner moved to enter closed session pursuant to CLOSED @ 5:36 P.M. RSMo 610.021 (1) Legal Action and litigation, RSMo 610.021 (2) Leasing, Purchase, or sale of real estate, RSMo 610.021(3) Hiring, firing, disciplining, or promoting a particular employee, when personal information about the employee is discussed, and RSMo 610.021 (13) Individually identifiable personnel records, performance ratings or records pertaining to employee or applicant for employment, second by Alderman Cockrell. Yes: Milner, Cockrell, Draut, Palma, and Beck. Motion carried 5-0. MOTION TO ADJOURN Alderman Beck moved at 6:40 p.m. to adjourn closed session CLOSED @ 6:40 P.M. with action taken, second by Alderman Draut. Yes: Beck, Draut, Cockrell, and Palma. Motion carried 4-0. REGULAR SESSION Mayor Pro Tem Jill Beck called the Regular Session Meeting to order at 7:02 p.m. She also announced that Bill 2023-082 and Bill 2023-083 were to be pulled from the agenda for this evening. Those in attendance were Mayor Pro Tem Jill Beck, Mayor Kathy Rose (joined meeting at 7:20 pm), Aldermen Dawn Cockrell, Jason Draut, and Steve Palma. Alderman Nathan Cretsinger and Alderman Rob Milner were absent for Open Session. Also present were City Administrator Brian Koral, City Clerk Robin Kincaid, Public Works Director Tom Wooddell, Police Chief Chris Skinrood, Community Development Director Mike Duffy, Fire Chief Gordon Fowlston, HR Manager Amy Strough, City Engineer Travis Hoover, Capital Projects /Parks Manager Noel Challis Bennion, Finance Director Erika Benitez, City Planner Sarah Wagner, Firefighter Adam Ellis, Assistant Fire Chief Jason Snarr, Captain Jeff 1 Hendrix, Lieutenant Deven Johnson, Firefighters Dan Myer and Kelly Gates, City Attorney Paul Campo, and Special Counsel Joe Bednar. PLEDGE OF ALLEGIANCE Mayor Pro Tern Jill Beck led the Pledge of Allegiance. PUBLIC COMMENT None. AUDIT REPORT Dustin Opatz, Manager for BerganKDV presented the June 30, 2023 final audit report to the Mayor and Board of Aldermen. PowerPoint slides for the Independent Auditor's Report, Government Audit Standards Report and Single Audit, and charts showing fund balances of revenues and expenditures were shared. Opatz answered questions from the Board. CONSENT AGENDA Alderman Cockrell moved to approve the consent agenda as presented, second by Alderman Palma. Yes: Cockrell, Palma, Beck, and Draut. Motion carried 4-0. MINUTES OF 12-05-2023 Alderman Cockrell moved to approve the minutes of the December 05, 2023, meeting, second by Alderman Palma. Yes: Cockrell, Palma, Beck, and Draut. Motion carried 4-0. COURT REPORT Alderman Cockrell moved to approve the court report for the month of November 2023, second by Alderman Palma. Yes: Cockrell, Palma, Beck, and Draut. Motion carried 4-0. RESOLUTION 2023-168 Alderman Cockrell moved to approve Resolution 2023-168 Bill Pay authorizing the expenditure of funds for fiscal year 2023-2024 for weeks ending December 8th and December 15th in the amount of $1,384,862.55, second by Alderman Palma. Yes: Cockrell, Palma, Beck, and Draut. Motion carried 4-0. RESOLUTION 2023-169 Alderman Cockrell moved to approve Resolution 2023-169 Trail Easement accepting a trail easement from Riverside Townhouses, Inc., second by Alderman Palma. Yes: Cockrell, Palma, Beck, and Draut. Motion carried 4-0. RESOLUTION 2023-170 Alderman Cockrell moved to approve Resolution 2023-170 Patek &Associates Agreement approving and authorizing an agreement by and between the City of Riverside, Missouri and Patek and Associates, LLC, regarding consulting and lobbying services, second by Alderman Palma. Yes: Cockrell, Palma, Beck, and Draut. Motion carried 4-0. 2 RESOLUTION 2023-171 Alderman Cockrell moved to approve Resolution 2023-171 Amend WSKF, Inc Agreement approving an amendment to the agreement with WSKF, Inc. for architectural services resulting in a revised agreement amount of $310,636.00 for such purposes, second by Alderman Palma. Yes: Cockrell, Palma, Beck, and Draut. Motion carried 4-0. RESOLUTION 2023-172 Alderman Cockrell moved to approve Resolution 2023-172 Crossland CO 18 approving change order eighteen to the agreement with Crossland Construction Company, Inc. for additions & renovations Riverside Public Safety resulting in a revised contract amount of $4,962,581.46 for such purposes, second by Alderman Palma. Yes: Cockrell, Palma, Beck, and Draut. Motion carried 4-0. REGULAR AGENDA PUBLIC HEARING Mayor Pro Tern Beck opened the public hearing at 7:09 p.m. Rezoning Property-LiveNation to consider rezoning for property generally located south of NW 39th Street, west of NW Horizons Parkway, north of Interstate 635 and e4ast of the Riverside Quindaro-Bend Levee, in the City of Riverside, Missouri. City Planner Sarah Wagner explained that this is a request for rezoning approximately 170 acres on the west side of Horizons. To rezone from industrial to an entertainment district for an amphitheater. Mayor Pro Tem Beck asked if there were any further questions or comments and hearing none, closed the public hearing at 7:11 p.m. BILL NO. 2023-074 City Clerk Robin Kincaid gave first reading of Bill No. 2023-074. Rezoning Property-LiveNation Alderman Cockrell moved to accept first reading and place Bill 2023-074 and final reading, second by Alderman Draut. Yes: Cockrell, Draut, Palma, and Beck. Motion carried 4-0. City Clerk Kincaid gave second reading of Bill No. 2023-074. Alderman Draut moved to approve Bill 2023-074 and enact said bill as ordinance, second by Alderman Palma. Yes: Draut, Palma, Cockrell, and Beck. Motion carried 4-0. PUBLIC HEARING Mayor Pro Tem Beck opened the public hearing at 7:13 p.m. Prelim & Final Dev. Plan to consider a preliminary development plan for property generally located south of NW 39th Street, west of NW Horizons Parkway, north of Interstate 635 and east of the Riverside Quindaro-Bend Levee, in the City of Riverside, Missouri. City Planner Sarah Wagner explained that this request is for a preliminary and final development plan for LiveNation amphitheater project that has been worked on for quite some time. This was unanimously approved by the Planning & Zoning 3 Commission at their meeting last week. Consultant Gretchen Blain from Generator Studios gave an overview of the project and showed pictures of the proposed project. Mayor Kathy Rose asked if there were any further questions or comments and hearing none, closed the public hearing at 7:25 p.m. BILL NO. 2023-075 City Clerk Robin Kincaid gave first reading of Bill No. 2023-075. Prelim. & Final Dev. Plan Alderman Draut moved to accept first reading and place Bill 2023-075 and final reading, second by Alderman Cockrell. Yes: Draut, Cockrell, Beck, and Palma. Motion carried 4-0. City Clerk Kincaid gave second reading of Bill No. 2023-075. Alderman Beck moved to approve Bill 2023-075 and enact said bill as ordinance, second by Alderman Palma. Yes: Beck, Palma, Draut, and Cockrell. Motion carried 4-0. PUBLIC HEARING Mayor Kathy Rose opened the public hearing at 7:27 p.m. Rezoning Property- Gunter to consider rezoning for property generally located south of Missouri Highway 9, west of NW Horizons Parkway, north of the BNSF Railroad, and east of 5654 NW River Park Drive, in the City of Riverside, Missouri. City Planner Sarah Wagner stated that this request is for rezoning property for Gunter Construction. This is approximately fourteen acres, and they are requesting a change from GP-I, General Planned Industrial to PD, Planned Development for industrial development and they will be required to make the buildings very similar to the current development in the area. Mayor Kathy Rose asked if there were any further questions or comments and hearing none, closed the public hearing at 7:28 p.m. BILL NO. 2023-076 City Clerk Robin Kincaid gave first reading of Bill No. 2023-076. Rezoning Property-Gunter Alderman Cockrell moved to accept first reading and place Bill 2023-076 and final reading, second by Alderman Draut. Yes: Cockrell, Draut, Beck, and Palma. Motion carried 4-0. City Clerk Kincaid gave second reading of Bill No. 2023-076. Alderman Palma moved to approve Bill 2023-076 and enact said bill as ordinance, second by Alderman Beck. Yes: Palma, Beck, Cockrell, and Draut. Motion carried 4-0. PUBLIC HEARING Mayor Kathy Rose opened the public hearing at 7:30 p.m. Rezoning Property- Gunter to consider a preliminary development plan for property generally located south of Missouri Highway 9, west of NW Horizons Parkway, north of the BNSF Railroad, and east of 5654 NW River Park Drive, in the City of Riverside, Missouri. City Planner Sarah Wagner stated that this request is for property Gunter Construction will develop. This is approximately fourteen acres, and they are proposing three buildings on the property, the first just over 118,000 square feet and future phases for the other 4 two. The building will be similar and consistent to those that are in the Horizons area. Mayor Kathy Rose asked if there were any further questions or comments and hearing none, closed the public hearing at 7:33 p.m. BILL NO. 2023-077 City Clerk Robin Kincaid gave first reading of Bill No. 2023-077. Prelim & Final Dev. Plan Alderman Palma moved to accept first reading and place Bill 2023-077 and final reading, second by Alderman Beck. Yes: Palma, Beck, Draut, and Cockrell. Motion carried 4-0. City Clerk Kincaid gave second reading of Bill No. 2023-077. Alderman Draut moved to approve Bill 2023-077 and enact said bill as ordinance, second by Alderman Cockrell. Yes: Draut, Cockrell, Palma, and Beck. Motion carried 4-0. BILL NO. 2023-078 City Clerk Robin Kincaid gave first reading of Bill No. 2023-078. FOP 2023 Side Letter Police Chief Chris Skinrood stated that this is a modification to the original contract negotiations. There were no questions from the Board. Alderman Beck moved to accept first reading and place Bill 2023- 078 on second and final reading, second by Alderman Draut. Yes: Beck, Draut, Cockrell, and Palma. Motion carried 4-0. City Clerk Kincaid gave second reading of Bill No. 2023-078. Alderman Palma moved to approve Bill 2023-078 and enact said bill as ordinance, second by Alderman Cockrell. Yes: Palma, Cockrell, Beck, and Draut. Motion carried 4-0. BILL NO. 2023-079 City Clerk Robin Kincaid gave first reading of Bill No. 2023-079. KCATA Agreement City Administrator Brian Koral reported that this is a three-month extension to the agreement in place for the IRIS service and this will continue with the same rates through March 2024. Alderman Draut moved to accept first reading and place Bill 2023- 079 on second and final reading, second by Alderman Cockrell. Yes: Draut, Cockrell, Palma, and Beck. Motion carried 4-0. City Clerk Kincaid gave second reading of Bill No. 2023-079. Alderman Cockrell moved to approve Bill 2023-079 and enact said bill as ordinance, second by Alderman Draut. Yes: Cockrell, Draut, Beck, and Palma. Motion carried 4-0. BILL NO. 2023-080 City Clerk Robin Kincaid gave first reading of Bill No. 2023-080. Revised Employee Handbook City Administrator Brian Koral explained that this project was discussed, and changes reviewed during the work session at the last meeting. Thank you to HR Manager Amy Strough and the leadership team for their work on this project. 5 Alderman Palma moved to accept first reading and place Bill 2023-080 on second and final reading, second by Alderman Beck. Yes: Palma, Beck, Draut, and Cockrell. Motion carried 4-0. City Clerk Kincaid gave second reading of Bill No. 2023-080. BILL NO. 2023-081 City Clerk Robin Kincaid gave first reading of Bill No. 2023-081. Public Works Hire - Kia Alderman Cockrell moved to accept first reading and place Bill 2023-081 on second and final reading, second by Alderman Draut. Yes: Cockrell, Draut, Beck, and Palma. Motion carried 4-0. City Clerk Kincaid gave second reading of Bill No. 2023-081. Alderman Beck moved to approve Bill 2023-081 and enact said bill as ordinance, second by Alderman Palma. Yes: Beck, Palma, Draut, and Cockrell. Motion carried 4-0. Mayor Rose noted again that Bill No. 2023-082 and Bill No. 2023- 083 are pulled from the agenda this evening. RESOLUTION 2023-173 City Administrator Koral and Fire Chief Gordon Fowlston showed Fire Ladder Truck Purchase slides explaining the Public Safety Sales Tax and priorities for the use of the tax dollars. Modernizing the fire trucks that are currently in use and the truck ordered and the approval of the price increase for the ladder truck that is coming after the first of the year. Alderman Palma moved to approve Resolution 2023-173 authorizing the purchase of a Fire Rescue Aerial Platform (Ladder) Truck, second by Alderman Beck. Yes: Palma, Beck, Cockrell, and Draut. Motion carried 4-0. CITY ADMINISTRATOR City Administrator Brian Koral stated that we are having the last meeting of a really great year for Riverside and looking forward to a wonderful 2024. He then shared an Upstream from Ordinary Story, an email received from Michelle Ford with the YMCA, thanking the City for the Community Center partnership and complimenting the great things that Lori, Amy, and Janiece are doing for the programs there that help the Riverside residents. Happy Holidays and Merry Christmas. COMMUNITY DEVELOPMENT Nothing to report. ENGINEERING City Engineer Travis Hoover explained that with the recent purchase of the Karen Boulevard property demolition is needed. We will go out to bid for that work in the next few weeks and bring that to you for consideration. Travis then announced the 2024 6 Asphalt Overlay Project going out to bid soon and he showed a slide of the focus area for said project. Capital Projects/Parks Manager Noel Challis Bennion then introduced the Homestead Park Improvements Proposal that was selected by the Park Board. They met and reviewed all feedback received from a Reaching Riverside event held in the Homestead area. PowerPoint slides were shared showing details of the equipment and the budget. Bennion explained the receipt of a $40,000 Scrap Tire Grant for the playground surface and the request to increase the project funds by that amount for the total available funds, for a contingency availability. Approval of this quote may come before the Board at the next meeting. FINANCE Finance Director Erika Benitez shared a PowerPoint presentation showing that we are at 41.7% through the fiscal year and right on pace with the budget. Benitez explained some Revenue, Expenditure, and Investment Fund details. FIRE Fire Chief Gordon Fowlston thanked the Board of Aldermen again for their approval of the resolution approving the Ladder Truck purchase. He reported that Santa Claus was a success along with the Santa Tracker. There were 500-600 following the app at any given time. There were many people outside of the Riverside that were parked along the route to see Santa as well. The Department is already looking at ideas to add to the event for next year. Fowlston then reviewed the monthly report numbers for November 2023. POLICE Police Chief Chris Skinrood reviewed the November reports and noted that crashes had increased along with citations, all other numbers are comparable to last month. PUBLIC WORKS Nothing to report. LEVEE BOARD City Engineer Travis Hoover reported that the annual levee inspection and our levee is far better than any other in the area, it is well taken care of. We are very busy with reviews for many projects the Levee Board is involved in. Hoover then answered questions. MAYOR'S DISCUSSION Mayor Kathy Rose stated that she has asked staff to review the City's Blight Program and bring a proposal to the Board for an improved process in a timelier manner. We are going to be looking at Tourism Grants, working with the new Riverside Chamber Director, and a possible grant for the Carved event. Today was my last Christmas event as Chair of the Northland Chamber, my term will be over at the end of the year. It was a very exciting time to serve the 1,500 membership for them. I am really proud what the NRCC has done for Northland. It has been a great experience for me and for the City. The Service Luncheon was a wonderful opportunity for us to appreciate and value our employees. Thanks 7 to Amy and Brian for putting that together to create a welcoming culture for our staff. Alderman Draut— I was able to attend the Riverside Awards Ceremony and it was awesome to see those that have worked here for 20, 10, and 5 years. We must be doing things right here. It was great to hear how they love working for Riverside. I also wanted to mention the City Christmas Party at Argosy that was wonderful, and my kids had a blast! One request I have, a minor change, to put Santa first before face painting, so the Santa pictures come prior to face paint. Also, asking for thoughts and prayers for Alderman Milner with some concerns for a member of his family.
