R-2024-053 A RESOLUTION APPROVING TASK ORDER NUMBER 4 WITH WATERS EDGE AQUATIC DESIGN BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF RIVERSIDE, MISSOURI AS FOLLOWS: THAT the Riverside Board of Aldermen hereby approves Task Order Number 4 by and between the City of Riverside and Waters Edge Aquatic Design, in substantially the form attached hereto, and the Mayor is authorized to execute the Task Order Number 4 on behalf of the City; and FURTHER THAT the Mayor, the City Administrator and other appropriate City officials are hereby authorized to take any and all actions as may be deemed necessary or convenient to carry out and comply with the intent of this Resolution and to execute and deliver for and on behalf of the City all certificates, instruments, agreements and other documents, as may be necessary or convenient to perform all matters herein authorized; and FURTHER THAT this Resolution shall be in full force and effect from and after its passage and approval. Rose ATTEST: • Robin Kincaid, City Clerk Task Order Number 4 For Engineering Services This Task Order is entered into as of the 16th day of April, 2024 (the "Effective Date"), by and between Waters Edge Aquatic Design, LLC, organized in the state of Kansas, having an office at 1153 Southwest Blvd Ste. 202, Kansas City,KS 66103 ("Waters Edge")and the City of Riverside, Missouri, a Missouri municipal corporation (the"City"). WHEREAS, the City has engaged Waters Edge to provide engineering services pursuant to the Agreement for Engineering Services dated October 19, 2021, pursuant to which the City may task Waters Edge to provide additional professional engineering services on a project-specific basis by acknowledging a separate Task Order. NOW, THEREFORE, in consideration of the promises and mutual covenants between the parties and for other good and valuable consideration the receipt of which is acknowledged by the parties, they agree as follows: 1. Incorporation of Base Agreement. This Task Order is subject to all terms and conditions contained in the Agreement for Engineering Services dated October 19, 2021, that are not inconsistent with the specific terms contained herein, and the Agreement for Engineering Services dated October 19, 2021, between the parties is incorporated herein as if set forth in full by this reference. 2. Scope of Services. The Scope of Services pursuant to this Task Order are as contained in Exhibit A. 3. Term. Waters Edge shall begin work pursuant to this Task Order No. 4 upon its Effective Date and shall continue until this initial scope for the Municipal Aquatics Improvements- 222-087 ("Project") is completed as evidenced by final acceptance of the Project by the City. 4. Compensation.Compensation shall be in accordance with the attached schedule(see Exhibit B). 5. Project Schedule. By: Name: rian Kor Title: City Administrator Dated: I% 0.2)P'‘'i 2 Exhibit A to Task Order 4 Scope of Services for Municipal Aquatics Improvements- 222-087 PROJECT DESCRIPTION The City of Riverside has awarded the contract for the Riverside Pool & Restroom Improvements to Royal Construction Services, LLC ("Royal"). The City has also received a Land Water and Conservation Fund (LWCF) grant through the Missouri Department of Natural Resources (MoDNR) for this project. This project will consist of all necessary activities to provide construction administration for this project by Waters Edge Aquatic Design. Construction administration by SFS for pool bathhouse and community center restrooms is included in Task Order 3. SCOPE OF SERVICES • Project `lanagement—The Consultant will regularly communicate with City staff to provide progress updates and requested deliverables. • Construction Administration o Provide digital addenda set of drawings for construction. o Provide on-site observation and inspection of construction. o Assist with selection of color palette for overall improvements. o Assist with evaluating splash pad submittals from Royal and selection of the equipment that meets specifications. o Assist in evaluating materials submitted by Royal for BABAA compliance. o Review and approve submittals and shop drawings by Royal. o Review 3`d-party inspection information received from Royal. o All activities identified as engineer participation in project manual. o Participate in paragraph Q, R, & S of Section 01 70 00. • Meetings/Conference Calls o Participate in regularly scheduled meetings with Royal and City,including: • Monthly progress meetings at the project site • Weekly/biweekly brief virtual meetings • Proiect Schedule o Notice to Proceed for Royal in April 2024. o Substantial Completion by Royal 05/02/2025 o Final Completion by Royal 05/23/25 o Winterization by Royal—end of pool season 2025 1 Exhibit B to Task Order 4 Fee Proposal for Municipal Aquatics Improvements- 222-087 FEE SCHEDULE • General Construction Administration $38,049.00 o Communication, RFI's, Clarifications,etc... • Construction Site Visits $20,995.00 • Meetings/Conference Calls: $12,960.00 Total: $72,004.00
