HomeMy WebLinkAbout2015 Approving Temporary Occupancy Project of Line Creek Trail by MoDOT BILL NO. 2024-044 ORDINANCE NO. 2015 AN ORDINANCE APPROVING A TEMPORARY OCCUPANCY PROJECT OF LINE CREEK TRAIL BY THE MISSOURI DEPARTMENT OF TRANSPORTATION BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF RIVERSIDE, MISSOURI AS FOLLOWS: SECTION 1 — APPROVAL. That the Riverside Board of Aldermen hereby approves the Determination of Section 4(f) Exception as a Temporary Occupancy Project, in substantially the form attached hereto, for the Missouri Department of Transportation. The Mayor is authorized to execute said document on the City's behalf. SECTION 2—GRANT OF FURTHER AUTHORITY. That the Mayor, the City Administrator, and other appropriate City officials are hereby authorized to take any and all actions as may be deemed necessary or convenient to carry out and comply with the intent of this Ordinance and to execute and deliver for and on behalf of the City all certificates, instruments, agreements and other documents, as may be necessary or convenient to perform all matters herein authorized. SECTION 3—EFFECTIVE DATE. That this Ordinance shall be in full force and effect from and after its passage and approval. SECTION 4(f) PROPERTY Describe the Section 4(f) property including the property boundary and the specific features that qualify the property for protection under Section 4(f).(23CFR§774.11 and 23CFR§774.17)If there is a management plan it may be necessary to refer to it to obtain the property boundary and features. Attach a location map and if needed, photographs to further depict property characteristics and conditions. Line Creek Trail is an 8.4-miles-long public trail located in Kansas City, Missouri between North Platte Purchase Drive and MO 9. The trail is owned by both the City of Kansas City and the City of Riverside and is managed each City within their city limits. The trail serves to connect multiple City recreation areas including E.H. Young Riverfront Park, Renner Brenner Park, Homestead Park, and the Line Creek Community Center. The primary use of this trail includes running, walking, biking, and hiking. Additionally, a Fixit bicycle service station is located along the trail, which provides bike services, including an air pump and basic tools for repairs. The segment of the Line Creek Trail that will be impacted by project construction is located directly under bridge A2029 (MO 9), over Line Creek. Line Creek Trail is located along the western bank of Line Creek. Please see the attached Location Map and Plan Sheet for the project location and details. TEMPORARY OCCUPANCY CONDITIONS Read each statement below and check the corresponding box if the statement is true for this project. All boxes must be checked for the project use to meet the conditions of a Temporary Occupancy. 1 Use of the Section 4(f) property will be temporary, less than the time needed to construct the project(less than the overall duration of the project by at least 1 day). ✓ 2. The project will not require a change in ownership of the Section 4(f) property. ✓ 3. The scope of work must be minor, i.e., both the nature and magnitude of the changes to the Section 4(f) property are minimal. ✓ Describe the scope of work and how it will impact the Section 4(f) property: MoDOT Job No.J4S3498 involves the rehabilitation of Bridge A2029 on MO 9, directly above Line Creek and the Line Creek Trail. The bridge rehabilitation is intended to provide structural and safety improvements, including a full redeck, guardrail replacements,pavement replacement,and the installation of a rock blanket that is flush with the ground line along the wing-walls and spill slopes. In order to ensure the safety of the trail users during project construction,periodic trail closures will be required while the deck removal is occurring and the stay-in-place(SIP)forms are being set over the trail. 4. There are no anticipated permanent adverse physical impacts, nor will there be complete interference with the protected activities, features, or attributes of the property,on either a temporary or permanent basis. ✓ Explain how adverse physical impacts and interference with protected activities, features, or attributes of the Section 4(f) property will be prevented: The project will not require any new right of way or easements from the Line Creek Trail property.However,the trail will be closed in the vicinity of the bridge to restrict pedestrians and bicyclists from entering the trail under the bridge while the deck removal is occurring and the SIP forms are being set over the trail.In order to prevent trail users from entering the area while construction is occurring over the trail,ADA compliant movable barricades and signs stating "Sidewalk closed ahead" or "Sidewalk Closed" will be placed before the construction zone.In addition to movable barricades and signs,a flagging operation may be utilized within the construction zone to allow trail users to enter the project area when it is safe to cross under the bridge.The duration of the trail closure will span three to four periods of construction with approximately three days of trail closure at a time.The total amount of time that the trail will be closed will equal approximately 12 days.The trail will be opened up to the public in the evenings when construction work is not taking place. 5 The land being used will be fully restored, i.e.,the property will be returned to a condition that is at least as good as that which existed prior to the project. ✓ Describe how the land will be restored: This project will not require any new right of way or easements from the Line Creek Trail property. However, a closure of the trail will be required due to safety concerns. MoDOT will ensure that the Line Creek Trail is protected by marking the trail as Do Not Disturb (DND) on the plan sheets for this project. The Contractor will be responsible for any trail damages that occur during project construction. 6.
