HomeMy WebLinkAbout2000-11-07. , Minutes of Regular Meeting of Board of Aldermen of City of Riverside, Missouri November 7, 2000 A regular meeting of the Board of Aldermen of the City of Riverside, Missouri was held in the City Hall of Riverside, Missouri on November 7, 2000. ' Those in attendance were Mayor Betty Burch, Aldermen Pam Darata, George Flaws, Ron Super, Ray Beard, Rochelle I.egaard and Andy Morse. Also, present was Louise Rusick, City Clerk, David Blackburn, City Administrator, Steve Crystal, City Attorney and Deborah Polk, City Attorney's office. Minutes, Sept. 26, 2000 Alderman Beard moved that the minutes of September 26, Approved 2000 be approved, seconded by Alderman Flaws, the vote was: Aye: Aldermen Beard, Morse, Super, Flaws, Darata and Legaard. Motion carries. Minutes, Oct. 17, 2000 Alderman Flaws moved that the minutes of October 17, 2000 Approved be approved, seconded by Aklermau Darata, the vote was: Aye: Aldermen Super, Flaws, Darata, Legaard and Beard. Abstain: Alderman Morse. Motion carries. Minutes, Nov. 2, 2000 Alderman Beard moved that the minutes of November 2, Approved 2000 be approved as corrected, seconded by Alderman Morse, the vote was: Aye: Aldermen Super, Flaws, Darata, Legaard, Beard and. Morse. Motion carries. Approval for Building Alderman Legsard moved to approve a building permit for Permit for Richard vacating a portion of the original street so it can be built Ulrich upon, seconded by Alderman Beard, the vote was: Aye: Aldermen Morse, Super, Flaws, Darata, Legaard and Beard. Motion carries. 1 T Approval for Building Alderman Morse moved to approve a building permit for Permit for Wm. Welliver, William Welliver, 3007 NW Florence, Riverside, Mo. to build 3007 NW Florence a detached garage with a concrete driveway, seconded by Alderman Beard, the vote was: Aye: Aldermen Super, Flaws, Darata, Legaard, Beard and Morse. Motion carries. Visitor Comment, Dwayne Hurlburt, 5005 NW Merrimac, Riverside, Mo. Dwayne Hurlburt mentioned a problem with the foundation drain that ran under the sidewalk He said the foundation drain at the end of Merrimac was disrupted when sod was laid. He said a drainage pipe was supposed to be installed and was not. Dick Winner, City Engineer spoke with David Blackburn , City Administrator and Dick said he had spoken with the contractor to fie this problem. Donna Wilson, Ms. Wilson, Attorney with Polsinelli, Shelton, Welte Polsinelli, Shelton, Welte commented on the request for approval of a Special Use Permit by Sprint PCS for an 80-foot monopole tower at 4101 NW Tullison Rd. She said there are eaisting utilities at the location and the tower would not discourage Industrial use. Also, she stated there would be no impact on property values with the uses that are there now. She said two (2) other carriers would like to co locate on the tower and the tower would have to be extended. There will be an 8-foot wooden fence around the tower. Mayor Burch said the Municipal Court Report for October was received. Request for a Special Alderman Beard moved to approve a Special Use Permit, Use Permit for Sprint PCS with conditions, for an 80-foot monopole tower for Sprint (with conditions) PCS, at 4101 NW TuWson Rd. (1) no objective to having Approved other carriers co locate, subject to submitting a Special Use Permit for approval (2) landscaping (3) the potential for other carriers to co locate, the base structure must be sound (4) paved access to the tower. This motion seconded by Alderman Morse, the vote was: Aye: Aldermen Morse, Super, Flaws, Darata, Legaard and Beard. Motion carries. City Admin. Comments David explained the changes at the New City Hall in the Court area. Cost not yet available. 2 f Bill No. 2000-89 Alderman Morse moved to place Bill No. 2000-89 on its first Supplemental Agreement reading, said Bill authorizing the Mayor to enter into No. 5, Bucher, Willis, & Supplemental Agreement No. 5 with Bucher, Willis and Ratliff Ratliff (amending paragraph 3) for construction, seconded by Alderman Beard, the vote was: Aye: Aldermen Super, Flaws, Darata, Legaard, Beard and Morse. Motion carries. Ordinance No. 2000-89 Alderman Beard moved to place Bill No. 2000-89 on its 2000-89 Approved second reading, and upon passage of same become Ordinance No. 2000-89, seconded by Alderman Morse, the vote was• Aye: Aldermen Flaws, Darata, Legaard, Beard, Morse and Super. Motion carries. Bill No. 2000-90 Alderman Super moved to place Bill No. 2000-90 on its first Contract with reading, said Bill subject to the City Attorney's review, Comanche Const. Inc. comment and approval, authorizing the Mayor to enter into a contract with Comanche Construction, Inc. to provide construction services for NW Gateway Road Bridge Improvements over Line Creek,-and setting a contract amount for $435,054.25, seconded by Alderman Beard, the vote was: Aye: Aldermen Darata, Legaard, Beard, Morse, Super and Flaws. Motion carries. Ordmance No. 2000-90 Alderman Morse moved to place Bill No. 2000-90 on its Approved second reading, and upon passage of same become Ordinance No. 2000-90, seconded by Alderman Beard, the vote was: Ayer Aldermen Legaard, Beard, Morse, Super, Flaws and Darata. Motion carries. Bill No. 2000-91 No action taken. Bill No. 2000-92 No action taken. 3 T Bill No. 2000-93 Alderman Darata moved to place Bill No. 2000-93 on its first Approving a Public reading, said Bill Approving a Public Ways Use Permit and Ways Use Permit agreement with Metricom, Inc., seconded by Alderman & agreement with Beard, the vote was: Metricom Aye: Aldermen Flaws, Darata, Legaard, Beard, Morse and Super. Motion carries. Ordinance. No. 2000-93 Alderman Legaard moved to place Bill No. 2000-93 on its Approved second reading, and upon passage of same become Ordinance No. 2000-93, seconded by Alderman Flaws, the vote was: Aye: Alderman Super, Flaws, Darata, Beard, Legaard and Morse. Motion carries. Bill No. 2000-94 Alderman Super moved to appoint Vivian Smith, a resident Appointing Vivian Smith of Ward I, to a five (5) year term as a member of the Board to Board of Zoning Adj. of Zoning Adjustment, seconded by Alderman Darata, the vote was: Aye: Aldermen Morse, Super, Flaws, Darata, Legaard and Beard. Motion carries. Ordinance No. 2000-94 Alderman Morse moved to place Bill No. 2000-94 on its Approved second reading, and upon passage of same become Ordinance No. 2000-94, seconded by Alderman Super, the vote was: Approval for "no changes" on NW 50'" St. original design, and "no amend- ments", other than what was agreed too Aye: Aldermen Super, Flaws, Darata, Legaard, Beard and Morse. Motion carries. Alderman Beard moved to not change the original design of N.W. 50"' St. and no amendments, other than what was agreed too, seconded by Alderman Legaard, the vote was: Aye: Aldermen Super, Flaws, Beard, Darata and Legaard. No: Alderman Morse. Recess A brief recess was called at 8:30 p.m. 4 1 Reconvene Aldermen's Comments Approval for City Admin. to obtain RFP's for the NW Gateway Project (Jct. I~iW Gtwy to I-29 All Aldermen and the Mayor responded to roll call and the meeting reconvened at 8:45 p.m. Alderman Legaard said some pieces of sod were left out on NW Strathbury. Alderman Morse moved to approve David Blackburn to request proposals on the NW Gateway project (Junction NW Gateway to I-29), seconded by Alderman Beard, the vote was: Aye:. Aldermen Beard, Darata, Super, Flaws, Morse and Legaard. Motion carries. Alderman Beard will look at the trees that appear scruffy beside K.C. Kids near the creek. Alderman Beard asked if the drain in front of 5005 NW Merrimac was approved at the time of sidewalk construction. Alderman Beard mentioned the fast traffic at Briarcliff and West Platte and drivers not stopping at the stop sign before entering onto West Platte. Chief Simpson said he would speak with the Kansas City Mo. Dept. of Public Safety regarding traffic control. The Platte County Economic Development Council is hosting its annual Job Development Awards Luncheon on December 5"' and the City will chose a business in the community for recognition. Motion for Closed Session Alderman Morse moved that the meeting go into closed session pursuant to RSMo 610.021(1) Legal issues RSMo 610.021 (2) RSMo Real Estate (3) 610.021 Personnel Issues with the City Attorney, seconded by Alderman Beard, the voh was: Aye:- Aldermen Super, Morse, Darata, Beard, Legaard and Flaws. Motion carries. Motion for Open Session Alderman Morse moved that the meeting go into open session, seconded by Alderman Darata, the vote was: Aye: Aldermen Super, Morse, Darata, Beard, Legaard and Flaws. 5 T Motion carries.
