HomeMy WebLinkAbout2040 Adding Section 342.070 to the City Code Pertaining to Operation of Motor Vehicles BILL NO. 2024-074 ORDINANCE NO. 2040 AN ORDINANCE ADDING SECTION 342.070 TO THE CITY CODE PERTAINING TO THE OPERATION OF MOTOR VEHICLES WITHOUT AN IGNITION INTERLOCK DEVICE WHEREAS,the City of Riverside,Missouri,seeks to promote public safety and ensure compliance with court-ordered restrictions for individuals required to use ignition interlock devices; and WHEREAS, the Board of Aldermen has determined that additional regulations are necessary to protect residents and visitors of Riverside from individuals circumventing ignition interlock device requirements NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF RIVERSIDE, MISSOURI, AS FOLLOWS: SECTION 1 — AMENDMENT. That Section 342.070 of Chapter 342 of the Code of Ordinances of the City of Riverside, Missouri, is hereby added to read as follows: Section 342.070 Operation of Motor Vehicles Without an Ignition Interlock Device It is unlawful for any person: 1. To operate a motor vehicle without a functioning, certified ignition interlock device when that person has been ordered by a court to equip any vehicle he or she operates with such a device, unless expressly exempted by Section 302.441 RSMo. 2. To request or solicit another person to blow into an ignition interlock device or to start a motor vehicle equipped with the device for the purpose of providing the person so restricted with an operable motor vehicle if the driving privilege of the person making the request is restricted pursuant to this section. 3. To blow into an ignition interlock device or to start a motor vehicle equipped with the device for the purpose of providing an operable motor vehicle to a person who has previously been ordered not to operate a motor vehicle without a functioning ignition interlock device. 4. Knowingly rent, lease, or lend a motor vehicle to a person known to have an interlock order, without such device installed. 5. Fail to notify any person who rents, leases, or lends a motor vehicle to him of the existence of an ignition interlock order. 6. To tamper with or circumvent the operation of an ignition interlock vehicle. 1 SECTION 2 — EFFECTIVE DATE. This ordinance shall be in full force and effect from and after the date of its passage and approval.
