HomeMy WebLinkAbout2009-04-21Minutes of Regular Meeting of Boazd of Aldermen of City of Riverside, Missouri Apri121, 2009 A regulaz meeting of the Board of Aldermen of the City of Riverside, Missouri, was held in the City Hall of Riverside, Missouri, on Apri121, 2009 at 7:00 p.m. Those in attendance were Mayor Kathy Rose, Aldermen Bruns, Darata, Super, Hurt, Fuller and Salyer. Also present were David Blackburn, City Administrator, Mike Duffy, Director of Community Development Jane Henry, Executive Administration Assistant, Louise Rusick, City Clerk, Greg Mills, Duector of Public Safety, Meredith Hauck, Coordinator of Communications and External Affairs and John McClelland, City Attorney. Call to Order Mayor Rose called the meeting to order and Aldermen Bruns, Salyer, Super, Dazata, and Roll Call Hurt and Fuller answered to roll call. Pledge of Allegiance Mayor Rose started the recital of the Pledge of Allegiance with the audience joining in. Public Comments Gary Brenner, 2020 NE Knollbrook, Lee's Summit, Mo spoke to the boazd regazding moving the playground m the park. Gazy said he understands the move of the playground equipment is partly to get it away from the skateboarders and enlarge the pazking azea. Gary said his problem is destroying the pazt of the value of the pazk. There's been several excavations done in the last seventeen yeazs that affected approximately 2,800 square feet and the azea of the playground is 5,000 square feet. The buildings that aze presently in place where they are is because those areas were already excavated. The azea where the gazebo sets was excavated in 1937 by and archeologist from the Smithsonian Institute and in 1954 by Grable and Howazd, University of Missouri. In 1980 the shelter house was excavated by Dr. Walter Burkes and he also excavated where the water features aze in the Smith's back yazd. Gary excavated down the southwest side on Vivion Road 25 yeazs ago. Also, under the gazage at the Smith's home, underneath the monument and the public bathroom Gary's opinion is the area where the pazk equipment is to be moved would need to be professionally excavated first. Thirty years ago the site was 6 acres and in the last 30 years it is down to 1 %: acres. Gail Lundeen, President of the Kansas City Archeology Society at 604 Shoreline Drive, Lee's Summit, Mo said she was present to express the society's concern to move the playground equipment in Renner-Brenner Park. The City of Riverside has many historic Indian sites and the City Hall and Renner Brenner sites are especially important sites. The first azcheologist to excavate the site in the 1930's from the Smithsonian Institute identified the group of people who had once lived here as the Kansas City Hopewell Culture. The archeologist named this culture based on the unique attributes of the artifacts found. The name around this azea is known as the `type site' of this culture which means the artifacts found here are used to judge all subsequent collections for similarities and differences to the Kansas City Hopewell culture. The Kansas City Museum, with the assistance with the Kansas City Archeology Society, also conducted a small excavation and the one the Smithsonian conducted is and only a very small fraction of the land was excavated at the pazk. The greater majority of the site is still preserved underground and any disturbance of the ground destroys valuable information that can be learned. Once disturbed the site is destroyed and cannot be re-examined for artifacts. There is much yet to be learned about the Kansas City Hopewell culture and the Renner- Brenner Park is the prime location for future investigations as very few sites like this still remain. The Kansas City Archeology Society requests the playground equipment not be Mins. 4/21/09 moved and the site be preserved for future scientists to investigate. If this is not possible, they aze asking that an archeologist be hired and a scientific excavation be conducted. Nancy Blue, 606 E. 127's St., Kansas City, Mo. is the Executive Duector of the Heart of America Indian Center and has been in existence for almost 40 years. Ms. Blue represents nafive American's on the Kansas and Missouri side and encompasses a 7 county area. They are concerned their history is being destroyed. If anything else is done to the site, their children will not have that knowledge and asked the board to think about what their children and future generations will have. Ms. Blue said the native Americans in this area are not very visible, but they have walked around and noticed the signs that were in place aze gone. Alvin Klusmann, Jr„ 16306 Francis Rd, Kearney, Mo., the President of the Executive Board of the Indian council of many nations and been in existence 1962 encompassing Indian and non-Indian people all the way from Plattsburg on the north, Belton on the south, Miami, Leavenworth, Wyandotte and Johnson County including Topeka, Ks. and on the other side of Bates City to the east. Mr. Klusmann said he was here to speak against the proposed destruction of the small quantity of land that remains at the Renner- Bremmer site as this ground is sacred to the Indian people and from a historical standpoint. Mr. Klusmann said Riverside acquired this ground to keep it as a sacred trust because in the National Regishy its site is 23PO1, the first site to be placed on the national registry in Platte County. Mr. Klusmamm would like the boazd to reconsider the destmction of the site. Mary Smith, 3009 NW Vivion Road said she lives on the property next to the park. Mary said the park was dedicated as an educational archeological site 20-25 yeazs ago. A promise from the former Mayor Betty Burch said the park would stay the way it was. Ms. Smith said they have had to call Public Safety several times because of the skateboazders fuming picnic tables upside down, bad language and all kinds of things going on that azen't good for any type of park. Ms. Smith's suggestion is to move the skateboazd park and move it to the city hall property where the police can watch the kids. She asked nothing be destroyed at the pazk and to keep it as an educational park and not to move ancient land marks and for the boazd to think about this before moving the playground. Brenda Teters, 2214 NW Homestead Road spoke to the board regazding the city paying for residential trash pickup Brenda asked "Why should she be any different that other residents that get their trash paid for by the city and why she isn't being considered to have her trash bill to be paid by the city?" She says she is no different than the duplexes here m the city or rentals. These people are on city streets as the people in the Homestead area. She does agree with the board, when they previously decided to have resident's trash paid for by the city, that the lazge apartments such as El Chapaaal, Chateau D' Mons etc. are businesses, but she said the Homestead area are not owned by one company. She thinks the board should reconsider paying for their trash charges also. Jay Thorn, Liberty, Mo. said he's been coming here to the Fall Festival yearly and used to come to the Renner-Brenner Park with his children. He believes the park is a major part of Riverside's history and left some history books of the pazk. Kurt Eckazd, 4817 Homestead Rd. agrees with Ms. Teters and owns 2 buildings on Homestead Road. Mr. Eckazd said he has received several letters from the city's code enforcement officers over the last 9 yeazs over the trash dumpsters. Mr. Eckard says he's told the codes officers, when the city starts paying for his trash, like everyone else's. He says the city can do the right thing and he will have his tenants set the trash out at the curb and have the trash company pick up their trash as the residents do now. Now, there Minn. 4/21/09 aze 6 different owners in the Homestead area and 6 different trash companies pick up trash tearing up the streets. The dumpsters are all in different places. Mr. Eckazd would like the board to re-look at the decision and pickup Homestead's trash and pay for it, also. Mary Smith also said she came to the meeting last week regarding the widening of Vivion Road where she lives and noticed when the Cliffview Bridge was built she saw a sidewalk being put in place near her property and the sidewalk ends there. Someone told her years ago the city was going to place a bike trail in this azea and wonders why as the property owners the Smith's haven't been approached regarding this and when the streets to be widened the sidewalk going through their front yazd. This comes back to this being one of the preserved sites as the front yard has never been touched. She is wondering why they were never approached about the sidewalk, bike trail and when the levee was being built, their property in the back had an easement for 3 years and if it was purchased, the Smith's never received any compensation. She said if the city did purchase it and never paid the Smith's for i; when the levee went in they were told to pay $3,500 to have their sewer lines moved which wasn't on their property; it was on the park property. She's confused to why they were charged for a sewer that wasn't on their property and had to be moved because the levee was going in. Mary said she's now being told the city bought that particular property and is going to put the trails through there. Minutes of Apr. 6, 2009 Alderman Hurt moved to approve the minutes for April 6, 2009, seconded by Approved Alderman Bmns, the vote was: Aye: Aldermen Fuller, Super, Dazata, Hurt, Salyer and Bruns. Motion carries. City Annex Remodel Kathy Warman, Wam~an Design Group gave a presentation on the remodel of the city Presentation annex remodel. The old entrance would remain and a new entrance would be made at the front (secondary entrance) and gain some more pazking. The idea is to open up the rooms to make more room. The large room doesn't need much done to it. The windows need to be replaced as they are very small. There would be a lobby area, then directly into the banquet hall, some storage and the stage would remain in place. The restrooms would need to be ADA standards and electrical must be brought up to current codes. She noticed the building has been added onto before. Space would be subdivided for meeting spaces and the banquet hall opened up with some glass. The building needs a new roof and energy efficient HVAC equipment needs to be installed. There is no insulation in the building. The exterior is the biggest challenge as it is a 1958 vintage and needs to be modernized. Ms. Warman recommends to not paint the brick and pull some dazker colors in with the existing brick. A cohesive campus needs to be created. The budget for this remodel is $1.4 million, a little over the city's figure. There could be a small balcony and rotunda added to see as you walk in the building. Mayor Rose said she likes the "flip" in the colors. Alderman Darata said it is "aesthetically great" considering its $1 million less than a new building. Alderman Fuller said we need to look into a certified process to maximize cheap heating and cooling and that will pay for itself in a long run. Ms. Warman said the new building would be 8,000 sq. ft. on the lower floor and 4,000 sq. ft. on the upper floor. The existing building is a little over 14,000 square feet. There would be just under a 1,000 sq. ft. lazger with a new building. Ms. Warman said she did not see anything that was not stmcturally sound. No assessment was done on hazardous materials. Mayor Rose said the question lies with the board as to what they want the building to be. Alderman Bruns said we just need to figure out what we need. Alderman Salyer said it is a good point in doing the comparison and a good thing to look at energy efficiency. Alderman Hurt likes this as Minn. 4/21 /09 an option and what function the board wants it to fulfill. City Administrator The preliminary plans and profile sheets have been completed for Northwood Road Phase Report II and the general limits of work have been established. A public "Open House" meeting has been scheduled for Thursday, May 7, 2009 at the Community Center from 5:00 to 7:00 p.m. Currently 105 out of 225 businesses in the City aze participating in the "Knox Box" program. In the first quarter of 2009, 11,523 people attended 255 individual events, classes or programs at the Community Center. In March, there were 4,247 unique visitors to the City web site, resulting in a 44.5% increase for February 2009 and a 42% increase in Mazch 2008. There were 100 calls for the Mazch Fire Division Statistics totaling 228 for the yeaz. Members of the Department of Public Safety staffed an information booth in the Community Center on Election day to promote several citizen safety programs. On April 161h, the Greystone Apartment Complex received the Ciry's first fully certified Crime Free Multi-Housing rating. The Community Development Activity Report for Apri14-15, 2009 was 19 violations found, 12 resolved and 7 pending resolved. There were 5 vehicle violations and 14 property maintenance violations found. Total violations from 1-1-09 to 4-3-09 were 170, 150 resolved and 120 pending. There were 2 tenant fmishes and 9 miscellaneous pernrits completed and 63 inspections. Public Works provided their update of street functions and operations for Mazch 2009. Middle Line Creek The trail has been graded and base gravel put down. It will not be paved yet until Trail Discussion the Briarcliff Development design is seen. Briarcliff has a haul permit for 100,000 square yazds of dirt to 68th Street and Gower. They have been asked for the majority of the work (dirt) to be hauled on Riverway Blvd. to 9 Highway to I-635 and off at NW 64`h Street. If there is any problem with dirt sliding into the roadway, tracks will be stopped. There will be some trucks coming up middle Gateway to Vivion Road. The word is this project should be done by mid July. Line Creek Bridge Jerry Johnson with Shafer Kline and Warren said there was a public meeting held on Discussion March 19"' as there was good attendance and the project explained and options presented. There was an opinion survey with 24 people and these were received at the public meeting and votes taken with anon-signature survey. This is a Mo- Dot stmcture, but Shafer, Kline and Warren will participate with MoDot to give the results of the public meefing and they will have final approval of what is done, but will be Shafer, Kline's suggestion. Mayor Rose said she talked with Northmoor people and they had the most concerns about closing the bridge. March or Apri12010 constmction will start. The schedule will be made to fit with businesses and the school district. This will not be done the same time as NW 641° Street constmction is going on. Sixty working days would be day shift only. An idea can be formed with the City Attorney and design team to come up with a program that would be fair to the Contractor to expedite the project.' Mr. Johnson said there would be some additional cost to expedite the project because 2 shins would occur, but no overtime and it would not be a major additional cost. Mins. 4/21/09 Alderman Darata said signage needs to be posted stating businesses will still be open. The idea is to get the business people and others in here and tell them the plan that is suggested at this time. Something will be put together and they will meet with City staff and work out a no- premium schedule and work an incentive, de-centive to put in the specs. The consensus of the boazd is to do full closure of the bridge to complete the project. Homestead Road will require some additional right-of--way and some temporary right-of--ways. Change Order for Alderman Dazata moved to approve a change order for Argosy Pazkway Westin the Argosy Parkway West amount of $60,425.15, seconded by Alderman Bruns, the vote was: Approved Aye: Aldermen Fuller, Bruns, Darata, Salyer, Hurt and Super. Motion carries. This project has been submitted to the American Public Works Association for an award. Change Order for Alderman Fuller moved to approve a change order for the Horizons Erosion Repair for Horizons Erosion Repair, R. A. Knapp to correct headcutting and erosion at a cost of $65,000, seconded by Approved Alderman Hurt, the vote was: Aye: Aldermen Super, Fuller, Bruns, Darata, Salyer and Hurt. Motion carries. Change Order for Alderman Bruns moved to approve a change order for the Welcome Plaza and West Welcome Plaza Platte Right-of--Way at a cost of $13,610, seconded by Alderman Dazata, the vote was: & W. Platte R-O-W Approved Aye: Aldermen Hurt, Super, Fuller, Bruns, Darata and Salyer. Motion carries. Vivion Road West Matt Eblin, Shafer, Kline and Warren said the bids for the Vivion Road project were Project comments received last Friday and J.M. Fahey was the low bidder. There is a time constraint with this project because of school. Matt said he cleared up several items with Fahey today on extras. Alderman Hurt's Alderman Hurt said there will be a new hire May 1" for the Levee Board to do outside comment inspections. There will be a new sandbag technique demonstrafion on Wednesday at 2 p.m City Administrator David said 1 mower bid was received and it was with propane. He asked the boazd to comment to reject the bid and go out for new bids. Go out for new bids Alderman Fuller moved to approve Public Works going out for new bids for a mower for a mower for Public for Public Works, seconded by Alderman Super, the vote was: Aye: Aldermen Fuller, Bruns, Hurt, Super, Hurt and Super. Motion carries. Motion carries. Mayor's Discussion Mayor Rose said there is a newly elected officials training program coming up in June. Last week was the 2009 recycle challenge and the Independence Mayor is ready to go and will call several of the communities for particulars. Mins. 4/21/09 Mayor Rose saw a lady at the Welcome Plaza acting like a sundial. The information (items) was sent over today to be placed in the time capsule. The Mayor's caucus will be Friday Apri124'" at Independence The theme for Riverfest this yeaz is "An Island State of Mind" with entertainment from the Coconuts From Florida group. Mayor Rose thanked the boazd for letting her attend the Leadership Class this last week and loved it. She met the Duector of SEMA and very nice compliments for Mike Shelton. She met Robert Creason with the Public Service Commission and Jason Grill. Aldermen's comments Alderman Bruns complimented the Fire Department on touring the facilities with the new staff. The scouts need to know what day they can come to visit. He said he had some questions about the playground equipment and the bidding process. Mike Duffy said it hasn't been decided yet if we will `get rid' of the equipment or the process. Alderman Salyer asked about the storm water remediation project on 50'" Street. Matt said they aze working on it. Alderman Salyer thanked everyone for his serving the community. Alderman Darata said she was proud to have served the community for 12 years. Recognition of Service Mayor Rose presented Alderman Dazata and Alderman Salyer with plaques for their years of service. Chief Mills presented both Aldermen with `night sticks' and a small plaque on the sticks. Swearing In Ceremony Louise Rusick, City Clerk swore in Aldermen Fuller, Thatcher and Cope.
