HomeMy WebLinkAbout2009-050 - Purchase of Conspan Precast ArchBILL N0.2009-50 ORDINANCE NO. 2009-50 AN ORDINANCE AUTHORIZING THE MAYOR TO EXECUTE AN AGREEMENT WITH CONTECH CONSTRUCTION PRODUCTS, INC. FOR PURCHASE OF CONSPAN PRECAST ARCH UNITS FOR THE VIVION ROAD WEST PROJECT WHEREAS, the City of Riverside, Missouri ("City") has received a proposal and engaged in negotiations with CONTECH Construction Products, Inc. ("CONTECH") for provision of CONSPAN Precast Arch Units, including precast headwalls and wingwalls, for the Vivion Road West Project (the "Products"); and WHEREAS, the City and CONTECH have reached an agreement concerning the provision of and payment for the Products. NOW, THEREFORE, be it ordained by the Board of Aldermen of the City of Riverside, Missouri, as follows: Section 1. This Ordinance is intended and is hereby detemuned and declared to be necessary to accomplish and serve the public purpose of improving public safety and traffic conditions on Vivion Road. Section 2. The Board of Aldermen finds that CONTECH is the only company capable of providing the Products and associated professional services, and the purchase is in the best interests of the City. Section 3. The City of Riverside shall enter into an agreement whereby CONTECH shall provide the Products as described in Exhibit A attached hereto to the City at a total cost of $345,500.00 (the "Agreement"). Section 4. The execution and delivery of the Agreement, in substantially the form attached hereto as Exhibit A, is approved, and the Mayor is authorized to execute the Agreement and to take such other actions reasonably necessary to carry out the intent of this Ordinance on behalf of the City, the execution of the Agreement being conclusive evidence of such approval. Section 5. The Mayor, the City Administrator, the City Attorney and other appropriate City officials are hereby authorized to take any and all actions as may be deemed necessary or convenient to cant' out and comply with the intent of this Ordinance and to execute and deliver for and on behalf of the City all certificates, instruments, agreements and other documents, as maybe necessary or convenient to perform all matters herein authorized.
