HomeMy WebLinkAbout2060 Authorizing an Agreement with TDR Construction Inc.- Abandoned Oil Wells BILL NO. 2025-015 ORDINANCE NO. 2060 AN ORDINANCE AUTHORIZING AND APPROVING THE EXECUTION BY THE CITY OF AN AGREEMENT WITH TDR CONSTRUCTION INC., TO EXCAVATE, CUT AND/OR PLUG CERTAIN ABANDONED OIL WELLS WHEREAS,the City Engineer has identified at least four(4) abandoned oil wells that need to be excavated, cut (3) and/or plugged (1) within the Horizons city owned property; and WHEREAS, the City Engineer together with the Missouri Department of Natural Resources determined it is most expedient for the City to retain a company to do the work; and WHEREAS, TDR Construction, Inc., ("Company") submitted bids, attached hereto and incorporated herein as Exhibit A, Four Thousand Five Hundred and 00/100 ($4,500.00) to cut and excavate three abandoned oil wells and Exhibit B Thirty-Three Thousand and 00/100 Dollars ($33,000.00) to complete the work to plug one abandoned oil well; and WHEREAS, the City finds that it is necessary and in the best interests of the health safety and welfare of the citizens and businesses of the City, to further the objectives of the TIF Plan, and the objectives of industrial and economic development for the City, to authorize and approve the proposed Agreement, attached hereto, and incorporated herein, between the City of Riverside and TDR Construction Inc. NOW THEREFORE BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF RIVERSIDE, MISSOURI, AS FOLLOWS SECTION 1 -- BEST INTEREST OF THE CITY. The Recitals set forth above in this Ordinance are incorporated into and made a part of this Agreement as if fully set forth in this Section 1, the Board of Aldermen hereby find and determine that accepting the bids to excavate, cut and plug certain abandoned oil wells, attached hereto and incorporated herein as Exhibit A and Exhibit B, with TDR Construction, Inc., will further the objectives of the TIF Plan and the objectives of industrial and economic development of the City, fulfill a public purpose and will further the health, safety and welfare of the citizens and businesses of the City, and the growth of the City, facilitate the development of the Riverside Horizons Area, improve the environment of the City, increase the assessed valuation of the real estate situated within the City, increase the sales tax revenues realized by the City, foster increased economic activity within the City, increase employment opportunities within the City, enable the City to direct the development of the Area, further the health, safety, and welfare of its residents and taxpayers, and that the City's acceptance of the submitted bid of the services of TDR Construction, Inc as attached hereto and incorporated herein as Exhibit A, Four Thousand Five Hundred and 00/100 ($4,500.00) to cut and excavate three abandoned oil wells and Exhibit B Thirty-Three Thousand and 00/100 Dollars ($33,000.00) to complete the work to plug one abandoned oil well is in the best interests of the City. SECTION 2 -- AUTHORITY GRANTED. The City is hereby authorized to accept the submitted bids as provided for by Section 2 of this Ordinance, the Mayor, the City Administrator, the City Attorney, the Special Counsel to the City, the Finance Officer and other appropriate City officials are hereby authorized to take any and all actions as may be deemed necessary or convenient to carry out and comply with this Ordinance consistent with the Ordinances of the City and the laws of the State of Missouri. WA 4320116.1 SECTION 4 - FAILURE TO COMPLY. That failure to comply with all the provisions contained in this ordinance shall constitute violations of this ordinance. SECTION 5 -SEVERABILITY CLAUSE. The provisions of this ordinance are severable and if any provision hereof is declared invalid, unconstitutional, or unenforceable, such determination shall not affect the validity of the remainder of this ordinance. SECTION 6-EFFECTIVE DATE. This ordinance shall be in full force and effect from and after the date of its passage and approval.
