HomeMy WebLinkAbout1999-04-06Minutes of Regalar Meeting Board of Aldermen of City of Riverside, Missouri April 6,1999 A regular meeting of the Board of Aldermen of the City of Riverside, Missouri was held in the Cfty Hall in Riverside, Missouri on April 6,1999 at 7:30 p.m. Those do attendance were: Mayor Ed Rule, Aldermen Ran Super, Brenda Teters, Pamela Darata, Betty Burch, Ray Beard and George Flaws. Also present were Ann Daniels, City Administrator, Louise Rusick, City Clerk, Chief Robert Bayless and Steve Crystal, City Attorney. Minutes, March 16,1999 Alderman Teters moved that the minutes of March 16,1999 be Approved. approved, seconded by Alderman Beard, the vote was: Aye: Aldermen Super, Darata, Beard, Burch, Teters and Flaws. Motion Canted. Comments by Visibrs Dale ReiW, 919 N.W. Valley Ln, Riverside, Mo. requested the board draft an ordinance to make it illegal for minors to possess cigarettes in Riverside. Jan Schwarz, 764 N.W. Schwarz Rd., Gower, Mo. ,Tobacco Control Specialist for the American Caneer Society spoke on the issue. Mrs. Schwarz said if we would adopt an ordinance making it ~7legal for those under the age of 18 b possess bbacco prodacb within the city limits, any minors in violation of the ordinance would attend an education program with their parents. The board decided to obtain more information from other cities before making a decision on drafting an ordinance. Dick Winner's report Alderman Darata and Burch stated there isn't any courtesy shown to property owners b notify them when construction work b going b be dons Alderman Darata asked why some of the retaining wall was torn oul. Ann Daniels, City Administrabr reported because of the curvature of the wall and Rose•Lan b paying for fhb change. Mr. Moats , 5026 NW High, Riverside, Mo. has complained that the street b going b be higher than his driveway and hard b enter and exit. Dick Winner, City Engineer and Charlie Purcell with TranSystems will talk m Mr. Moats regarding this matter. Mr. and Mrs. Gak McKcehan, 5102 NW High Dr., Riverside, Mo. rnmplained that when dte retaining Wald was removed 6y Larkin Excavating the vibration caused by that removal caused or enhanced cracking on walls at their house. Mayor Ruk suggested that Dick Winner call John Larkin, Larkin Excavating b dbcuss this matter. i Minutes of Reg. Meeting, Apr. 6,1999 Page 2 Mayor Rule said the residents should talk to Dick Winner regarding construction problems. Dick Winner is to confirm that the drain is open oa 45"' C>: Alderman Beard's Alderman Beard has been talking with the surveyors and explained comments on Florence Rd. to Mr. and Mrs. Poe, 3002 NW Florence Rd., Riverside,Mo. that the right-of-way line will not be moved; the street wiII go from the center of the r~ht-of-way to the north in front of the Pce's house then swing soutl- to the center of the right of-way in front of the Pce's on the west to look as though they have more front yard. The new right-of-way is 50' wide according to the plans. Approval for Shafer, Alderman Burch moved to approve Shafer, Kline & Warren to Kline & Warren to stake the southwest corner of the Pce's property, seconded by stake souWwest corner Alderman Darata, the vote was: of Pce's property. Aye: Aldermen Darata, Beard, Super, Teters, Flaws and Burch. Motion Carried. Municipal Court Report Mayor Rule reported the Municipal Court Report was received for the month of March. Ann Daniels report on Missouri American Water Co. sent a letter to the City stating a flyer Mo. American Water Co. would be included in water tilt to customers concerning letter crytosporidium in crytosporidium in the water. This tells of precautions that the water. customers with severely compromised immune systems should take wiW their drinking water as part of their daily health care regimen. Public Hearing, Apri124s' A public bearing will be held on Tuesday, April 20"' at 7:30 p.m, to consider proposed amendments to Chapter lV: Land Use section of the Municipal Codes. Employee's Christmas The board decided the employet~Christmas party will be held at Party. Argosy. Alderman Burcb's question Jeremiah Finnegan ,Finnegan, Conrad & Peters invoiced the city regarding J. Finnegan's for 515,000 to defend us and several surrounding cities regarding the bill. water rate case. Ann explained we bill the rest of the cities for the difference owed. No ruling has been made from the Mo. Public Service Commission. Bill No. 99-24 Alderman Flaws moved to place Bill No. 99-24 on its first reading, Payment of Bills. said Bill provides for the payment of certain indebtedness as listed therein, seconded by Alderman Beard, the vote was: Minutes of Reg. Meeting, Apri16, 1999 Page 3 Aye: Aldermen Beard, Super, Teters, Flaws, Burch and Darata. Motion Carried. Ordinance No. 99-24 Alderman Beard moved to place $ill No. 99-24 on its second reading, Approved. and upon passage of same become Ordinance No. 99-24, seconded by Alderman Flaws the vote was: Aye: Aldermen Super, Teters, Flaws, Burch, Darata and Beard. Motion Carried. Recess at 8:35 p.m: A recess was called and the meeting reconvened. Those present were Meeting reconvened at Mayor Rule, Aldermen Super, Teters, Darata, Burch, Beard and 8:50 p.m. F>aws. Also present were Ann Daniels, City Administrator, Louise Rusick, City Clerk and Steve Crystal, City Attorney. Into closed session Alderman Teters moved that the meeting go into closed session 8:50 p.m. pursuant to RSMO 610.021(1) for legal issues, seconded by Alderman Super, the vote was: Aye: Aldermen Teters, Flaws, Super, Darata, Beard and Burch. Motion Carried. Into regular session. Alderman Beard moved that the meeting go into regular session, 9:00 p.m. seconded by Alderman Flaws, the vote was: Aye: Aldermen Beard, Super, Teters, Flaws, Burch and Darata. Motion Carried. Alderman Burch's Alderman Burch reported that David Brenner has resigned comment. from the TIF Commission. Adjournment: Alderman Burch moved the meeting adjourn, seconded by Alderman Beard, the vote was: Aye: Aldermen Flaws, Darata, Super, Burch ,Teters and Beard.
