AUGUST 17, 1999 The Board of Aldermen for the City of Riverside, Missouri, entered into a Closed Session pursuant to RSMO 610.021 (1) for discussion of a legal issue on Tuesday, August 17, 1999 in the Board Room at City Hall, 4500 NW High Drive, Riverside, Mo., upon a motion by Alderman Darata, and voted unanimously by the Board. The meeting was called to order by Mayor Ed Rule. Roll call was answered by the following: Aldermen Beard, Burch, Teters, Flaws, Super and Darata. Also present were Steve Crystal, City Attorney, Deborah Polk, City Attorney, Ann Daniels, City Administrator and Louise Rusick, City Clerk. After discussion, Alderman Beard moved to place Bill No. 99-62 on its first reading, said Bill authorizes and approves the City of Riverside, Mo. to acquire the land and improvements commonly known as P.LC. Plaza and all associated appurtenances and improvements (The "Property"). Whereas, the City is authorized to acquire property for parks and parkland; and Whereas, the City desires to so acquire the real property described as Exhibit (the "Property"; Whereas, the City desires to make an attempt to reach agreement for purchase of the Property as hereafter provided and the City shall make a final offer in the amount of $140,000, seconded by Alderman flaws, the vote was: Aye: Aldermen Super, Darata, Beard, Teters and Flaws. No: Alderman Burch. Motion carries. Alderman Teters moved to place Bill No. 99-62 on its second reading, and upon passage of same becomes Ordinance No. 99-62, seconded by Alderman Beard, the vote was: Aye: Aldermen Teters, Super, Flaws, Darata and Beard. No: Alderman Burch. Motion carries. After discussion, Alderman Super moved to place Bill No. 99-63 on its first reading authorizing and approving the City of Riverside, Mo. to acquire the land and improvements commonly known as P.I.C. Plaza and all associated appurtenances and improvements (the "Property"), by exercise of its power of eminent domain by negotiation in the event it is unable to acquire the property by purchase, seconded by Alderman Teters, the vote was: Aye: Aldermen Super, Darata, Beard, Teters and Flaws. No: Alderman Burch. Motion carries. T • M Page 2 Alderman Super moved to place Bill No. 99-63 on its second reading, and upon passage of same becomes Ordinance No. 99-63, seconded by Alderman Beard, the vote was: Aye: Alderman Super, Flaws, Darata, Teters and Beard. No: Alderman Burch Motion carries. Alderman Teters moved the meeting go into open session, seconded by Alderman Super, the vote was: Aye: Alderman Burch, Teters, Flaws, Super, Darata and Beard.
